Operative words

I, Kay Ivey, Governor of the State of Alabama, on the recommendation of the State Health Officer and pursuant to relevant provisions of the Alabama Emergency Management Act of 1955, as amended, Ala. Code §§ 31-9-1 et seq., do hereby declare that a state public health emergency exists in the State of Alabama.... Health care facilities that have invoked their emergency operation plans in response to this public health emergency may implement the 'alternative standards of care' plans provided therein, and those alternative standards of care are declared to be the state-approved standard of care in health care facilities

Ala. Code § 31-9-8 (sixty-day duration unless extended); § 31-9-13 (orders under the Act have force of law); § 31-9-22 (violation of an order under the Act: fine of not more than $500 or imprisonment) as recited in later proclamations (Ex. AL-026 § I)

Notes

Predicate only under T9(b); every State Health Officer order and every suspension of licensure, notarization, meeting, procurement and eviction law rests on it. Its termination date (July 6, 2021) is fixed by Ex. AL-079; it was re-declared August 13, 2021 (Ex. AL-052).
