The record in brief

Georgia's regime ran on one continuous emergency predicate and two overlapping instrument chains, and the record is the Governor's own scanned orders read by OCR from gov.georgia.gov. Governor Brian P. Kemp declared a Public Health State of Emergency by Executive Order 03.14.20.01 on March 14, 2020 (Ex. GA-001); the General Assembly, convened in special session, concurred by joint resolution on March 16, 2020 (recited in every renewal); and the Governor renewed the emergency sixteen times (04.08.20.02, 04.30.20.01, 05.28.20.01, 06.29.20.01, 07.31.20.01, 08.31.20.01, 09.30.20.01, 10.30.20.01, 11.30.20.01, 12.30.20.01, 01.29.21.01, 02.26.21.01, 03.31.21.01, 04.23.21.01, 05.28.21.01 and 06.22.21.01) until it terminated at 12:00 A.M. on July 1, 2021 (Ex. GA-039). The same day it ended, Executive Order 06.30.21.01 declared a new State of Emergency for Continued COVID-19 Economic Recovery, reciting 'an ongoing emergency due to the impacts of COVID-19 on the economy, supply chain, and healthcare infrastructure' (Ex. GA-041), renewed by 07.22.21.01 (to Aug. 29), 08.19.21.01 (to Sept. 28) and 09.20.21.01 (to Oct. 28, 2021) (Exs. GA-059, GA-060, GA-046), so Georgia was under a declared COVID-19 state of emergency on every day of every claimable quarter through September 30, 2021. 2020 Q2 (with the March 13-31 run-up): EO 03.16.20.01 closed every public elementary, secondary and post-secondary school from March 18 (Ex. GA-003), extended through April 24 (Ex. GA-008) and then through the end of the 2019-2020 school year (Ex. GA-009); EO 03.23.20.01 (effective noon March 24) closed every 'Bar', forbade any business or organization to allow more than ten persons gathered within six feet, ordered the Department of Public Health to order the medically fragile to shelter in place, and authorized DPH to mandate closure of noncompliant businesses (Ex. GA-005); EO 04.02.20.01 (effective 6:00 P.M. April 3) ordered all residents and visitors to shelter in place, confined every business that was not 'Critical Infrastructure' to 'Minimum Basic Operations', required those businesses to implement 'teleworking for all possible workers' and to hold 'all meetings and conferences virtually, wherever possible', ended dine-in service, closed gyms, fitness centers, bowling alleys, theaters, live performance venues, amusement rides, body art studios, barbers, cosmetologists, estheticians, hair designers, massage therapists and bars, suspended every conflicting local order and made violation a misdemeanor under O.C.G.A. 38-3-7 (Ex. GA-010); EO 04.03.20.01 deputized every sheriff to close noncompliant businesses (Ex. GA-011); EO 04.08.20.02 extended the shelter-in-place regime to April 30 (Ex. GA-012); EO 04.08.20.03 imposed mandatory protocols on nursing homes and every other long-term care facility, including a prohibition on all visitors (Ex. GA-013); EO 04.08.20.04 banned every short-term vacation rental in the State from April 9 through April 30 (Ex. GA-014). Reopening was staged by order: EO 04.20.20.01 let gyms, salons, barbers, body art, bowling and massage resume 'Minimum Basic Operations' on April 24 under twenty enumerated mandatory measures, told health care practices that had ceased operations to begin treating patients again, and adopted CISA version 3.0 as the Critical Infrastructure list (Ex. GA-017); EO 04.23.20.02 ('Reviving a Healthy Georgia') let restaurants resume dine-in on April 27 at no more than ten patrons per 500 square feet and six per table, kept bars, live performance venues, amusement rides and public pools closed, capped retail at 50 percent of fire capacity or eight patrons per 1,000 square feet, kept the ten-person gathering ban, and required every person 65 or older, every long-term-care resident and everyone with an enumerated condition to shelter in place (Ex. GA-018); EO 04.30.20.01 extended the medically-fragile shelter order to June 12 (Ex. GA-020); EO 05.12.20.02 (May 14-31) eased restaurants to ten patrons per 300 square feet and kept bars and venues closed (Ex. GA-022); EO 05.28.20.02 (June 1-15) raised the gathering cap to 25, reopened bars at 25 persons or 35 percent of fire capacity, kept live performance venues closed and bound dental practices to the American Dental Association's interim guidance (Ex. GA-023); EO 06.11.20.01 (June 16-30) set the gathering cap at 50, bars at 50 persons or 35 percent, and forbade live performance venues and conventions to operate before July 1, 2020 (Ex. GA-024). 2020 Q3: the biweekly 'Empowering a Healthy Georgia' orders (06.29.20.02, 07.15.20.01, 07.31.20.02, 08.15.20.01, 08.31.20.02, 09.15.20.01, 09.30.20.02) kept the 50-person gathering ban, the medically-fragile shelter-in-place order, mandatory sector protocols for restaurants, bars, gyms, theaters, salons, retail, schools, camps, venues, conventions and long-term care, and the closure-after-two-citations enforcement rule; EO 07.15.20.01 suspended every local mask mandate 'to the extent that they are more restrictive than this Executive Order' (Ex. GA-026), and EO 08.15.20.01 replaced that suspension with the 'Local Option Face Covering Requirement' available only to counties at or above 100 cases per 100,000 over fourteen days and never enforceable against private businesses (Ex. GA-027). 2020 Q4 and 2021 Q1 (the winter): the same chain (09.30.20.02, 10.15.20.01, 10.30.20.02, 11.13.20.01, 11.30.20.02, 12.08.20.01, 12.30.20.02, 01.15.21.01, 01.29.21.02, 02.15.21.01, 02.26.21.02, 03.12.21.01) held every mandatory measure through March 31, 2021, added mandatory ventilation requirements on February 16, 2021 (Ex. GA-058), and the Insurance Commissioner ordered suspension of preauthorization and utilization review to free hospital beds (Exs. GA-048, GA-049); the Chief Justice suspended jury trials again from December 22, 2020. 2021 Q2: EO 03.31.21.03 (effective April 8, 2021) ended the gathering ban and the shelter-in-place order, kept mandatory distancing and sector measures, and provided that 'no Organization shall be mandated to close for failure to comply' (Ex. GA-034); EO 04.30.21.01 (May 1-30) made distancing 'strongly encouraged' while still requiring restaurants, bars and every Organization to 'implement measures which mitigate the exposure and spread of COVID-19' and holding long-term care facilities to mandatory DPH directives (Ex. GA-035); EO 05.28.21.02 (May 31-June 15, extended to July 1) kept the long-term care mandates and the local-option mask framework (Exs. GA-038, GA-040). 2021 Q3: the Public Health State of Emergency and the last Empowering order expired at 12:00 A.M. July 1, 2021; in force from that moment were the Economic Recovery State of Emergency and its regulatory-suspension orders (Exs. GA-041, GA-042, GA-059, GA-060, GA-046, GA-061), EO 08.19.21.03 of August 19, 2021, which suspended every local COVID-19 ordinance 'more or less restrictive' than the Governor's order and forbade any law enforcement agency to compel a business to adhere to a local ordinance (Ex. GA-043), the Guard deployments to hospitals and the hours-of-service suspension for freight of August 25 and 30 (Exs. GA-044, GA-045), the Insurance Commissioner's Delta-surge directives of August 16, August 17 and September 15 (Exs. GA-050, GA-055, GA-056), and the local judicial emergency and speedy-trial-relief orders that the circuits entered when the statewide judicial emergency expired June 30, 2021 (Exs. GA-051 to GA-054).

What remained in force

From April 8, 2021: mandatory Social Distancing for all residents ('shall practice'), mandatory sector measures ('shall implement') for restaurants, bars, gyms, theaters, salons, schools, camps, venues and conventions, mandatory DPH long-term-care directives, the Local Option Face Covering Requirement framework and the suspension of local orders 'more or less restrictive' than the Governor's (Ex. GA-034). From May 1, 2021: mandatory mitigation measures for restaurants, bars, banquet and event facilities and every Organization ('shall implement measures which mitigate the exposure and spread of COVID-19'), mandatory long-term-care directives, the local-option framework (Ex. GA-035); from May 31: the same plus the bar on school districts relying on the emergency for masks (Ex. GA-038). From July 1, 2021 through September 30, 2021: the State of Emergency for Continued COVID-19 Economic Recovery (Exs. GA-041, GA-059, GA-060, GA-046) with its regulatory suspensions (temporary and lapsed-license practice, remote notarization, DDS examiner rules, unemployment rules) (Exs. GA-042, GA-061); the August 19, 2021 order suspending inconsistent local COVID-19 ordinances and barring compelled business enforcement (Ex. Preemption of local orders

Georgia preempted local orders from the first statewide instrument and never stopped. EO 04.02.20.01 (Apr. 2, 2020) suspended 'the powers of counties and cities conveyed in Titles 36 and 38... to the extent of suspending enforcement of any local ordinance or order adopted or issued since March 1, 2020, with the stated purpose or effect of responding to a public health state of emergency, ordering residents to shelter-in-place, ordering a quarantine, or combatting the spread of coronavirus or COVID-19 that in any way conflicts, varies, or differs from the terms of this Order,' and provided that 'no county or municipality shall adopt any similar ordinance or order while this Order is in effect' (Ex. GA-010 at 8). That suspension displaced the City of Atlanta's Executive Order 2020-21, the Fulton County Board of Health order and every other local shelter order of March 2020. EO 04.20.20.01 suspended 'enforcement of any county or municipal ordinance or order that is more or less restrictive than this Order' (Ex. GA-017 at 6), and every Empowering a Healthy Georgia order repeated that suspension and provided that local rules 'more or less restrictive than the terms of this Order shall be considered inconsistent with this Order.' EO 07.15.20.01 (effective July 16, 2020) added that 'any state, county, or municipal law, order, ordinance, rule, or regulation that requires persons to wear face coverings, masks, face shields, or any other Personal Protective Equipment while in places of public accommodation or on public property are suspended to the extent that they are more restrictive than this Executive Order' (Ex. GA-026 at 38), voiding the fifteen local mask orders then in force (Ballotpedia; Husch Blackwell); the Governor sued the City of Atlanta over its mask order and gathering limits on July 16, 2020 (Kemp v. Bottoms, Fulton Super. Ct.) and withdrew the suit on August 13, 2020. EO 08.15.20.01 (effective Aug. 16, 2020) authorized a 'Local Option Face Covering Requirement' only in counties meeting the 'Threshold Requirement' (100 or more confirmed cases per 100,000 over the previous fourteen days), forbade any fine, fee or penalty against a private business for a customer's noncompliance, limited enforcement to individuals, and let every government control terms of entry to its own property regardless of the threshold (Ex. GA-027 at 9-10, 38-39); that framework continued in every order through July 1, 2021 (Exs. GA-028, GA-029, GA-031, GA-032, GA-034, GA-035, GA-038). The Governor's orders also provided throughout that 'the operation of Critical Infrastructure shall not be impeded by county, municipal, or local ordinance.' After the Public Health State of Emergency ended, EO 06.30.21.01 recited O.C.G.A. 38-3-28(a)'s bar on local emergency rules 'inconsistent with' the Governor's and defined 'more or less permissive' local rules as inconsistent (Ex. GA-041 at 3), and EO 08.19.21.03 (Aug. 19, 2021) ordered that 'No Organization... shall be compelled to enforce any provision of any county or municipal ordinance, order, rule, or regulation enacted pursuant to emergency authority or a declaration of emergency related to COVID-19,' that 'No law enforcement agency shall compel any Organization... to adhere to' such a local provision, and that 'enforcement of any county or municipal ordinance, order, rule or regulation that is more or less restrictive than this Order and is not otherwise expressly permitted by the terms herein is hereby suspended' (Ex. GA-043 at 4-6). Local mask and vaccination ordinances of the Delta wave (Atlanta, Savannah, Athens-Clarke and school districts) therefore operated in Q3 2021 only as the Governor's order permitted: binding on individuals and on government property, never enforceable through the private business.

Offices and telework

Non-Critical Infrastructure businesses limited to Minimum Basic Operations Apr. 3-30, 2020 and required to implement 'teleworking for all possible workers', 'staggered shifts for all possible workers', 'all meetings and conferences virtually, wherever possible' and 'intangible services remotely wherever possible' (Ex. GA-010 at 4); the same items were mandatory measures for reopened sectors (Ex. GA-017) and listed measures for Critical Infrastructure and Organizations in every order through June 30, 2021.

Manufacturing

Manufacturing within CISA versions 2.0 and 3.0 was Critical Infrastructure (Exs. GA-010, GA-017) with mitigation measures; non-CISA manufacturers were confined to Minimum Basic Operations Apr. 3-30, 2020; the Georgia Department of Economic Development issued binding Critical Infrastructure status guidance treated as final agency action (Ex. GA-010 at 6).

Construction

Construction was Critical Infrastructure under the CISA guidance adopted by EO 04.02.20.01 and was never closed; outdoor work 'without regular contact with other persons, such as delivery services, contractors, landscape businesses' was Minimum Basic Operations for everyone else (Ex. GA-010 at 4); Critical Infrastructure was subject to the listed mitigation measures and the ten-, 25- and 50-person gathering rules did not apply to it.

Real estate

Remote notarization of real estate documents by real-time audio-visual technology authorized Mar. 31, 2020 (Ex. GA-057) and remote notarization and attestation generally Apr. 9, 2020 (Ex. GA-015), continued after July 1, 2021 by the Economic Recovery suspensions (Exs. GA-042, GA-061); showings and open houses were Minimum Basic Operations Apr. 3-30, 2020; short-term rental ban Apr. 9-30, 2020 (Ex. GA-014).

Hospitals and long-term care

EO 03.23.20.01 sheltered nursing-home residents (Ex. GA-005); EO 04.02.20.01 barred visitors to sheltered persons and made the visitor rules 'strictly enforced against nursing homes or other long-term care facilities' (Ex. GA-010 at 7); EO 04.08.20.03 imposed mandatory protocols including prohibition of all visitors and non-essential personnel, in force to Sept. 15, 2020 (Exs. GA-013, GA-028); the Empowering orders then made DPH and Guard long-term-care directives 'mandatory' through June 30, 2021 (Exs. GA-028 to GA-038); Insurance Directives 20-EX-7, 20-EX-9, 20-EX-11, 21-EX-1, 21-EX-2 and Bulletin 21-EX-3 suspended preauthorization and review to free beds (Exs. GA-047 to GA-050, GA-055, GA-056); Guard deployed to hospitals Aug. 25-30, 2021 (Exs. GA-044, GA-045).

Dental and elective health care

EO 04.20.20.01 addressed medical, dental, orthodontic, optometry, physical therapy, ambulatory surgical centers and elective surgeons that 'have elected to cease operations' and directed that they 'should begin treating patients as soon as practicable' under CDC and CMS guidelines (Ex. GA-017); EO 05.12.20.02 permitted ambulatory surgical centers their full scope (Ex. GA-022); EO 05.28.20.02 bound dental practices to the ADA Interim Guidance for Minimizing Risk of COVID-19 Transmission and Interim Mask and Face Shield Guidelines (Ex. GA-023); Insurance Directive 20-EX-7 (Mar. 26, 2020) directed suspension of preauthorization, concurrent and retrospective review because hospitals were 'delaying or suspending many scheduled procedures' (Ex. GA-047).

Schools

All public elementary, secondary and post-secondary schools closed for in-person instruction Mar. 18-31, 2020 (Ex. GA-003), through Apr. 24 (Ex. GA-008), then through the end of the 2019-2020 school year (Ex. GA-009); summer school subject to mandatory measures (Ex. GA-023); 2020-21 and 2021-22 reopening left to districts under mandatory screening and ventilation measures in the Empowering orders (Exs. GA-028, GA-032, GA-034); EO 05.28.21.02 barred districts from relying on the PHE to require masks (Ex. GA-038); no statewide 2021-22 mask or quarantine order (DPH quarantine orders on exposed persons and local district mandates governed).

Child care

Child Care Learning Centers and Family Child Learning Homes stayed open as Critical Infrastructure under suspended access and field-trip rules (Ex. GA-006); DECAL ratios and 20-person classroom gathering rules in the Empowering orders (Ex. GA-022); overnight summer camps permitted from May 31, 2020 under mandatory protocols (Ex. GA-023); mandatory measures through June 30, 2021.

Worship and gatherings

No business, establishment, corporation, non-profit corporation or organization could allow more than ten persons gathered within six feet from noon Mar. 24, 2020 (Exs. GA-005, GA-010); cap 25 from June 1 (Ex. GA-023) and 50 from June 16, 2020 through Apr. 7, 2021 (Exs. GA-024 to GA-032); no gathering ban from Apr. 8, 2021 (Ex. GA-034). Conventions forbidden before July 1, 2020, then capacity-tiered protocols (Exs. GA-024, GA-025).

Courts and public offices

Statewide Judicial Emergency declared Mar. 14, 2020 and extended fifteen times to 11:59 P.M. June 30, 2021, suspending jury trials, grand juries and deadlines (deadlines reimposed July 14, 2020; jury trials suspended again Dec. 22, 2020 into March 2021) (Ex. GA-051 recital; Husch Blackwell; Judicial Council); local judicial emergency and speedy-trial-relief orders from July 1, 2021 (Exs. GA-051 to GA-054); DDS license expirations extended 120 days and new-resident licensing suspended (Ex. GA-007); DDS road-test rules suspended through Sept. 2021 (Exs. GA-042, GA-061); grand jury rules relaxed (EO 09.10.20.02, index).

Travel and quarantine

No statewide traveler quarantine; 'Necessary Travel' limited to Essential Services, Minimum Basic Operations and Critical Infrastructure Apr. 3-30, 2020 (Ex. GA-010); vacation rental ban to keep Georgia from 'becoming a vacation destination for out-of-state individuals' Apr. 9-30, 2020 (Ex. GA-014); DPH quarantine and isolation orders on specific persons controlled over every Governor's order (Exs. GA-010, GA-041, GA-043); freight hours-of-service and weight limits suspended Mar. 14, 2020 (Ex. GA-001) and Aug. 30, 2021 (Ex. GA-045).

Face coverings

No statewide mandate; anti-mask statute suspended Apr. 13, 2020 (Ex. GA-016); masks 'strongly encouraged' and mandatory for restaurant and salon workers in the Empowering orders; local mandates suspended July 16-Aug. 15, 2020 (Ex. GA-026); Local Option Face Covering Requirement for threshold counties from Aug. 16, 2020 to June 30, 2021, unenforceable against private businesses (Exs. GA-027, GA-038); from Aug. 19, 2021 no business could be compelled to enforce a local mask ordinance (Ex. GA-043).

Vaccination mandates

None issued by the State; EO 05.25.21.01 prohibited State agencies, providers and properties from requiring proof of vaccination and barred any requirement to show proof to enter Georgia (Ex. GA-036).

Standing duties

The statutes, codes and penalty provisions of Georgia that stood before March 2020 and ran through every claimable quarter. They are the reason nothing an employer did under the orders was voluntary. Read the Georgia duties →

Georgia law placed every person, every employer and every owner or occupier of premises under standing duties that made the pandemic measures compulsory from the first day of the Public Health State of Emergency (March 14, 2020) through the third quarter of 2021 and beyond. Title 31 empowers the Department of Public Health and every county board of health to require isolation, segregation, quarantine and surveillance (O.C.G.A. section 31-12-4) and 'such other measures to prevent the conveyance of infectious matter from infected persons to other persons as may be necessary and appropriate' (section 31-12-3(a)); charges the Department to 'safeguard and promote the health of the people of this state' and to 'forestall and correct... biological conditions that, if left to run their course, could be injurious to health' (section 31-2A-4); and makes any violation of Title 31 a misdemeanor (section 31-5-8), enforceable also by injunction and public-nuisance abatement (section 31-5-9). The Department's Isolation and Quarantine rules (Ga. Comp. R. & Regs. r. 511-9-1) implement those sections and authorize the Department to isolate, quarantine, restrict travel, limit or cancel public gatherings and close any facility that may pose a danger to public health, by administrative order effective on issuance. The Emergency Management Act makes the violation of 'any rule, order, or regulation' made under it a misdemeanor (section 38-3-7), commands State and local law enforcement to enforce those orders (section 38-3-4), and gives the Governor the powers under which every order in the library was issued (section 38-3-51). The 2021 replacement volume of the Code itself records, in the Editor's notes to section 38-3-7, that the section was applied 'in 2020 and 2021' through Executive Orders 04.20.20.01, 09.15.20.01 and 05.28.21.02. Every Georgia employer was bound by the federal general duty clause (29 U.S.C. section 654(a)(1)), Georgia having no State plan, and by the State's own 1937 statute requiring every employer to furnish employment 'reasonably safe' and to 'do every other thing reasonably necessary to protect the life, health, safety, and welfare of such employees' (section 34-2-10, misdemeanor under section 34-2-13), by the employer's duty to warn of 'dangers incident to an employment' (section 34-7-20), and by the owner's or occupier's duty of 'ordinary care in keeping the premises and approaches safe' for invitees (section 51-3-1). The Georgia COVID-19 Pandemic Business Safety Act (SB 359, approved August 5, 2020; extended by HB 112 to causes of action accruing through July 14, 2022) conditioned the immunity it gave on conduct short of gross negligence and gave a presumption of assumption of risk only to a business that printed or posted the statutory warning; it left Title 31 and Chapter 3 of Title 38 untouched (section 51-16-5). The standing immunity in section 38-3-35(b) protects only those 'complying with or reasonably attempting to comply with' the Act and orders under it. The food-service statutes made it unlawful to operate without a permit under Department sanitation standards (sections 26-2-371, -373, -375). The Department's Long-Term Care Facilities Reopening administrative order of September 15, 2020, issued under sections 31-2A-4 and 31-12-4, imposed 'must' and 'shall' conditions on every long-term care facility through the end of the emergency. The Court of Appeals in Arbor Management Services, LLC v. Hendrix (June 22, 2022) read the Governor's March 14, 2020 order as requiring facilities to comply with emergency orders and applied the Act's gross-negligence condition to a facility's March 2020 infection-control conduct.
