In plain terms: if you ran a hotel, an inn, a short-term rental business, a casino hotel, a convention center, a tour company or an event venue between March 2020 and September 2021, government orders reached almost every part of what you sold. Orders closed lodging to leisure guests in eleven States and in the resort counties of California, Colorado, Utah and Florida. They quarantined the arriving traveler in at least twenty-four States and the District of Columbia. They shut every commercial casino floor, closed every convention center in the Library, halted every cruise, and turned away the foreign guest and the Canadian and Mexican day visitor at the border. They closed or capped your restaurant, your bar, your ballroom, your pool, your gym and your spa. The reopening orders then fixed the schedule on which you could rebuild, percentage by percentage, into the summer of 2021, and in the largest markets a new order arrived before the fall calendar could refill.

This page sets out those orders layer by layer (federal, State, metro, regulator, counterparty and standing duty), quarter by quarter, and function by function: rooms, food and beverage, meetings, amenities, travel demand, group sales, housekeeping, supply, hiring, office work, the workforce and the guest. It then answers the fourteen sentences the IRS letters use, with the instrument behind each answer, and states what the public record establishes for each of the six quarters. The quarter the Service's letters most often dispute is the third quarter of 2021, July 1 through September 30, and the record for that quarter, set out below instrument by instrument, answers it.

Partial suspension, element by element

Every analysis on this site asks the same five questions in the same order. Here they are asked of Hotels, Travel and Tourism, from the industry's own record.

  1. The order: issuer, instrument, date, exhibit.The Library holds 36 instruments from this industry's own regulators and sector authorities and 58 organizer notices. The earliest is Centers for Disease Control and Prevention, Department of Health and Human Services, No Sail Order and Suspension of Further Embarkation (Mar. 14, 2020), published 85 Fed. Reg. 16628 (Mar. 24, 2020) (Ex. SEC-06-001). The fifty-State regime table below names the State orders that reached its premises, State by State, each with its exhibit; the federal layer and the standing duties sit behind them on every day of the six quarters.
  2. The function of the business it reached.The orders named the functions of the business in terms.   3. The change it compelled: the operative words.The operative words of No Sail Order and Suspension of Further Embarkation (Mar. 14, 2020), published 85 Fed. Reg. 16628 (Mar. 24, 2020) (Ex. SEC-06-001): “announces the issuance of a No Sail Order and Suspension of Further Embarkation on March 14, 2020 for all cruise ships that are not voluntarily suspending operation.” Each record page quotes the operative words in full, with the enforcement provision beside them.
  4. The quarter: in force on which days.Every instrument carries the quarters it was in force. The six quarters sets out what was in force in each, and the third quarter of 2021 is listed instrument by instrument below.
  5. The statute's answer.A partial suspension is a temporary delay, interruption or termination of a portion of the business's operations; the order need only be the but-for cause of it; and nothing in the Suspension Clause asks whether the business was essential, stayed open, could telework or served customers who were themselves under orders (Tri-State Memorial Hospital v. Function codes

The analysis describes the business as twelve functions, each with a two-letter code that every page of this set uses without variation. An order “reached” a function when its operative words told the business what that part of it could do, when, where, for how many and on what conditions.
