In plain terms: if you run a home health or home care agency, a hospice, a nursing home, an assisted living community or an adult day center, the orders of 2020 and 2021 did not close your doors. They did what the IRS letters leave out. From March 13, 2020 a federal directive barred every visitor from every certified nursing home and cancelled communal dining and every group activity. From May 2020 the States began ordering universal testing of your residents and your staff, and from September 2, 2020 a federal condition of participation required it on a schedule set by your county's positivity rate, with untested workers kept out of the building. Hospitals were ordered to stop the elective procedures that generate your referrals, and New York would not let a hospital discharge to a nursing home without a negative test. Your aides worked under screening at the door of every home, under a federal occupational standard from June 21, 2021, and, in fifteen States and cities, under vaccination-or-testing orders issued between July 26 and September 28, 2021 that named home care agencies and home health aides in terms. Those orders reached all twelve functions of your business: the visit, the assessment, the admission, the visitor, the referral, infection control, transport, dining, hiring, the office, the workforce and the payer.

This page sets out those orders layer by layer, quarter by quarter and function by function, with a link to the instrument behind each one, and answers the fourteen sentences the IRS letters use. The quarter the letters most often dispute is the third quarter of 2021, and the record answers it: on every day of that quarter, in every State, a federal testing condition, a federal visitation condition and a federal occupational standard were in force on this industry.

Partial suspension, element by element

Every analysis on this site asks the same five questions in the same order. Here they are asked of Home Care, Nursing and Senior Living, from the industry's own record.

The statute's answer.A partial suspension is a temporary delay, interruption or termination of a portion of the business's operations; the order need only be the but-for cause of it; and nothing in the Suspension Clause asks whether the business was essential, stayed open, could telework or served customers who were themselves under orders (Tri-State Memorial Hospital v.
