The record in brief

ScopeNew York City (Manhattan, Brooklyn, Queens, the Bronx, Staten Island) mayoral Emergency Executive Orders, Department of Health and Mental Hygiene (DOHMH) Commissioner's Orders and Board of Health orders, Department of Buildings notices, Department of Education closures, Metropolitan Transportation Authority (MTA) transit orders; Nassau, Suffolk and Westchester County executive orders.

New York City operated under a continuous local state of emergency from March 12, 2020 (Emergency Executive Order No. 98, Ex. MET-NYC-001) through and beyond September 30, 2021, renewed every thirty days without a break (Exs. MET-NYC-022 to 034, 014, 016, 018, 020); every substantive order was re-extended every five days by its own numbered successor, so the City issued more than 250 numbered emergency orders in the eighteen months at issue. In the run-up to the second quarter of 2020 the Mayor acted before and alongside the Governor: EEO 99 (Mar. 15) cancelled every gathering over 500 and capped every gathering place at 50 percent occupancy; EEO 100 (Mar. 16) closed every restaurant, bar and cafe except for take-out and delivery at 8:00 p.m. that day, closed every entertainment venue and commercial gym, and directed every hospital and ambulatory surgery center in the City to cease elective procedures within 96 hours; EEO 101 (Mar. 17) banned pooled for-hire rides; EEO 102 (Mar. 20) closed barbershops, salons, nail and tattoo parlors (Mar. 21), closed the indoor common areas of every mall over 100,000 square feet and every place of public amusement, cancelled every gathering over 50, and ordered every business and not-for-profit to telecommute to the maximum extent and to cut its in-person workforce by 50 percent by 8:00 p.m. that night; EEO 103 (Mar. 25) raised the in-person workforce reduction to 100 percent for every non-essential business and cancelled every non-essential gathering of any size for any reason. The Department of Buildings suspended all non-essential construction and demolition for the duration of the emergency (Exs. MET-NYC-050, 051), and the Board of Health closed center-based child care and 3-K/pre-K programs from April 3 to July 12, 2020 (Ex. MET-NYC-038). Nassau (Mar. 13 and 15), Suffolk (Mar. 12) and Westchester (Mar. 16) declared their own emergencies, closed county facilities, stayed evictions and closed every public and private school in their counties before the State did (Exs. MET-NYC-052 to 054, 058, 059). The MTA closed the subway overnight from May 6, 2020 (Ex. MET-NYC-047). The City's New York Forward phases ran a month behind the rest of the State: Phase 1 June 8, Phase 2 June 22 (outdoor dining only; Open Restaurants, Ex. MET-NYC-007), Phase 3 July 6 and Phase 4 July 20, 2020, each without indoor dining, gyms, malls or museums; personal care reopened July 7 with face-uncovering services still prohibited (Ex. MET-NYC-025); gyms reopened September 2, 2020 under DOHMH attestation and inspection with indoor group classes prohibited (Ex. MET-NYC-010); indoor dining did not reopen until September 30, 2020 at 25 percent (State). Throughout the third and fourth quarters of 2020 and the first quarter of 2021 the City enforced the State's traveler quarantine with Sheriff's checkpoints at the City line (EEO 137, Aug. 5, 2020) and required every hotel and short-term rental to bar guests from restricted States who had not completed the Traveler Health Form (EEO 141, Aug. 21, 2020; EEO 159, Nov. 3, 2020), rules revoked only on May 22, 2021 (Ex. MET-NYC-013); it refused permits for street events, parades and fairs (EEO 130 s. 4, July 7, 2020, renewed through 2021); the DOHMH closed every public and non-public school in the State's Red and Orange cluster zones in Brooklyn and Queens from October 2020 (Ex. MET-NYC-039) and imposed distancing, masking, reporting and 14-day quarantine rules on every non-public and charter school for the whole 2020-21 school year (Ex. MET-NYC-044); the Department of Education closed all school buildings November 19 to December 7, 2020 (secondary source only). The State closed NYC indoor dining again December 14, 2020 to February 12, 2021. The second quarter of 2021 saw the checkpoints and hotel rule end (May 22), the subway return to 24-hour service (May 17), the DOHMH school order rescinded (May 10) and the State lift capacity limits (June 15) and its own emergency (June 24), while the City's emergency and its Open Restaurants, Open Storefronts, outdoor-heater, OATH remote-hearing and hotel-tax orders were all re-extended into July (Ex. MET-NYC-015). The third quarter of 2021 is not a quarter without orders in New York City: the local emergency was renewed June 26, July 26, August 25 and September 24; the DOHMH ordered vaccination or weekly testing for DOHMH clinical and Health + Hospitals staff by August 2 (Ex. MET-NYC-035) and for every staff member and contractor at City shelters, supportive housing and congregate programs from August 16 (Ex. MET-NYC-036); the Mayor's Key to NYC program (EEO 225, Aug. 16, effective Aug. 17, 2021, restated Aug. 25, Sept. 14 and Sept. 24, penalties from Sept. 13) forbade every indoor restaurant, bar, gym, theater, museum, arena, convention center and event venue in the five boroughs to admit any patron, employee or contractor without proof of vaccination, on pain of fines of $1,000 to $5,000 (Exs. MET-NYC-017 to 019, 021); the DOHMH ordered every DOE employee, contractor, charter-school and DOE-building program employee (Aug. 24; restated Sept. 15; deadline moved to Oct. 1 after the Second Circuit's Sept. 24-27 injunction, Exs. MET-NYC-040 to 042), every DOE-contracted early-childhood and after-school program's staff (Sept. 12, Ex. MET-NYC-043) and every student in high-risk sports and activities (Sept. 15, Ex. MET-NYC-037) to be vaccinated; and the MTA continued to enforce the federal transit mask requirement with its $50 fine (Ex. MET-NYC-046). End of general restrictions

Instrument For the City's own orders: EEO 203 s. 2 (May 22, 2021) revoked the boundary checkpoints (EEO 137) and the hotel Traveler Health Form rule (EEO 141/159); the DOHMH rescinded its school health-and-safety order May 10, 2021 (Ex. MET-NYC-045); the MTA restored 24-hour subway service May 17, 2021 (Ex. MET-NYC-048). The general business capacity, gathering and distancing limits that governed the City were the State's (lifted June 15, 2021.

What remained in force

The State and the local orders

New York did not preempt or bar New York City's local COVID-19 orders. Under N.Y. Executive Law s. 24 a local chief executive's emergency orders may not be inconsistent with the Governor's, and every NYC order recited that it 'incorporates any and all relevant provisions of Governor Executive Order No. 202 and subsequent orders' (e.g., EEO 103 s. 4; EEO 155 s. 3). The City's orders ran concurrently with and in several respects ahead of the State's (gathering caps and closures Mar. 15-16, 2020; workforce reductions Mar. 20 and 25, 2020; gyms held closed until Sept. 2, 2020 after the State allowed Aug. 24; Key to NYC and the DOHMH vaccination orders of July-Sept. 2021 with no State counterpart). Litigation history within the period: the Second Circuit temporarily enjoined the DOE staff vaccination order on Sept. 24, 2021 and dissolved the injunction on Sept. 27, 2021 (recited in Ex. MET-NYC-042); the DOHMH moved the proof deadline to Oct. 1, 2021. Nassau, Suffolk and Westchester issued their own declarations and school and facility closures in March 2020; the State's EO 202.4 (Mar. 16, 2020) then closed schools statewide from Mar. 18, 2020, and the county orders were subsumed.

Hotels and short-term rentals

Every hotel, motel, inn, short-term rental and temporary lodging business required from Aug. 21, 2020 to question arriving guests about travel from restricted States and to refuse a room until the State Traveler Health Form was completed, enforced by the Sheriff with Health Code penalties and a class B misdemeanor (EEO 141, Ex. 009; restated EEO 159, Ex. 012); revoked May 22, 2021 (Ex. 013); hotel occupancy tax reduced June 1-Aug. 31, 2021 as a relief measure (EEO 202 s. 1 as extended by Ex. 015).

Offices and telework

Every business and not-for-profit ordered to telecommute to the maximum extent and reduce in-person workforce 50 percent by 8:00 p.m. Mar. 20, 2020 (EEO 102 s. 6, Ex. 005) and 100 percent from Mar. 25, 2020 except essential businesses under EO 202.6 and ESD guidance (EEO 103 s. 2, Ex. 006); State office reopening Phase 2 (June 22, 2020) at 50 percent and later steps; ULURP and land-use hearings remote (EEO 100 s. 2; EEO 188, Mar. 13, 2021); OATH hearings remote through Q3 2021 (EEO 177 ss. 2-5 as extended by Ex. 015).

Manufacturing
