Religious Organizations and Nonprofits

Houses of worship were the one class of employer that Congress named in the Suspension Clause (orders limiting group meetings 'for commercial, social, religious, or other purposes'), and the orders reached them earlier, more completely and for longer than the…

In plain terms: if you run a congregation, a school, a pantry, a shelter or a nonprofit, the orders of 2020 and 2021 reached what your organization exists to do: bring people together in a room. Between March 12 and April 7, 2020, every State and the District of Columbia banned or capped gatherings, and at least thirty-nine named religious or worship gatherings. Stay-at-home orders in forty-two jurisdictions kept your members, volunteers and staff at home, and school orders closed every classroom you ran. Reopening came on the orders' conditions: caps of ten to fifty people or 25 to 50 percent of capacity, distancing, no singing in some States, a written protocol in most. Twenty-two jurisdictions cut the caps again in the winter of 2020-21. The last statewide worship caps ended June 30, 2021; within weeks, indoor face-covering orders in seven States, the District of Columbia and more than a dozen metros reached every sanctuary, hall, classroom and pantry, and thirteen States placed every "public, private, and parochial" school under face-covering, quarantine or staff-vaccination orders.

The statute's operative text, the "Suspension Clause", asks whether an operation was fully or partially suspended during a quarter due to orders limiting commerce, travel or group meetings, and it names "religious" meetings; Notice 2021-20 (the "Notice") is the Service's guidance; the "United States" is the Government in court. The quarter the Service's letters most often dispute is the third quarter of 2021, and the record answers it: the orders in force from July 1 to September 30, 2021 are listed below.

Partial suspension, element by element

SEC-16-095): “SOCIAL VISITS: Social visits will be suspended for 30 days, at which time the suspension will be reevaluated.... LEGAL VISITS:... while in general, legal visits will be suspended for 30 days, case-by-case accommodation will be [made]....   5. The statute's answer.A partial suspension is a temporary delay, interruption or termination of a portion of the business's operations; the order need only be the but-for cause of it; and nothing in the Suspension Clause asks whether the business was essential, stayed open, could telework or served customers who were themselves under orders (Tri-State Memorial Hospital v.
