The record in brief

Idaho's regime ran on three layers that the exhibits document from the issuing authorities' own texts: (1) the Governor's emergency chain under Idaho Code § 46-1008 and the extreme-emergency proclamation under Idaho Code § 46-601 (Mar. 13 and Mar. 25, 2020), renewed in thirty-day increments without interruption through July 19, 2021 (Ex. ID-047), re-declared Aug. 17, 2021 (recited in EO 2021-11, Ex. ID-030) and continued until the Governor announced its end effective Apr. 15, 2022 (Ex. ID-063); (2) the Department of Health and Welfare Director's orders of isolation under Idaho Code § 56-1003(7), enforceable as misdemeanors under § 56-1003(7)(c) and Idaho Code § 18-113 (six months, $1,000); and (3) the public health districts' and cities' orders under Idaho Code §§ 39-414, 39-415, 39-419 and 56-1003(7), which every State order expressly preserved ('the cities, counties, and public health districts of the State of Idaho may enact more stringent public health orders than those set out in this Order'). 2020 Q2: the statewide Order to Self-Isolate (Mar. 25, 2020, Ex. ID-003; amended Apr. 15, 2020, Ex. ID-004) ordered all individuals to self-isolate, ordered every business except Essential Businesses to 'cease all activities at facilities located within the state except Minimum Basic Operations', closed bars, nightclubs, dine-in restaurants, gyms and recreation facilities, prohibited 'all public and private gatherings and multi-person activities... regardless of the number of people involved', prohibited all non-essential travel, and from Apr. 15 required every person entering Idaho to self-quarantine for fourteen days; it ran to 11:59 p.m. Apr. 30, 2020. The Idaho Rebounds Stay Healthy Orders then reopened in stages by mandatory order: Stage 1 (eff. May 1, Ex. ID-005: bars, nightclubs, dining rooms, gyms, close-contact services and large venues 'required to remain closed'; 14-day traveler quarantine still required; employers 'shall' implement distancing and sanitation measures), Stage 2 (eff. May 16, Ex. ID-006: bars, nightclubs and large venues closed; gatherings over ten to be avoided; traveler quarantine reduced to 'strongly encouraged'), Stage 3 (eff. May 30, Ex. ID-007: nightclubs and large venues closed; gatherings over fifty to be avoided), and Stage 4 Guidelines (eff. June 13, 2020, Ex. ID-008: all businesses may operate; recommendations only). Ada County did not follow the State to Stage 4: Central District Health's order of June 22, 2020 (eff. June 24, Ex. ID-022) closed Ada County bars and nightclubs by quarantine order, prohibited large-venue gatherings and imposed mandatory employer distancing and sanitation duties; the City of Boise's Public Health Emergency Order 20-09 (eff. June 24, Ex. ID-073) closed bars and prohibited gatherings over fifty. The Idaho Supreme Court's Emergency Reduction in Court Services order (Mar. 25, 2020, Ex. ID-081) limited courts to emergency hearings, called no jury panels and continued criminal trials through Apr. 30, 2020; the State Board of Education closed schools to in-person instruction Mar. 24, 2020 for the year (secondary). 2020 Q3: the State stood at Stage 4 (guidelines) with the emergency renewed July 10, Aug. 7 and Sept. 4 (Exs. ID-034 to ID-036) and a regional response in which the health districts set restrictions; in Ada County the CDH orders of July 14 and Aug. 11, 2020 (Exs. ID-023, ID-024) kept bars closed, prohibited gatherings of fifty or more and social gatherings over ten, required face coverings in public places and on school property, and imposed employer duties, while Boise Order 20-10 (eff. July 4, Ex. ID-074) required face coverings citywide; CDH's Valley County face-covering order took effect Aug. 11, 2020 (Ex. ID-080). 2020 Q4 was the re-tightening: the Modified Stage 3 Stay Healthy Order (eff. Oct. 27, 2020, Ex. ID-009) prohibited indoor gatherings over fifty, capped outdoor gatherings at 25 percent of permitted occupancy, required patrons of bars, restaurants and nightclubs to remain seated, mandated face coverings in long-term care facilities and converted the employer duties back to 'shall'; the Modified Stage 2 Order (eff. Nov. 14, 2020, Ex. ID-010; reissued Dec. 30, 2020, Ex. ID-011) prohibited all gatherings over ten, public and private, kept seated-only service and LTC masks, and made employer duties mandatory ('Employers must'); EO 2020-19 activated the National Guard (Ex. ID-027); CDH's Oct. 20, 2020 Ada County order (Ex. ID-025) kept bars closed until a school-category trigger, required masks and capped social gatherings at ten; Boise Order 20-13 (eff. Nov. 23, Ex. ID-075) required face coverings and closed bars; South Central Public Health District Order 2020-01 (Nov. 12, 2020, Exs. ID-058, ID-059) mandated face coverings in eight counties under penalty of Idaho Code § 39-419; the Supreme Court's Oct. 8, 2020 order barred civil jury trials before Dec. 1, 2020 and made proceedings presumptively remote (Ex. ID-082). 2021 Q1: the Stage 2 Order remained in force until the Stage 3 Guidelines of Feb. 2, 2021 (Ex. ID-012) rescinded it and converted the statewide gathering cap (now fifty) and seated-only rule to recommendations while keeping the LTC face-covering requirement mandatory; CDH lifted the Ada County order and Valley County mask order Feb. 19, 2021 (Ex. ID-065); Boise Order 20-14 (eff. Feb. 19, 2021, Ex. ID-076) continued the city's mask requirement and prohibited gatherings of fifty or more. 2021 Q2: Boise Order 20-16 (eff. Apr. 28, Ex. ID-077) required indoor face coverings until Order 20-17 (eff. May 14, 2021, Ex. ID-078) reduced them to a recommendation; EO 2021-04 (Apr. 7, 2021, Ex. ID-028) barred State entities from requiring vaccination proof; the Stage 4 Guidelines of May 11, 2021 (Ex. ID-013) removed the recommended gathering cap and kept the LTC face-covering requirement; Lt. Governor McGeachin's EO 2021-07 (May 27, 2021) purporting to bar local mask mandates was repealed the next day by EO 2021-08 (Ex. ID-029), which recites that Idaho law vests cities, counties, schools and health districts with that authority. 2021 Q3: the emergency declaration continued (Exs. ID-046, ID-047; Aug. 17, 2021 re-declaration recited in Ex. ID-030); the Stage 4 Guidelines with the mandatory LTC face-covering requirement remained the State's operative instrument (Ex. ID-013); EO 2021-11 (Aug. 31, 2021, Ex. ID-030) re-activated the Guard because hospitals were reducing operations and diverting patients; the Department activated Crisis Standards of Care under IDAPA 16.02.09 for the Panhandle and North Central districts on Sept. 7, 2021 (Ex. ID-064) and statewide on Sept. 16, 2021 (secondary); the Boise School District required masks of all students and staff from Aug. 3, 2021 (Ex. ID-079); the Fourth Judicial District imposed masks and distancing in the Ada County courthouses from Aug. 9, 2021 under the Supreme Court's June 25, 2021 amended emergency order (Ex. ID-084); the Department's June 9, 2021 long-term care visitation guidelines (Ex. ID-051) and the Rebound business guidelines (Ex. ID-057) governed facilities and employers. Idaho never issued a statewide mask mandate and never preempted local orders during the period.

Preemption of local orders

Idaho did not preempt local orders at any time from March 2020 through September 30, 2021. Every statewide order preserved local authority in terms: 'To decrease the spread of COVID-19, the cities, counties, and public health districts of the State of Idaho may enact more stringent public health orders than those set out in this Order' (Ex. ID-003 § 11; Ex. ID-004 § 11; Ex. ID-005 § 11; Ex. ID-006 § 11; Ex. ID-007 § 11); from Oct. 27, 2020 the clause added 'school districts, and institutions of higher education' and from Nov. 14, 2020 provided that 'Health orders issued by cities, counties, public health districts, school districts, or institutions of higher education that are more stringent than this Order remain valid' (Ex. ID-009 § 7; Ex. ID-010 § 9; Ex. ID-011 § 9). The only attempted preemption was Executive Order 2021-07, signed by Lt. Governor McGeachin as acting Governor at 11:00 a.m. May 27, 2021, barring State and local mask mandates; Governor Little repealed it 'in its entirety' by Executive Order 2021-08 on May 28, 2021, retroactive to 11:00 a.m. May 27, 2021, reciting that Idaho Const. art. XII, § 2 and Idaho Code §§ 50-304, 39-414 and 33-512 vest cities, counties, schools and public health districts with authority 'to act as they deem necessary to protect the health and safety of the people they serve' (Ex. ID-029). Lt. Governor McGeachin's EO 2021-13 (Oct. 5, 2021, post-period) was repealed by EO 2021-14 on Oct. 6, 2021 (Ex. ID-032). The Legislature's emergency-powers bills (H.B. 135, S.B. 1136) were vetoed Apr. 16, 2021 and the vetoes stood. No statute limiting local health orders took effect in the period.

Face coverings

No statewide mask mandate (ID-029 recital). Statewide mandatory face coverings only in long-term care facilities from Oct. 27, 2020 through Sept. 30, 2021 and beyond (ID-009, ID-010, ID-011, ID-012, ID-013, ID-048). Vaccination mandates

None issued by the State; EO 2021-04 (Apr. 7, 2021) bars State executive entities from requiring vaccination proof for services (ID-028); EO 2021-14 (Oct. 6, 2021) repealed the Lt. Governor's Oct. 5, 2021 order banning mandatory testing and kept EO 2021-04 in force (ID-032); Stage 4 Guidelines encourage vaccination (ID-013 § 1); LTC visitation guidelines direct facilities to record vaccination status and prefer vaccinated visitors (ID-051). Hospital-system employee mandates announced in 2021 were private, not governmental, and are not catalogued.

Standing duties

The statutes, codes and penalty provisions of Idaho that stood before March 2020 and ran through every claimable quarter. They are the reason nothing an employer did under the orders was voluntary. Read the Idaho duties →

Idaho's communicable-disease law placed every person under a standing statutory duty to obey the orders of the Director of Health and Welfare and of the seven public health districts, and made disobedience a crime on a negligence standard. Idaho Code section 56-1003(7) (2020 text) gave the Director 'the power to impose and enforce orders of isolation and quarantine to protect the public from the spread of infectious or communicable diseases' and provided that 'any person who violates an order of isolation or quarantine shall be guilty of a misdemeanor' (Ex. DUT-ID-001); this is the clause every statewide Idaho order of 2020 recited as its penalty (Exs. ID-003 to ID-011). Section 56-1008 made it a misdemeanor for 'any person who willfully or negligently violates any of the provisions of the public health laws or the terms of any lawful notice, order, permit, standard, or rule issued pursuant thereto' (Ex. DUT-ID-012). Section 39-419 (2020 text) made it 'unlawful for any person, association, or corporation, and the officers thereof to willfully violate, disobey, or disregard the provisions of the public health laws or the terms of any lawful notice, order, standard, rule, regulation, or ordinance issued pursuant thereto' (Ex. DUT-ID-005), the penalty clause the Central District Health, South Central Public Health District and Boise orders recited (Exs. ID-022 to ID-025, ID-058, ID-059, ID-073). The district boards were charged 'to administer and enforce all state and district health laws' and 'to do all things required for the preservation and protection of the public health' (Ex. DUT-ID-003), with 'the same authority... in relation to the right of quarantine within the public health district as does the state' (Ex. DUT-ID-004). The Board of Health and Welfare's communicable-disease rule, IDAPA 16.02.10 (2020 edition), authorized the closing of 'any... place of public assembly' that 'must not reopen until permitted by the health official', defined quarantine as 'the restriction placed on the entrance to and exit from the place or premises where an infectious agent... exists', and excluded infected food employees and care workers from work (Ex. DUT-ID-007). The Disaster Preparedness Act gave the Governor's proclamations 'the force and effect of law' (Ex. DUT-ID-008) and, during an extreme emergency, 'all police power vested in the state' (Ex. DUT-ID-009); the Legislature rewrote both provisions effective May 10, 2021 to require that emergency orders be 'narrowly tailored' and place no 'unnecessary restrictions on the ability for a person... to work' (Exs. DUT-ID-010, DUT-ID-019), and from July 1, 2021 confined isolation and quarantine orders to persons diagnosed or exposed (Ex. DUT-ID-002); from March 19, 2021 a willful violation of a county-wide or district-wide health order became a fifty-dollar infraction while every other violation remained a misdemeanor (Ex. DUT-ID-006). Idaho has no State occupational-safety plan; private employers were bound by the federal general duty clause and OSHA's COVID-19 guidance and enforcement programs (Exs. FED-088, FED-082, FED-083, FED-084, FED-080). The Coronavirus Limited Immunity Act (Aug. 27, 2020; extended to July 1, 2022) immunized persons from coronavirus-exposure suits except for 'an intentional tort or willful or reckless misconduct as defined in section 6-1601' (Exs. DUT-ID-016, DUT-ID-017, DUT-ID-018); it contains no compliance-with-guidance condition, and it left criminal enforcement of the health laws untouched. The public-nuisance statutes made 'anything which is injurious to health' a public nuisance and its maintenance, or the willful omission 'to perform any legal duty relating to the removal of a public nuisance', a misdemeanor (Exs. DUT-ID-013, DUT-ID-014); the Food Establishment Act made food-establishment rules enforceable by misdemeanor proceedings under section 56-1008 (Ex. DUT-ID-015). The statewide orders themselves conditioned continued operation on distancing, sanitation and disinfection ('Employers shall', May 1 to June 12, 2020, Exs. ID-005 to ID-007; 'Employers must', Oct. 27, 2020 to Feb. 1, 2021, Exs. ID-009 to ID-011), while the Stage 4 and 2021 Guidelines used 'should' and 'are encouraged' (Exs. ID-008, ID-012, ID-013, ID-057); the Ada County and Boise orders used 'shall' and 'must comply' (Exs. ID-022 to ID-025, ID-073, ID-075, ID-076).
