In plain terms: if you run a bank, a credit union, a mortgage or consumer lender, a loan servicer, an insurance agency or carrier, or an advisory firm, the governmental orders of 2020 and 2021 reached your business twice over. They reached the places where you meet the public: branch lobbies confined to drive-through and ATM service, capped at 25 or 50 percent, placed under screening, distancing and face-covering rules with a duty on you to enforce them; contact centers and back offices emptied by telework mandates in March 2020, refilled under caps, emptied again in the winter of 2020-21. And they reached the way you collect what you are owed: from March 18, 2020 to July 31, 2021 no servicer could foreclose on a federally backed mortgage; from September 4, 2020 to July 31, 2021, and again from August 3 to August 26, 2021, no residential eviction could proceed anywhere in the nation; forbearance was compelled on the borrower's word; nineteen States and the District stayed foreclosures, evictions, garnishments or repossessions into the third quarter of 2021; insurance regulators in more than thirty States forbade cancellations and ordered refunds; and the recorders, motor-vehicle offices, courts and sheriffs your loans depend on closed or ran by appointment.

This page walks through the fourteen functions of a financial-services employer, the layers of government whose orders reached each one, the six quarters one by one, and the fourteen sentences the Internal Revenue Service (the "Service") uses in its letters, each answered from the public orders held in this site's Orders Library (the "Library"). The statute's operative text, called here the "Suspension Clause", asks whether an operation was fully or partially suspended during a quarter due to such orders; Notice 2021-20 (the "Notice") is the Service's own guidance on it, and the "United States" is the Government as it has spoken in court. The quarter the Service's letters most often dispute is the third quarter of 2021, and the record answers it: the orders in force from July 1 to September 30, 2021 are listed below by name, date and operative clause.

Partial suspension, element by element

Every analysis on this site asks the same five questions in the same order. Here they are asked of Financial Services, from the industry's own record.

  1. The order: issuer, instrument, date, exhibit.The Library holds 73 instruments from this industry's own regulators and sector authorities and 55 organizer notices. The earliest is Congress (CARES Act sec. 4021, Pub. L. 116-136, 134 Stat. 281, 489), codified at 15 U.S.C. 1681s-2(a)(1)(F), 15 U.S.C. 1681s-2(a)(1)(F) (Reporting information during COVID-19 pandemic) (Mar. 27, 2020) (Ex. SEC-13-017).   2. The function of the business it reached.The orders named the functions of the business in terms.   3. The change it compelled: the operative words.The operative words of 15 U.S.C. 1681s-2(a)(1)(F) (Reporting information during COVID-19 pandemic) (Ex. SEC-13-017): “The term 'accommodation' includes an agreement to defer 1 or more payments, make a partial payment, forbear any delinquent amounts, modify a loan or contract, or any other assistance or relief granted to a consumer who is affected by the coronavirus disease 2019 (COVID-19) pandemic during the…” Each record page quotes the operative words in full, with the enforcement provision beside them.
  4. The quarter: in force on which days.Every instrument carries the quarters it was in force. The six quarters sets out what was in force in each, and the third quarter of 2021 is listed instrument by instrument below.
  5. The statute's answer.A partial suspension is a temporary delay, interruption or termination of a portion of the business's operations; the order need only be the but-for cause of it; and nothing in the Suspension Clause asks whether the business was essential, stayed open, could telework or served customers who were themselves under orders (Tri-State Memorial Hospital v. Function codes

The analysis describes the business as fourteen functions, each with a two-letter code that every page of this set uses without variation. An order “reached” a function when its operative words told the business what that part of it could do, when, where, for how many and on what conditions.
