In plain terms: if you run a gym, a studio, a rink, a pool, a movie theater, a live venue, a bowling center, an arcade, an amusement park, a league or a team, your product is a room full of people, and the governmental orders of 2020 and 2021 were written about that room. Between March 16 and April 3, 2020 every State and the District of Columbia closed your kind of business by name or by a gathering prohibition that had the same effect. Nothing reopened without conditions the orders wrote: a cap of twenty-five to fifty percent, a class limit, closed locker rooms, saunas, showers and child care, six to fourteen feet between exercisers, reservation-only entry, no spectators, no indoor performance. Between November 13 and December 26, 2020 thirty-one States and the District closed or capped you a second time. On March 31, 2021 capacity or gathering orders still reached gyms, theaters or venues in thirty-seven jurisdictions, and the last statewide caps lifted between May 19 and July 6, 2021. In the summer of 2021 Hawaii re-capped the industry statewide, four of the nation's largest cities barred the unvaccinated from your doors, five States and two counties conditioned your largest events, and more than twenty jurisdictions placed every person on your floor under face-covering and exposure-control rules that the business had to enforce.

This page covers the eleven functions of a business in this industry, the layers of government whose orders reached each, the six quarters one by one, and the fourteen sentences the Internal Revenue Service (the "Service") uses in its letters, each answered from the public orders in this site's Orders Library (the "Library"). The statute's operative text, the "Suspension Clause", asks whether the operation of a trade or business was fully or partially suspended during a quarter due to orders limiting commerce, travel or group meetings; Notice 2021-20 (the "Notice") is the Service's guidance on it; the "United States" is the Government as litigant. The quarter the Service's letters most often dispute is the third quarter of 2021, and the record answers it: the orders in force from July 1 to September 30, 2021 are listed below by issuer, date and operative clause.

Partial suspension, element by element

Every analysis on this site asks the same five questions in the same order. Here they are asked of Fitness, Arts, Entertainment and Sports, from the industry's own record.

  1. The order: issuer, instrument, date, exhibit.The Library holds 17 instruments from this industry's own regulators and sector authorities and 67 organizer notices. The earliest is Bureau of Labor Statistics, The Employment Situation, April 2020 (USDL-20-0815) (May 8, 2020) (Ex. SEC-17-002).   2. The function of the business it reached.The orders named the functions of the business in terms.   3. The change it compelled: the operative words.The operative words of The Employment Situation, April 2020 (USDL-20-0815) (Ex. SEC-17-002): “In April, employment in leisure and hospitality plummeted by 7.7 million, or 47 percent.... Employment also fell in the arts, entertainment, and recreation industry (-1.3 million) and in the accommodation industry (-839,000). Table B-1: Arts, entertainment, and recreation 2,472.4 (Feb. 2020)...…” Each record page quotes the operative words in full, with the enforcement provision beside them.
  4. The quarter: in force on which days.Every instrument carries the quarters it was in force.   5. The statute's answer.A partial suspension is a temporary delay, interruption or termination of a portion of the business's operations; the order need only be the but-for cause of it; and nothing in the Suspension Clause asks whether the business was essential, stayed open, could telework or served customers who were themselves under orders (Tri-State Memorial Hospital v. Function codes

The analysis describes the business as eleven functions, each with a two-letter code that every page of this set uses without variation. An order “reached” a function when its operative words told the business what that part of it could do, when, where, for how many and on what conditions.
