In plain terms: if you ran a restaurant, a bar, a catering business or a food-service contract between March 2020 and September 2021, the government told you, under penalty, when your dining room could open, how many tables it could hold and how far apart, what hour the bar had to stop pouring, whether your staff and guests wore face coverings, and who could come through the door and on what proof. Every State and the District of Columbia closed on-premises food and beverage service between March 15 and April 6, 2020. Every State reopened it only in steps, at fixed percentages of the fire-code occupant load, on mandatory conditions. About twenty States closed indoor dining again in the winter of 2020-21. The last statewide caps outside Hawaii ended June 30, 2021; Hawaii's ran to December 1, 2021. In the third quarter of 2021, seven States, the District and more than thirty of the largest cities put face coverings back on every server and guest, and New York City, San Francisco, New Orleans and Honolulu required proof of vaccination at the door.

The orders reached all nine functions of the business, from the dining room and the bar to the kitchen, the workforce and the customers. This page sets those orders out by layer, quarter and function, with instrument numbers, dates and exhibit links, and answers from the public record the fourteen sentences the Internal Revenue Service (the "Service") uses in its letters. Four terms recur: the "Suspension Clause" (CARES Act § 2301(c)(2)(A)(ii)(I) and § 3134), the "Notice" (Notice 2021-20), the "United States" (the Government as a litigant) and the "Library" (this site's Orders Library; "Ex. TX-021" is an exhibit). The quarter the Service's letters most often dispute is the third quarter of 2021, and the record answers it.

Partial suspension, element by element

Every analysis on this site asks the same five questions in the same order. Here they are asked of Restaurants and Food Service, from the industry's own record.

  1. The order: issuer, instrument, date, exhibit.The Library holds 20 instruments from this industry's own regulators and sector authorities and 8 organizer notices. The earliest is Texas Alcoholic Beverage Commission, TABC Coronavirus Information page (as archived June 23, 2020): Governor's waivers (Mar. 18, 2020 alcohol to-go; Apr.-May 2020), to-go sales and delivery rules, permit-type guidance under the GA orders (Ex.   2. The function of the business it reached.The orders named the functions of the business in terms.   3. The change it compelled: the operative words.The operative words of TABC Coronavirus Information page (as archived June 23, 2020): Governor's waivers (Mar. 18, 2020 alcohol to-go; Apr.-May 2020), to-go sales and delivery rules, permit-type guidance under the GA orders (Ex. SEC-05-013): “TABC recognizes the major impact the coronavirus pandemic is having on the alcoholic beverage [industry]... To-Go Sales: Who's Allowed to Sell Alcohol for Consumer Pickup... Who's Allowed to Sell and Deliver Alcohol to Consumers... Restaurants, alcoholic beverage manufacturers, distributors and…” Each record page quotes the operative words in full, with the enforcement provision beside them.
  4. The quarter: in force on which days.Every instrument carries the quarters it was in force.   5. The statute's answer.A partial suspension is a temporary delay, interruption or termination of a portion of the business's operations; the order need only be the but-for cause of it; and nothing in the Suspension Clause asks whether the business was essential, stayed open, could telework or served customers who were themselves under orders (Tri-State Memorial Hospital v. Function codes

The analysis describes the business as nine functions, each with a two-letter code that every page of this set uses without variation. An order “reached” a function when its operative words told the business what that part of it could do, when, where, for how many and on what conditions.
