The record in brief

Wyoming never issued a stay-at-home order. It governed the pandemic through the Governor's Executive Order 2020-2 (March 13, 2020, declaring a state of emergency and a public health emergency under W.S. 19-13-102, 19-13-104 and 35-4-115(a)(i), in force until Executive Order 2022-03 rescinded it on March 15, 2022), and through four numbered Statewide Public Health Orders of the State Health Officer under W.S. 35-1-240(a)(i), (ii) and (iv), each enforced by criminal prosecution under W.S. 35-1-105 and 35-1-106 (a misdemeanor punishable by a fine of up to $1,000 or imprisonment of up to one year), and each continued, modified and renumbered every two weeks for fourteen months. Order #1 (March 19, 2020) closed to the public all restaurants, bars, cigar bars, gymnasiums and theaters, closed child care except for children of essential personnel, dismissed all K-12 schools and barred in-person instruction at colleges, universities and trade schools; Order #2 (March 20, 2020) forbade gatherings of ten or more people in a single room or confined space; Order #3 (March 24, 2020, effective March 25) closed nail and hair salons, barber shops, cosmetology, electrology and esthetic services, non-medical massage, and tattoo, body art and piercing shops. The Governor's Statewide Directive of April 3, 2020 required every person arriving from another State or country for a non-work-related purpose to self-quarantine for fourteen days and required hotels and short-term rentals to post the quarantine in their listings; it ended May 8, 2020. Each statewide order superseded county orders while preserving more restrictive county provisions, and from May 1, 2020 each authorized Countywide Variance Orders, less or more restrictive, signed by both the County Health Officer and the State Health Officer. 2020 Q2: the closures ran through April 30; on May 1 gymnasiums and child care reopened under conditions and personal services reopened by appointment with face coverings, screening and no waiting areas while restaurants, bars and theaters stayed closed to on-premises service and the ten-person gathering ban continued; on May 15 restaurants and bars resumed seated service (groups of six, tables six feet apart, staff face coverings, no buffets, no dances or karaoke), theaters reopened in limited capacity, child care groups rose to 25, the gathering cap became 25 (worship and funerals exempt with conditions), and schools were authorized limited on-site instruction; on June 1 outdoor gatherings of up to 250 were permitted with conditions and indoor events remained at 25; on June 15 indoor gatherings rose to 250 with distancing (50 without), and K-12 schools, colleges and trade schools were authorized on-site instruction in groups of no more than 50 per room. The Wyoming Supreme Court's Temporary Plan of March 18, 2020 suspended in-person proceedings in every State court, and its Fourth Order (June 12, 2020) barred jury trials before August 3, 2020. 2020 Q3: the Seventh through Thirteenth Continuations (effective July 1 through October 15) held restaurants, bars, gymnasiums, theaters and personal services to seated service, six-person groups (eight from October 1), six-foot spacing, staff face coverings, screening logs and sanitation rules; forbade gatherings of more than 50 people (events of up to 250 indoors, and outdoors up to 50 percent of venue capacity to a maximum of 1,000, only with conditions); and, from August 1, 2020, required students, teachers and school staff to wear face coverings where six feet of separation could not be maintained, with groups capped at 50 per room. 2020 Q4: the Fifteenth Continuation (effective November 1) carried the same regime; the Seventeenth Continuation (November 19, effective November 24) re-tightened gatherings to 25, capped indoor events at 25 percent of capacity and 100 people and outdoor events at 50 percent and 250, and confined sports and performance participants to groups of 25; county face-covering orders approved by the State Health Officer took effect in Laramie County (November 2), Teton County (July 21) and, by November 18, in at least twelve counties; and the Eighteenth Continuation and Statewide Public Health Order #4 (December 7, effective December 9) imposed the first statewide face-covering requirement in businesses, government facilities, health care and transportation, barred on-premises consumption in bars and restaurants from 10:00 p.m. to 5:00 a.m., cut groups from eight to six and gym classes from 25 to 10, and limited gatherings to ten. 2021 Q1: the Eighteenth Continuation and Order #4 governed through January 8; the Nineteenth (effective January 9) kept the ten-person cap while restoring late-night bar service; the Twentieth (January 26 to February 14), Twenty-first (February 15 to 28) and Twenty-second (March 1 to 15) eased groups to eight and then ten, permitted buffets, raised event caps and, on March 1, ended Order #3; Order #4 expired March 15, and the Twenty-third Continuation (March 12, effective March 16) removed all restrictions and requirements for all businesses and entities except child care facilities, K-12 schools, colleges, universities and trade schools, and removed the personal-gathering restriction while keeping indoor events of more than 500 people at 50 percent of capacity. 2021 Q2: the Twenty-fourth through Twenty-seventh Continuations (April 1 through May 31) kept the school and child-care face-covering and distancing requirements and the large-indoor-event rule; the statewide orders expired May 31, 2021 and none was issued thereafter. 2021 Q3: Executive Order 2020-2 remained in force (until March 15, 2022); the Supreme Court's Temporary Plan and its procedural orders remained in force (extended thirteen times, most recently July 7, 2022, and terminated effective February 1, 2023); 2021 Wyo. Sess. Laws ch. 168 (HEA 93, effective July 1, 2021) limited any new health order restricting movement or activity to ten days and reserved subsequent orders to the Governor (60 days) or, for local orders, to the county commissioners or municipal governing body; Teton District Public Health Order #21-5 (August 26, 2021), approved by the State Health Officer, required face masks in every business and government facility open to the public, health care facility, taxi and public conveyance and in every K-12 school and postsecondary institution in Teton County through September 4, 2021 unless extended; the University of Wyoming required masks indoors wherever six-foot distancing was not possible from August 16, 2021, required entry testing of every student and employee August 18-22, 2021, and extended the requirement indefinitely on September 17, 2021; and Laramie County School District No. 1 and Albany County School District No. 1 adopted indoor mask mandates on September 8, 2021, with Teton, Sheridan and Goshen county districts adopting theirs in the preceding two weeks. No statewide business, gathering, mask or travel order was in force in Wyoming in the third quarter of 2021.

What remained in force

Executive Order 2020-2 (state of emergency and public health emergency) until March 15, 2022; Order #1 as continued for child care facilities, K-12 schools, colleges, universities and trade schools (face coverings indoors where six feet of separation cannot be maintained, distancing, screening; room caps removed April 1, 2021) through May 31, 2021; Order #2 as continued for indoor events of more than 500 people (50 percent of venue capacity with mask protocols) through May 31, 2021; the Wyoming Supreme Court's Temporary Plan and procedural orders through February 1, 2023; Countywide Variance Orders and county health officer orders approved by the State Health Officer (e.g., Teton District Order #21-5, August 26, 2021); the University of Wyoming's indoor mask and entry-testing requirements from August 16, 2021; school district mask mandates from late August and September 2021; the federal general layer (CDC conveyance mask order; TSA security directives; OSHA Healthcare ETS from June 21, 2021.

Preemption of local orders

Wyoming did not preempt or bar local orders; it channeled them through the State Health Officer. Under W.S. 35-1-240(a)(iv) county health officers act 'under the direction and supervision of the State Health Officer,' and every statewide order recited that it 'supersedes all previous individual county orders authorized by the Wyoming State Health Officer under Wyoming Statute 35-1-240(a)(iv). To the extent the county order is more restrictive, the more restrictive provisions still apply' (Order #1 para. 7, Ex. WY-004; Order #2 para. 7, Ex. WY-005; Order #3 para. 5, Ex. WY-006). From May 1, 2020 each statewide order authorized 'countywide variances... in the form of a Countywide Variance Order, if approved by the County Health Officer and the State Health Officer,' which 'may be less restrictive (or more restrictive) than the measures imposed in this Order' (Ex. WY-014 para. 5; WY-015). County face-covering orders were issued by county health officers and approved in writing by the State Health Officer (Laramie County Order #10-2020 recital: 'Alexia Harrist, MD, Ph.D., the Wyoming State Health Officer has reviewed and does hereby authorize the issuance of this Order,' Ex. WY-035; Teton District Orders #20-6 and #21-5 likewise). From July 1, 2021, 2021 Wyo. Sess. Laws ch. 168 (HEA 93) added W.S. 35-1-310 and 35-1-240(c): a county, municipal or district health officer's order restricting movement or activity requires 48 hours' public notice and comment (absent immediate and life-threatening harm) and 'shall be effective for a period of not more than ten (10) days,' with subsequent orders of any duration issuable only by the board of county commissioners or the municipal governing body; a State Health Officer order of that kind is likewise limited to ten days and 'subsequent orders for the same or substantially same purpose shall only be issued by the governor... and shall be in effect for not more than sixty (60) days' (Ex. WY-055). The act applies only to orders issued on or after July 1, 2021. Nothing in Wyoming law barred a school district, the University of Wyoming's Board of Trustees or a county from imposing mask requirements in 2021, and each did.

Vaccination mandates

No State health-care-worker or State-employee vaccination mandate in the period; the University of Wyoming required COVID-19 testing of every student and employee on entry (August 18-22, 2021) and weekly random testing of 3 percent of the campus population (WY-060, WY-061); federal mandates (EO 14042, 14043; CMS and OSHA rules of November 2021) per FED files.

Standing duties

The statutes, codes and penalty provisions of Wyoming that stood before March 2020 and ran through every claimable quarter. They are the reason nothing an employer did under the orders was voluntary. Read the Wyoming duties →

Wyoming's compulsion ran on four standing tracks, none written for COVID-19 and none dependent on the life of a Statewide Public Health Order. First, the public health code of Title 35. Every statewide order and every county order of 2020 and 2021 was issued under W.S. 35-1-240 and 35-4-103 and recited W.S. 35-1-105 and 35-1-106 as its enforcement clause (Ex. WY-004 to WY-058; the recital is recorded in the State records for each order). Section 35-1-240(a) gives the Department of Health, through the State Health Officer, the power and duty to control communicable disease, to 'establish, maintain and enforce isolation and quarantine' with 'physical control over property and over the persons of the people within this state', 'To close theaters, schools and other public places, and to forbid gatherings of people', 'To abate nuisances' and to enforce sanitary standards for hotels, factories, workshops and 'places used for public gatherings' (35-1-240(a)(ii)-(v), (xv); DUT-WY-003). Section 35-1-105(a)(i) forbids every 'person, corporation or other organization' to 'Willfully violate, disobey or disregard the provisions of the public health laws of Wyoming or the terms of any lawful notice, order, rule or regulation issued pursuant thereto', and 35-1-105(a)(vii) binds the owner or occupant of premises to remove a 'nuisance, source of filth or cause of sickness' within forty-eight hours of a health authority's order, with civil damages preserved (35-1-105(b); DUT-WY-002). Section 35-1-106 makes any person 'who shall fail or refuse to obey any lawful order issued by any state, county or municipal health officer' guilty of a misdemeanor punishable by a fine of up to $1,000, imprisonment of up to one year, or both (DUT-WY-002). The contagious-disease article adds the Department's power to 'prescribe rules and regulations for the management and control of communicable diseases', with a misdemeanor for 'violating or refusing to obey such rules and regulations or resisting or interfering with any officer or agent' (35-4-101), the mandatory quarantine and travel-regulation machinery (35-4-103) and the crime of escape from quarantine (35-4-105) (DUT-WY-004), and the misdemeanor of doing 'any other act with intent to, or necessarily tending to the spread of such disease' with civil liability 'to any and all persons, who may, from that cause, become infected' (35-4-109, 35-4-110; DUT-WY-005). Second, the emergency layer. Executive Order 2020-2 (March 13, 2020) declared the public health emergency under W.S. 19-13-102, 19-13-104 and 35-4-115(a)(i) and directed the Director of the Department of Health to act under W.S. 35-1-240, 35-1-227 and 35-4-101 to 115 (Ex. WY-001, WY-002). The Wyoming Homeland Security Act lets the Governor 'Make, amend and rescind the necessary orders, rules and regulations to carry out this act' and assign mitigation activities to a State agency, which 'shall undertake and carry out the activity on behalf of the state' (19-13-104(c)(i)), and requires every homeland security program to 'execute and enforce orders, rules and regulations made by the governor' (19-13-116) (DUT-WY-012). Chapter 13 of Title 19 contains no offense provision; in Wyoming the offense for disobeying a pandemic order lies in Title 35, which is why every order recited 35-1-105 and 35-1-106. Third, the workplace duty. Wyoming operates an OSHA-approved State plan (WYOSHA, within the Department of Workforce Services) under the Wyoming Occupational Health and Safety Act, W.S. 27-11-101 to 27-11-114, whose declared policy is that 'the prevention of accidents and occupational diseases and abiding by rules and regulations are the responsibility of both the employer and the employee' (27-11-102(a)(i)) and whose employer duties are that 'Each employer shall furnish to his employees, a place of employment and employment which are free from recognized hazards that are causing or that are likely to cause death or serious physical harm' and 'shall comply with occupational safety and health standards, rules, regulations and orders issued pursuant to this act' (27-11-105(b)(vi)(A)-(B)), enforced by criminal penalties for willful violations causing death and by civil penalties for serious and other violations at federal levels (27-11-107) (DUT-WY-014). WYOSHA adopted no Wyoming COVID-19 standard during the six quarters; its 'COVID-19 Resources' compilations (May 2020 to 2021) are each 'intended as a resource' and list the federal OSHA enforcement memoranda then 'in effect' (DUT-WY-015, DUT-WY-016), and its letter of July 15, 2021 announced partial adoption of the Healthcare ETS by emergency rule, stated that the State plan 'must be "at least as effective" as the Federal program' and that the ETS 'is not enforceable in Wyoming' until the rule issued, and 'encourage[d]' hazard assessments, written COVID-19 plans, PPE, distancing or barriers and paid leave for vaccination (DUT-WY-017). Those instruments are recorded as recommendations; the duty they served is 27-11-105(b)(vi). Fourth, the liability shield and its condition. On April 6, 2021, SEA 57 (2021 Wyo. Sess. Laws ch. 118), effective immediately, created W.S. 1-1-141, under which in any 'COVID-19 liability claim' 'there shall be a rebuttable presumption that the claimant accepted and assumed the risk of catching COVID-19 if the claimant entered the premises of another person or entity', and added 35-4-114(d)-(e), under which 'Any health care provider, person or entity shall be immune from liability for damages in an action involving a COVID-19 liability claim unless the person seeking damages proves... gross negligence or willful or wanton misconduct', pleaded with particularity and proven by clear and convincing evidence (DUT-WY-008, DUT-WY-009). Wyoming's shield is therefore two-tiered: good-faith compliance with health-officer instructions is a complete immunity for every business entity (35-4-114(a)), and the 2021 act makes gross negligence the floor for every COVID-19 claim. The Legislature thereby declared compliance with the health officers' instructions the conduct the law protects. Fifth, the sanitary and food-establishment layer: 35-1-240(a)(v) and (xv), 35-1-105(a)(vii), and the Wyoming Food, Drug and Cosmetic Safety Act ('No food establishment shall serve, hold for sale or sell food to the public without a valid license', 35-7-124(a); violation of the act or its rules a misdemeanor, 35-7-111, -113) (DUT-WY-018). Sixth, the operating conditions in the orders themselves, cross-referenced from the State layer with their verbs ('must be screened'; 'must wear face coverings'; 'shall perform hand hygiene'; 'must post notices'; long-term care exempt only 'as long as the facility complies with guidance and directives from the CDC') (DUT-WY-021 to DUT-WY-031). Seventh, no Wyoming court decision or Attorney General opinion on the duty of businesses under the orders was located; the Department of Health's guidance documents are recorded as what they are, recommendations ('The Wyoming Department of Health recommends') (DUT-WY-019, DUT-WY-020, DUT-WY-032).
