Operative words

Section 1. Stage Two Modified Order - Incorporated Herein. Section 2. CDH Order: Restriction [incorporated]. Section 3. Businesses - Required Compliance. All businesses that are eligible to remain open pursuant to the Stage Two Modified Order and the CDH Order: Restriction must comply with all social distancing and sanitation recommendations and requirements... Section 4.B. Every person is required to wear a face covering that completely covers the person's nose and mouth when the person is in a public place. ['public place' includes] outdoor public areas, including but not limited to public parks, trails, streets, sidewalks, lines for entry, exit or service. Section 7. Bars and Bicycle Bars. All bars, as defined by Boise City Code Section 5-11-6, including nightclubs, shall remain closed until they are permitted to open according to the criteria and requirements set forth in the CDH Order: Restriction. All non-motorized commercial touring services (i.e., bicycle bars)... shall remain closed.

Enforcement

Section 8: Boise City Code § 1-15-10 misdemeanor; City Clerk may treat a licensed business operating in violation as 'a clear and immediate threat' to its license

Makes the State's Stage 2 Modified Order and the CDH Oct. 20 order enforceable as City law; recites Orders 20-12, 20-12a (Oct. 16, 2020) and 20-12b (Oct. 27, 2020) on businesses, airport, bars and bicycle bars.
