Veterinary and Animal Services

The veterinary and animal-services industry is the health-care sector Congress never separated from the rest of medicine when it wrote the Suspension Clause, and the governmental orders of 2020 and 2021 did not separate it either.

In plain terms: if you ran a veterinary practice, an animal hospital, a boarding kennel or daycare, a grooming salon, a training school or an animal shelter between March 2020 and September 2021, the government told you, under penalty, which procedures you could perform, where your customers had to wait, what to do with your masks and anesthesia machines, whether your groomers could open, and how you could lawfully examine an animal and prescribe. Six States suspended elective veterinary work in the spring of 2020, and three kept every elective procedure under written conditions for more than a year afterward. At least fourteen States closed pet grooming as a personal service. Michigan ordered every veterinary facility to postpone non-essential services and to practice by telemedicine "to the fullest extent possible." Pennsylvania, Kansas, California and Delaware required a face covering of every person who entered a "veterinary clinic" by name. Oregon restored a "Veterinary Clinics" appendix to its workplace rule on August 13, 2021.

The orders reached all eleven functions of the business, from the surgical suite to the boarding run, the grooming table, the pharmacy, the supply closet, the front desk, the workforce and the customers who bring the animals in. This page sets them out by layer, quarter and function, with instrument numbers, dates and exhibit links, and answers from the public record the fourteen sentences the Internal Revenue Service (the "Service") uses in its letters. Four terms recur: the "Suspension Clause" (CARES Act § 2301(c)(2)(A)(ii)(I) and I.R.C. § 3134(c)(2)(A)(ii)(I)), the "Notice" (Notice 2021-20), the "United States" (the Government as a litigant) and the "Library" (this site's Orders Library; "Ex. SEC-26-009" is an exhibit). The quarter the Service's letters most often dispute is the third quarter of 2021, and the record answers it.

Partial suspension, element by element

Every analysis on this site asks the same five questions in the same order. Here they are asked of Veterinary and Animal Services, from the industry's own record.

SEC-26-008): “In some localities, such as San Francisco, and states, like Maryland and Pennsylvania, veterinary practices are appropriately considered 'essential businesses.'...   5. The statute's answer.A partial suspension is a temporary delay, interruption or termination of a portion of the business's operations; the order need only be the but-for cause of it; and nothing in the Suspension Clause asks whether the business was essential, stayed open, could telework or served customers who were themselves under orders (Tri-State Memorial Hospital v.
