The record in brief

Alabama's COVID-19 regime ran on two instruments that were issued together and extended together for fourteen months: the Governor's state public health emergency under the Alabama Emergency Management Act of 1955 (Ala. Code § 31-9-8), proclaimed March 13, 2020 and extended in sixty-day steps until it was terminated at 11:59 p.m. on July 6, 2021, and the State Health Officer's Order Suspending Certain Public Gatherings under Ala. Code § 22-2-2(4), first issued for five Birmingham-area counties on March 17, 2020, made statewide on March 19, 2020, and amended twenty-two times through May 3, 2021. From July 15, 2020 every amended order was also promulgated by gubernatorial proclamation as an order under Ala. Code §§ 31-9-6(1) and 31-9-13, enforced by the law-enforcing authorities of the State under § 31-9-14, with a fine of not more than $500 or imprisonment in the county jail under § 31-9-22.

2020 Q2 (with the March 13-31 run-up). The March 19 order prohibited gatherings of 25 or more, closed all schools, colleges and child-care centers at the close of business that day, barred visitors from hospitals and nursing homes, delayed all elective dental and medical procedures and ended on-premises consumption at every restaurant, bar and brewery statewide. It told employers in terms that they were 'authorized to advise employees to work from home or maintain flexible work schedules.' The March 27 amendment (effective March 28 at 5:00 p.m.) cut the gathering cap to 10, closed entertainment venues, athletic facilities, close-contact service providers and six categories of retail store, and postponed all dental, medical and surgical procedures other than emergencies. The Stay at Home Order of April 3 (effective April 4 at 5:00 p.m.) ordered 'every person' to 'stay at his or her place of residence' except for enumerated essential activities, limited work outside the home to 'essential businesses and operations' and to 'work-related activities that do not require any regular interaction within six feet of another person,' capped essential retailers at 50 percent of fire-marshal occupancy, quarantined every person who tested positive for 14 days, closed beaches, and preempted every less stringent local curfew or quarantine measure. The Governor's supplemental proclamations of March 18, 26 and April 2-3 closed public K-12 schools for the rest of the 2019-20 year, moved public bodies and shareholder meetings to remote procedures, authorized remote notarization and directed law enforcement to cease enforcing evictions and foreclosures (to June 1, 2020). The Supreme Court of Alabama suspended all in-person court proceedings from March 16 to May 15, 2020 and jury trials until September 14, 2020. Birmingham (Ordinances 20-48, 20-50 and the April 30 'Safer in Birmingham Curfew'), Mobile, Tuscaloosa and Montgomery imposed 24-hour or overnight curfews; Birmingham's Ordinance 20-69 required masks in public from May 1, 2020. The Safer at Home Order of April 28 (effective April 30 at 5:00 p.m.) replaced the stay-home command with a mandatory employer code ('all employers shall take reasonable steps... facilitating remote working arrangements; and minimizing employee travel'), kept retail at 50 percent, kept entertainment venues, gyms and close-contact providers closed, and kept every restaurant closed to on-premises consumption until May 11. The May 8 and May 21 amendments reopened restaurants (party size 8, six feet between tables, employee masks), salons and gyms (50 percent) on May 11, and entertainment venues (50 percent) on May 22; schools and child care remained closed to in-person operation until June 1 and May 23, 2020.

2020 Q3. The Safer at Home Order remained in force throughout, extended June 30, July 15, July 29, August 27 and September 30. The July 15 amendment (effective July 16 at 5:00 p.m.) imposed the statewide mask requirement in every indoor space open to the public, every transportation-service vehicle and every outdoor gathering of ten or more, and preempted the Jefferson County Health Officer's June 26 face-covering order and Birmingham's ordinances. The ABC Board's emergency rule of July 27 (effective August 1) ordered every on-premises licensee to stop alcohol service at 11:00 p.m., and its September 29 rule bound every licensed bar and restaurant to 50 percent occupancy on pain of immediate license suspension. Retail, gyms and entertainment venues stayed at 50 percent of occupancy through November 7, 2020; hospitals and nursing homes were limited to one caregiver or visitor at a time from October 2.

2020 Q4 and 2021 Q1 (the winter). Alabama did not add closures in the winter wave; it held the mask mandate, the employer code, the restaurant party-size and spacing rules, the close-contact-provider and athletic-facility rules and the hospital visitation limits in force by amendments of November 5, December 9, 2020, January 21 and March 4, 2021, and it extended the emergency on November 5 (to January 7), December 9 (to March 8) and March 4 (to May 7, 2021). The November 5 amendment ended the numerical occupancy caps effective November 8, 2020 in favor of six-foot spacing or impermeable partitions. The ABC Board readopted its curbside-sales rule on December 14, 2020.

2021 Q2. The March 4 amendment (effective March 6) removed the restaurant party-size limit and allowed two hospital visitors; the March 22 technical revision cut school spacing to three feet. The Safer Apart Order of April 7 (effective April 9 at 5:00 p.m.) rescinded the mask mandate and converted every employer and business requirement into an 'encouraged' measure, while keeping three commands: the quarantine of every person who tests positive, senior-center compliance with Department of Senior Services guidelines, and hospital and long-term-care visitation rules. Birmingham re-enacted its own mask ordinance (No. 21-31) on April 6, 2021, effective through May 24, 2021, and the Safer Apart Order's preemption clause reached only municipal ordinances adopted before March 4, 2021. The May 3 amendment carried the Safer Apart Order to 11:59 p.m. on May 31, 2021 and the Governor extended the emergency to July 6, 2021. SB 267 (vaccine passports) passed May 17, 2021.

2021 Q3. The state of emergency ran through 11:59 p.m. July 6, 2021 and the Supreme Court's judicial emergency to 5:00 p.m. July 7, 2021. On August 13, 2021 the Governor proclaimed a new state public health emergency for COVID-19 (hospitalizations 235 on July 6 to 2,441 on August 12; 95 percent of ICU beds occupied), suspending licensure, supervision and facility rules for hospitals and waiving federal hours-of-service rules for emergency freight; it was extended on October 8 through October 31, 2021. The Supreme Court declared a second judicial state of emergency on August 20, 2021 (effective August 23, to November 29, 2021), superseding rules that impeded audio-video proceedings, and kept its workers'-compensation order in force to October 29, 2021. Birmingham required masks of every visitor to City indoor facilities from July 30, 2021 (EO 88-21) and of its workforce (EO 87-20, revised July 1, July 29 and September 27, 2021); Birmingham City Schools required masks of all students, employees and visitors from the August 2, 2021 opening. SB 267 barred every Alabama business from refusing service on the basis of immunization status. Alabama issued no statewide health-care-worker or State-employee vaccination mandate; Executive Order 724 of October 25, 2021 (post-period) directed the executive branch not to enforce federal mandates.

Instrument State Health Officer, Safer Apart Order (amended April 7, 2021) (Ex. AL-049), promulgated by the Governor's supplemental proclamation of April 7, 2021 (Ex. AL-048); the last statewide health order, the Safer Apart Order as amended May 3, 2021 (Ex. What remained in force

April 9 to May 31, 2021: the quarantine of every person who tested positive (Safer Apart ¶ 2), senior-center compliance with Department of Senior Services guidelines (¶ 5), hospital, nursing-home and assisted-living visitation rules (¶ 7), the preemption clause (¶ 9), and the state of emergency with its licensure, notarization, remote-meeting and procurement suspensions; Birmingham Ordinance 21-31 (masks in public) to May 24, 2021; Supreme Court Administrative Orders to July 7, 2021; SB 267 from its passage. After July 6, 2021: SB 267; Supreme Court Administrative Orders No. 12 (to October 29, 2021) and No. 13 (August 23 to November 29, 2021); the August 13, 2021 state public health emergency (extended to October 31, 2021); Birmingham EO 88-21 and EO 87-20 (to December 31, 2021); Birmingham City Schools' mask requirement from August 2, 2021; the ADPH notifiable-disease reporting rule for COVID-19.

Preemption of local orders

Alabama never enacted a statute barring local COVID-19 orders during the period, and its State Health Officer orders expressly preserved local power to be more stringent: from March 19, 2020 'the Jefferson and Mobile County Health Officers are authorized, after approval by the State Health Officer, to implement more stringent measures as local circumstances require' (Ex. AL-005 ¶ 9; AL-011 ¶ 11; AL-013 ¶ 17), and from July 15, 2020 'county health officers are authorized, after approval by the State Health Officer, to implement more stringent measures' (Ex. AL-027 ¶ 21). The orders preempted in the other direction: the April 3, 2020 order 'supersedes and preempts any county and municipal orders or ordinances, whenever adopted, that purport to impose less stringent COVID-19-related curfew or quarantine measures' (AL-013 ¶ 17), a clause repeated through March 2021. The July 15, 2020 mask amendment superseded 'all orders previously issued by county health officers concerning COVID-19 mitigation measures, as well as any municipal ordinances concerning the use of facial coverings,' with the proviso that '[i]f this Order's facial-covering requirement is rescinded, however, orders of county health officers and municipal ordinances pertaining to COVID-19 facial coverings may take effect according to their terms' (AL-027 ¶ 21); this displaced the Jefferson County Health Officer's June 26, 2020 order (AL-074) and Birmingham's Ordinance 20-69 series (AL-072, AL-073). The Safer Apart Order of April 7, 2021 superseded 'any municipal ordinance adopted before March 4, 2021, concerning the use of facial coverings' (AL-049 ¶ 9), which left Birmingham's Ordinance 21-31 of April 6, 2021 (AL-085) in force to May 24, 2021. Birmingham's own ordinances adopted the State Health Officer's orders by reference and made their violation a municipal offense (AL-070 § 1(b), § 3: fine up to $500). SB 267 (passed May 17, 2021; Ex. AL-078) barred State and local governments from issuing vaccine passports or conditioning services on immunization and barred every business in the State from refusing service on the basis of immunization status; Executive Order 724 (October 25, 2021, post-period; Ex. AL-080) directed State agencies not to enforce federal vaccination mandates.

Child care

Preschools and child-care centers closed at the close of business March 19, 2020 except centers serving essential employees' children (AL-005 ¶ 4.b); from March 20, 2020 facilities with 12 or more children in a room closed (AL-006 ¶ 4.b; AL-013 ¶ 12.b) through May 22, 2020; reopened May 23, 2020 at 5:00 p.m. under distancing, sanitation and employee-mask rules (AL-021 ¶ 14); day and overnight camps under rules from May 23, 2020 (¶ 15); rules became recommendations April 9, 2021 (AL-049 ¶ 6).

Worship and gatherings

Gatherings of 25+ prohibited from 5:00 p.m. March 19, 2020 (AL-005 ¶ 1); non-work gatherings of 10+ prohibited from 5:00 p.m. March 28, 2020 (AL-011 ¶ 1), with religious services limited to fewer than 10 persons or drive-in format under the Stay at Home Order (AL-013 ¶ 1.c); from May 11, 2020 gatherings of any size that cannot maintain six feet between households prohibited, 'non-work related gathering' defined to include church services, weddings, funerals, concerts, festivals and sporting events (AL-020 ¶ 3; AL-017 ¶ 3); masks required at outdoor gatherings of 10+ from July 16, 2020 (AL-027 ¶ 2); gathering rule became a recommendation April 9, 2021 (AL-049).

Courts and public offices

Supreme Court of Alabama: all in-person proceedings suspended March 16 to April 16, 2020 (AL-054), extended to April 30 (AL-056) and May 15, 2020 (AL-057); in-person hearings authorized after May 15 at presiding circuit judges' discretion and jury trials suspended until September 14, 2020 (AL-058); workers'-compensation and remote-testimony orders extended to December 31, 2020, April 30, July 29 and October 29, 2021 (AL-059 to AL-061, AL-063); judicial state of emergency ended July 7, 2021 (AL-062) and was re-declared August 20 to November 29, 2021 (AL-064); Heflin-Torbert Judicial Building closed to the public March 19 to June 2, 2020; public bodies authorized to meet remotely and to postpone public hearings from March 18 and April 2, 2020 (AL-004 § III; AL-012 § IV); summonses in lieu of arrest (AL-010 § V); parole hearings cancelled March 2020 (ADPH inventory, not saved).

Travel and quarantine

No statewide travel-quarantine order; every person who tested positive quarantined at home for 14 days from April 4, 2020 (AL-013 ¶ 9), 'for a period of time specified by the State Health Officer' from August 27, 2020 (AL-032 ¶ 3) through May 31, 2021 (AL-051 ¶ 2); employers directed to minimize employee travel April 30, 2020 to April 9, 2021 (AL-017 ¶ 4.g); beaches closed March 19 to April 30, 2020; Birmingham (March 24 to May 15, 2020), Mobile (April 4 to 30, 2020), Tuscaloosa (March 27 to April 11, 2020) and Montgomery (from March 27, 2020) curfews (AL-069 to AL-071, AL-093 to AL-095); the August 13, 2021 proclamation invoked 49 C.F.R. § 390.23 to waive hours-of-service rules for emergency freight (AL-052 § VI).

Face coverings

Birmingham Ordinance 20-69 required masks in public from May 1, 2020 (AL-075; extended by AL-072, AL-073 and later ordinances to July 3, 2020); Jefferson County Health Officer's order required face coverings countywide from 5:00 p.m. June 29, 2020 (AL-074); employee masks required at close-contact providers, gyms and restaurants from May 11, 2020 (AL-020); statewide requirement for 'each person' in indoor public spaces, transportation-service vehicles and outdoor gatherings of 10+ from 5:00 p.m. July 16, 2020 (AL-027 ¶ 2), promulgated with a $500 fine or county jail (AL-026 § I), extended through 5:00 p.m. April 9, 2021 (AL-045, AL-047, AL-048 § I); students from second grade from July 29, 2020 (AL-030); Birmingham Ordinance 21-31 from April 6 to May 24, 2021 (AL-085); Birmingham City facilities from July 30, 2021 (AL-086) and Birmingham City Schools from August 2, 2021 (AL-084).

Vaccination mandates

None issued by the State for health-care workers, State employees or students; SB 267 (passed May 17, 2021) prohibited vaccine passports, conditioning government services on immunization and refusal of service by any business on the basis of immunization status (AL-078); Executive Order 724 of October 25, 2021 (post-period) directed the executive branch not to enforce federal mandates (AL-080).

Standing duties

The statutes, codes and penalty provisions of Alabama that stood before March 2020 and ran through every claimable quarter. They are the reason nothing an employer did under the orders was voluntary. Read the Alabama duties →

Alabama bound its employers through four standing layers of law that existed before March 2020 and ran through every claimable quarter. First, the health code. Ala. Code § 22-2-2(6) gives the State Board of Health power to adopt rules 'for administering the health and quarantine laws of the state, which rules and regulations shall have the force and effect of law,' § 22-2-8 makes the State Health Officer the Board's acting executive with the duty to 'take prompt measures to prevent' invading disease, § 22-11A-7 commands every person reported with a notifiable disease to 'conform to or obey the instructions or directions' of the health officers, chapter 22-12 supplies the quarantine power and warrantless arrest for its violation, and § 22-2-14 makes the knowing violation of any Board rule a misdemeanor with each day a separate offense. The State Health Officer's COVID-19 orders were issued under § 22-2-2(4) and adopted as an emergency rule of the Board on March 20, 2020 (Ex. AL-007), so the § 22-2-14 penalty attached from that day, as the Attorney General told every law-enforcement agency on March 21 and April 5, 2020 (Exs. DUT-AL-016, DUT-AL-017). Second, the Emergency Management Act. From July 15, 2020 every Safer at Home, Safer Apart and mask order was promulgated by the Governor under §§ 31-9-6(1) and 31-9-13, which give such orders 'the full force and effect of law,' with the § 31-9-22 penalty of a $500 fine and county jail (Exs. AL-026 and every later proclamation; DUT-AL-011 to DUT-AL-014). Third, the workplace duty. Alabama has no State OSHA plan; 29 U.S.C. § 654(a)(1) bound every Alabama employer directly, and Ala. Code § 25-1-1 independently requires every employer to 'do everything reasonably necessary to protect the life, health and safety of his employees,' defining safety to include 'conditions and methods of sanitation and hygiene' (Exs. DUT-AL-009, DUT-AL-010). Fourth, the liability shield. Act 2021-4 (SB 30), effective February 12, 2021 and retroactive to March 13, 2020, withholds its protection from a covered entity that a claimant shows 'did not reasonably attempt to comply with the then applicable public health guidance,' defined as guidance 'in any proclamation, order, or rule of the Governor, the State Health Officer, or the State Board of Health' (Ex. DUT-AL-015); the Governor's May 8, 2020 proclamation (Ex. AL-019) carried the same condition. The orders themselves wrote operating conditions in the imperative: 'all employers shall take reasonable steps'; 'all retail stores shall comply with the following rules'; the retailer 'shall take reasonable steps to comply with guidelines on sanitation from the Centers for Disease Control and Prevention and the Alabama Department of Public Health'; ABC licensees 'shall abide by the directives of the State Health Officer in all aspects of the operation' (Exs. AL-013, AL-017, AL-020, AL-027, AL-035). Where the State chose a recommendation it said so ('are encouraged,' 'should,' 'strongly recommended': Ex. AL-049 from April 9, 2021; Two courts of the period stated the structure: the Middle District of Alabama held that the Board's rules 'shall have the force of law' and that Alabama law gave the State Health Officer 'the ability to issue orders in response to COVID-19' (Ex. DUT-AL-021), and the Supreme Court of Alabama recited the promulgation of each order under the Emergency Management Act with the § 31-9-22 penalty (Ex. DUT-AL-020). The measures an Alabama employer took to distance, screen, sanitize, mask, telework and reduce occupancy were the means of complying with duties the law imposed; the word 'voluntary' does not describe them.

Whether the measures Alabama employers took beyond the words of the emergency orders were 'voluntary' within Notice 2021-20 Q&A-14, or were compelled by standing legal duties that bound employers independent of, and in addition to, the orders already in the Orders Library.
