The record in brief

Alaska imposed one of the country's shortest statewide business lockdowns and one of its longest travel-quarantine regimes, and it never issued a statewide mask order; the State's largest city and its capital carried the restrictive load from mid-2020 through the spring of 2021, and the State itself re-entered the field in September 2021 with a hospital-capacity order under a statute enacted for that purpose. Governor Dunleavy declared a Public Health Disaster Emergency under AS 26.23.020 on March 11, 2020 (Ex. AK-001), the Legislature extended it to November 15, 2020 by SB 241 (ch. 10, SLA 2020) (AK-002), and DHSS issued eighteen numbered COVID-19 Health Mandates in five weeks. Health Mandate 003 (March 17) closed every bar, brewery and restaurant in the State to dine-in service and closed theaters, gyms, bowling alleys and bingo halls from March 18 at 5:00 p.m. (AK-005); Mandates 005 and 006 (March 19) ordered every hospital, surgical center and provider to postpone all non-urgent or elective procedures for three months and all elective dental procedures for one month (AK-007, AK-008); Mandates 001, 008 and 013 closed every public and private K-12 school to students from March 16 through the end of the 2019-20 school year (AK-003, AK-010, AK-015); Mandate 009 (March 23) stopped all personal-care services and all gatherings of more than ten statewide (AK-011); Mandate 010 (March 23) ordered every person arriving in Alaska to self-quarantine for fourteen days from March 25, on pain of a $25,000 fine or a year in jail (AK-012); and Mandate 011 (March 27) ordered all persons to remain at their residences, closed every business not on the Essential Services and Critical Workforce Infrastructure list except Minimum Basic Operations, prohibited all gatherings with non-household members regardless of size, and directed employers to enable remote work, effective March 28 at 5:00 p.m. (AK-013, AK-021). Mandate 012 prohibited all in-state travel between communities except for critical infrastructure and critical personal needs and expressly superseded local orders (AK-014). The second quarter of 2020 therefore opened under a full stay-home, business-closure, school-closure, elective-procedure and travel-quarantine regime. Reopening came in three steps under Mandate 016: Phase I on April 24, 2020 (Attachments D-H reopened non-essential businesses, retail, dine-in, personal care under conditions) (AK-085); Phase II on May 8, 2020 at fifty percent of maximum occupancy, household-only groups, reservations and visitor logs, and gatherings of no more than fifty (AK-018, AK-042, AK-043); and Phase III/IV on May 22, 2020, when the State converted the business and gathering attachments to advisory documents and ended statewide capacity and gathering limits (AK-098 to AK-100, AK-048). The instruments that remained after May 22 were the ones that reached commerce and travel most directly: Mandate 010, revised on June 5 (testing alternative), August 6 (non-residents must pre-test) and October 15, 2020 (AK-038, AK-039, AK-022), which required every arriving traveler to test or quarantine through November 15, 2020 and continued as COVID-19 Outbreak Health Order No. 6 from November 16, 2020 to February 14, 2021 (AK-035); Mandate 018 on intrastate travel to off-road communities and the protective-plan filing requirement for every business with staff traveling between communities (AK-020), continued as Outbreak Health Order No. 8 (AK-036); Mandate 015 on health-care delivery (universal masking, screening of every patient, conditions on elective surgery) (AK-017, AK-044); Mandate 017 and Outbreak Health Order No. 5 on commercial fishing, seafood processing and critical-infrastructure protective plans (AK-019, AK-034, AK-037); and the Governor's July 22, 2020 directive that every employee, contractor and visitor to State facilities wear a mask (AK-050). The winter re-tightening was real but took two forms: the Governor's November 12, 2020 emergency alert ordering all executive-branch employees to work from home whenever feasible, recited in the Chief Justice's Special Order 8210 (AK-055, AK-102); the November 6 re-declaration effective November 16, 2020 and its renewals on December 15, 2020 and January 14, 2021 (AK-023, AK-025, AK-026) with eight Outbreak Health Orders (AK-032 to AK-037); and, in Anchorage, Emergency Order EO-16 (December 1, 2020 to January 1, 2021), which closed indoor dining and entertainment, capped retail, gyms and salons at twenty-five percent, limited indoor gatherings to six and required remote work where possible (AK-074), followed by EO-17 (January 1, 2021: twenty-five percent hospitality, alcohol service ending at 11:00 p.m.), EO-18 (February 1: fifty percent), EO-19 (March 8: distancing-based limits, gatherings of 25/35 indoors) and EO-20 (April 16: gatherings of 25/35, industry attachments), all carrying a mandatory remote-work clause and a two-week closure penalty (AK-075 to AK-078). Anchorage's mask order EO-13 ran from June 29, 2020 through at least May 3, 2021 in five versions (AK-071, AK-080); its summer 2020 orders EO-14 (July 24: indoor gatherings over 25 prohibited, bars at twenty-five percent) and EO-15 (August 3-30: bars, indoor dining, theaters and bingo halls closed, indoor gatherings over 15 prohibited, remote work required) are the reason the Chief Justice kept jury trials suspended (AK-072, AK-073, AK-053). Juneau required masks indoors by Emergency Ordinance 2020-41 (July 20, 2020) and 2020-49 (September 21, 2020), re-established its COVID-19 Mitigation Strategies with incident risk levels by Emergency Ordinance 2021-11 (April 26, 2021), raised the level to High on July 30, 2021 (indoor masks required, indoor gatherings capped at 50, bars and gyms at half capacity) and extended the regime to March 1, 2022 by Ordinance 2021-42 on September 27, 2021 (AK-040, AK-041, AK-095, AK-096). The State's disaster declaration lapsed at 12:00 a.m. on February 14, 2021; the Governor directed every department to keep all COVID-19 policies in force for State operations (AK-027) and DHSS converted the travel orders to Health Advisories (AK-083, AK-084, AK-086, AK-087). HB 76 (ch. 2, SLA 2021), signed April 30, 2021, ratified the November, December and January declarations, extended the January 15 declaration to December 31, 2021 retroactive to February 14, 2021, and created a new DHSS public-health-emergency power (AK-028); the Governor ended the disaster declaration the same day (AK-029) and Commissioner Crum declared a COVID-19 Public Health Emergency effective May 1, 2021 that remained in force through and beyond September 30, 2021 (AK-030). On September 21-22, 2021 DHSS issued Addendum No. 1 to that order, finding Anchorage hospitals on EMS divert more than ninety percent of the time, directing hospitals to implement CMS 1135 flexibilities, to postpone or reschedule medical and surgical procedures and to increase patient-to-staff ratios, and activating crisis standards of care (AK-031, AK-092). The Alaska Court System stopped new jury trials on March 15, 2020, suspended almost all proceedings from March 23, kept jury trials suspended (with limited exceptions) into 2021, resumed the most serious felony trials only on July 6, 2021, required masks of every courthouse visitor from August 3, 2021, and suspended every in-person civil jury trial from August 31, 2021 through January 10, 2022 (AK-101, AK-051 to AK-062). The third quarter of 2021 in Alaska therefore had in force: the DHSS Public Health Emergency Order and its September addendum; the courts' mask, screening and civil-trial-suspension orders; Juneau's mitigation ordinance at Level High from July 30; the Anchorage and Fairbanks school districts' universal-masking rules from August 9 and September 13, 2021; and the federal layer.

Preemption of local orders

Alaska did not preempt or bar local business, gathering or mask orders at any time in the period; it superseded local travel restrictions in the spring of 2020 and later confined local travel rules within limits. Health Mandate 010 (March 23, 2020) provides: 'This Mandate supersedes any local government travel restrictions' (AK-012, p. 2); Health Mandate 012 (March 27, 2020) provides: 'This Mandate supersedes any local government or tribal mandate, directive, or order restricting intrastate travel' (AK-014, p. 2); Health Mandate 011 (March 27, 2020) provides: 'This mandate supersedes any local government or tribal mandate, directive, or order' (AK-013, p. 3). Health Mandate 018 (May 12, 2020) and the DHSS mandates page acknowledged that boroughs and cities 'set their own requirements and rules for travelers' (AK-020; AK-050). Outbreak Health Order No. 8 (November 15, 2020), Section A: 'Local communities may enact travel restrictions, but cannot prevent individuals traveling for a Critical Personal Need or the conduct of an Essential Service/Critical Infrastructure installation, maintenance, or repair,' may not prevent residents from returning home, may not prevent critical-infrastructure workers from commencing work, and 'should not prevent the travel of work crews engaged in non-essential construction or repair projects' (AK-036, pp. 2-3). Health Advisory No. 3 (April 26, 2021): 'The State of Alaska DOES NOT restrict or limit travel within the state. Individual communities, acting through their local leaders and government bodies, may wish to withdraw or enact laws related to protection of communities from COVID-19' (AK-087, p. 1). The Governor's HB 76 FAQ (April 30, 2021): 'municipalities have their own local powers that may provide restrictions on businesses as well as a mask mandate. The Governor has no constitutional authority to interfere with local decisions in first-class cities' (AK-089). Anchorage (a unified home-rule municipality) and the City and Borough of Juneau issued and enforced their own emergency orders and ordinances throughout, with penalties (Anchorage: mandatory suspension or closure of the business for up to two weeks; Juneau: civil fine of up to $25).

Mandate 007 closed hair salons, spas, nail salons, barbers, tattoo, piercing, massage and tanning in the Fairbanks North Star and Ketchikan Gateway Boroughs from 8:00 a.m. March 21, 2020 (AK-009); Mandate 009 extended the closure statewide from 5:00 p.m. March 24, 2020 and barred in-home delivery of the services (AK-011); Phase I reopened personal care under Attachment G on April 24, 2020 (AK-085) and Phase II on May 8 (AK-018); caps lifted May 22, 2020. Anchorage: EO-16 salons at 25 percent and no services requiring mask removal (AK-074); EO-17 and EO-18 at 50 percent with the same bar (AK-075, AK-076); EO-19 distancing-based (AK-077). Juneau: masks in personal-care facilities (AK-040); personal services by appointment only and waiting areas at 50 percent under the 2021 risk-level rules (AK-041, AK-095).

Fitness and entertainment

Mandate 003 closed theaters, gyms and fitness centers, bowling alleys and bingo halls statewide from 5:00 p.m. March 18, 2020 (AK-005); Phase II reopened gyms, theaters, bowling alleys, bingo halls and pools under Attachments K, P, R, S and T on May 8, 2020 with capacity limits (AK-018); advisory from May 22, 2020. Anchorage: EO-14 gyms, bingo halls and theaters at 50 percent (July 24, 2020) (AK-072); EO-15 bingo halls and theaters closed Aug. 3-30, 2020 (AK-073); EO-16 indoor entertainment closed, gyms 25 percent (Dec. 2020) (AK-074); EO-17 entertainment 25 percent, gyms 50 percent (AK-075); EO-18 50 percent (AK-076); EO-19 open with distancing, masks while exercising (AK-077). Hotels and short-term rentals

Mandate 010 designated a visitor's or worker's 'hotel room or rented lodging' as the quarantine location for fourteen days and barred quarantining travelers from pools, meeting rooms, fitness centers and restaurants (AK-012, p. 2); Attachment L (May 8 / May 22, 2020) governed lodging and overnight camping (AK-018 series); Outbreak Health Order No. 6 kept test-or-quarantine for every arriving traveler to Feb. 14, 2021 (AK-035); Anchorage EO-14, EO-18 and EO-19 required hotel management to report quarantining guests to health departments and to supply PPE, and EO-20 Attachment G governed lodging (AK-072, AK-076, AK-077, AK-078).

Offices and telework

Mandate 011: individuals 'Work from home as much as possible'; all non-essential businesses 'required to cease all activities at facilities located within the state except Minimum Basic Operations,' which include 'the minimum necessary activities to facilitate employees of the business being able to continue to work remotely from their residences'; 'Employers will evaluate which of their employees can feasibly work remotely from home and to the extent reasonable, take steps to enable employees to work from home' (AK-013, pp. 2-3; AK-021, p. 1); Phase I/II Attachment H reopened non-public-facing businesses under conditions (April 24 / May 8, 2020) (AK-085, AK-018). Governor's July 22, 2020 directive: masks in State facilities where six feet cannot be kept, including 'personal offices' (AK-050). Governor's November 12, 2020 emergency alert 'requiring all executive branch employees to work from home whenever feasible and urging other organizations that can operate remotely to allow their employees to work from home' (recited in Special Order 8210, AK-055). Anchorage: EO-15 'Employers shall require employees to work from home when their work can be accomplished remotely without significantly impeding business operations' (Aug. 3-30, 2020) (AK-073); EO-16 remote work required when possible (AK-074); EO-17 'Employers must require employees to work from home when their work can be accomplished remotely' (AK-075); EO-18 same with 'without significantly impeding business operations' (AK-076); EO-19 'must require... without impeding business operations' (Mar. 8, 2021) (AK-077); EO-20 encouraged (Apr. 16, 2021) (AK-078); EO-13 masks in 'communal areas of offices where people from multiple households are present' and elevators (AK-071). Manufacturing

Non-listed manufacturing closed to Minimum Basic Operations under Mandate 011 and the Essential Services Order from March 28 to April 24, 2020 (AK-013, AK-021); seafood processing plants and vessels operated under Mandate 017 (Apr. 24, 2020), its appendices and Outbreak Health Order No. 5 Appendices 5-01 to 5-04 (Nov. 16, 2020 - Feb. 14, 2021), which required Community/Workforce Protective Plans, acknowledgement forms before any tender or processor may accept fish, and quarantine or testing of arriving workers (AK-019, AK-034, AK-037); every arriving worker was subject to Mandate 010 and Outbreak Health Order No. 6 (AK-012, AK-039, AK-035).

Construction

Mandate 011 and the Essential Services Order closed every business not on the list from March 28, 2020; the March 23 Attachment A listed 'public works construction, construction of housing' among essential infrastructure, so other construction was confined to Minimum Basic Operations until Phase I (April 24, 2020) (AK-012, pp. 3-4; AK-013; AK-021); Mandate 012 and 018 barred travel of crews to off-road communities except for critical infrastructure and required protective plans for every business with staff traveling between communities (AK-014, AK-020); Outbreak Health Order No. 8 told communities they 'should not prevent the travel of work crews engaged in non-essential construction or repair projects' and to negotiate access requirements (Nov. 16, 2020 - Feb. 14, 2021) (AK-036, p. 3).

Real estate

No Alaska instrument specific to showings, closings or recorders was identified; brokerage, title and appraisal offices were non-essential businesses under Mandate 011 (professional services were essential only 'when necessary to assist in compliance with legally-mandated activities') from March 28 to April 24, 2020 (AK-012, p. 4; AK-013); Anchorage's remote-work mandates (EO-15 to EO-19) and mask orders reached offices and showings (AK-073 to AK-077); the Court System's Special Orders 8131 and 8210 suspended non-priority civil proceedings and required remote hearings (AK-051, AK-055).

Hospitals and long-term care

Mandate 001 suspended public visitation at State institutions and limited it at the Alaska Pioneer Homes from March 14, 2020 (AK-003); Mandate 005 elective-procedure postponement (AK-007); Mandate 015 universal masking, screening and elective-surgery conditions to Nov. 15, 2020 (AK-017); Mandate 014 and Outbreak Health Order No. 4 non-congregate quarantine and isolation sheltering for health-care workers and first responders (AK-016, AK-033); Public Health Emergency Order (May 1, 2021) and Addendum No. 1 (Sept. 21, 2021): CMS 1135 flexibilities, alternate care sites, EMTALA off-site screening, early discharge, postponement of procedures, increased patient-to-staff ratios, crisis standards of care for hospitals, psychiatric hospitals, critical access hospitals, long-term care hospitals and skilled nursing facilities (AK-030, AK-031, AK-092).

Dental and elective health care

Mandate 005 (Mar. 19, 2020): 'All patients, providers, hospitals and surgical centers are required to postpone or cancel all non-urgent or elective procedures for three months' (AK-007); Mandate 006 (Mar. 19, 2020): 'elective oral health care procedures are required to be postponed for a period of one month' (AK-008); Mandate 015 (Apr. 15, 2020) allowed routine services from April 20 and non-urgent elective surgeries from May 4, 2020 subject to universal masking, screening of every patient, PPE and a plan to stop procedures if a surge occurs, revised June 1, 2020 (AK-017); Appendix 03 governed dentistry and dental hygiene from April 24, revised June 17 and August 5, 2020 (AK-044); Mandate 015 expired November 15, 2020 (AK-024). Addendum No. 1 (Sept. 21, 2021) directed hospitals to 'postpone or reschedule medical and surgical procedures' and activated crisis standards of care (AK-031).

Schools

Mandate 001 made March 16-30, 2020 non-student-contact days statewide (AK-003); Mandate 008 closed public and private schools to students through May 1, 2020 (AK-010); Mandate 013 extended the closure to the end of the 2019-20 school year (AK-015); Mandate 002 sent residential school students home by March 27, 2020 (AK-004); fall 2020 reopening was left to districts under the DEED 'Alaska Smart Start 2020' framework, and Outbreak Health Order No. 5 required districts to follow DEED guidance and submit protective plans (AK-037, p. 2); no statewide masking or quarantine order for the 2021-22 year; Anchorage School District required masks indoors of all students, staff and visitors from August 9, 2021 (AK-093); Fairbanks North Star Borough School District required universal masking from September 13, 2021 (AK-094); Anchorage EO-16 and EO-17 capped educational institutions at 50 percent of classroom capacity (AK-074, AK-075).

Child care

Attachment A (Mar. 23, 2020) listed child-care facilities as critical 'subject to new recommendations for increased hygiene and social distancing' and 'only by those who need childcare to work at a critical job' (AK-012, p. 4); Mandate 016 Attachment V (May 12, 2020) governed licensed child care in Phase II (AK-018 series); Anchorage EO-09 Attachment F (May 11, 2020), EO-17 Attachment B, EO-18 Attachment B and EO-20 Attachment H imposed operating criteria on child-care facilities and day camps (AK-067, AK-075, AK-076, AK-078); Juneau required masks in child-care facilities from July 20, 2020 (AK-040).

Worship and gatherings

Mandate 009 prohibited gatherings of more than ten statewide from March 24, 2020 (AK-011); Mandate 011 ordered all individuals to 'cease participation in public or private gatherings that include non-household members, regardless of the number of people involved. This includes, but is not limited to, weddings, faith gatherings, graduations, and funeral events' (AK-013, p. 2); Phase I allowed gatherings of up to 20 (April 24) and Phase II Attachment N up to 50 people or 50 percent of maximum occupancy (May 8) (AK-043); the gathering attachment became advisory on May 22, 2020 (AK-099). Travel and quarantine

Mandate 004 (Mar. 17, 2020) stay-home for travelers from CDC Level 3 areas (AK-006); Mandate 010 (Mar. 25, 2020) fourteen-day self-quarantine of every arriving resident, worker and visitor, travel declaration form, critical-infrastructure protective plans due March 24 at 3:00 p.m., $25,000 fine or one year (AK-012); revised June 5 (eff. June 6: negative test within 72 hours or test on arrival as alternatives) (AK-038), August 6 (eff. Aug. 11: non-residents must pre-test; residents test or quarantine) (AK-039), October 15 (eff. Oct. 16: all travelers test or quarantine; strict social distancing five days) (AK-022); Outbreak Health Order No. 6 (Nov. 16, 2020 - Feb. 14, 2021) same regime, non-residents $250 test on arrival, 'strict social distancing' barring entry to restaurants, bars, gyms, office buildings and schools (AK-035); Mandate 012 (Mar. 28, 2020) prohibited all intrastate travel except critical needs (AK-014); Mandate 018 (May 12, 2020) freed road-system and marine-highway travel, kept the off-road prohibition and the protective-plan filing (AK-020); Outbreak Health Order No. 8 (Nov. 16 / Nov. 21, 2020) testing for travel from the road system to off-road communities and limits on community restrictions (AK-036); Health Advisories 2 and 3 (Feb. 14, 2021) converted the requirements to recommendations (AK-083, AK-084) and their April 26, 2021 revisions state that the State 'does NOT REQUIRE COVID-19 testing for travelers' and 'DOES NOT restrict or limit travel within the state' (AK-086, AK-087). Anchorage EO-10 and EO-11 carried the State quarantine into municipal law (AK-068, AK-069).

Face coverings

No statewide mask mandate at any time ('At this time the State of Alaska does not mandate the general use of masks,' DHSS, Oct. 2020, AK-050); State facilities: 'All employees, contractors, and visitors to State of Alaska facilities must wear a facemask if social distancing of at least six feet or more between individuals cannot be maintained' (Governor, July 22, 2020) (AK-050); health-care settings: universal masking under Mandate 015 from April 20, 2020 (AK-017); Anchorage EO-13 (June 26, 2020, eff. June 29, 8:00 a.m.; V2 July 31, 2020; V3 Nov. 2020; V4 Mar. 2021; V5 Apr. 30, 2021, eff. Vaccination mandates

No Alaska health-care-worker, State-employee or vaccination-proof mandate was identified in this research. HB 76 sec. 17 (Apr. 30, 2021): 'An individual may object to the administration of a novel coronavirus disease (COVID-19) vaccine based on religious, medical, or other grounds' (AK-028); the Governor's HB 76 FAQ states that HB 76 does not require vaccination and recites an Administrative Order banning 'vaccine passports' for travel in Alaska (AK-089). The Court System exempted fully vaccinated visitors from masking from June 1 to Aug. 2, 2021 (AK-057) and Juneau's risk-level rules distinguished vaccinated and unvaccinated persons (AK-041). Hospital-system staff vaccination requirements in Alaska in the fall of 2021 were private employer policies, not orders, and are not listed.

Standing duties

The statutes, codes and penalty provisions of Alaska that stood before March 2020 and ran through every claimable quarter. They are the reason nothing an employer did under the orders was voluntary. Read the Alaska duties →

Alaska's compulsion ran on three standing statutory tracks that predate COVID-19 and outlasted every Health Mandate. First, the Alaska Disaster Act gives every gubernatorial disaster order 'the force of law' (AS 26.23.020(b)) and empowers the Governor to 'control... the movement of persons within the area, and the occupancy of premises in it' (AS 26.23.020(g)(7)); the Disease Control statute lets the Department of Health and Social Services, in a declared disease disaster, 'close, direct, and compel the evacuation of, or decontaminate' any facility that 'may endanger the public health' (AS 18.15.390(1)), binds persons to isolation and quarantine on pain of class B and class A misdemeanors (AS 18.15.385(n)-(o)), and authorizes investigation of 'facilities or materials that may pose a threat to the public health' (AS 18.15.375(b)). Every Health Mandate, the Essential Services Order and Mandate 016 recited the consequence of noncompliance in the same words: an order to cease operations, a civil fine of up to $1,000 per violation, and prosecution for reckless endangerment under AS 11.41.250, a class A misdemeanor carrying one year (AS 12.55.135(a)), $25,000 for a person and $500,000, or $2,500,000 where death results, for a business organization (AS 12.55.035(b)(5), (c)(1)). Second, the Alaska Occupational Safety and Health Act commands that 'An employer shall do everything necessary to protect the life, health, and safety of employees' (AS 18.60.075(a)), including furnishing a workplace 'free from recognized hazards' ((a)(4)) and complying with the federal general-industry standards adopted by reference in 8 AAC 61.1010; AKOSH told employers in May 2020 that the Health Mandates 'Must be Followed - "Shall"', that an Exposure Control Plan 'is a requirement of The General Duty Clause', and that the 'employer is required to use the Hierarchy of Controls'; and on July 21, 2021 AKOSH implemented OSHA's COVID-19 Healthcare Emergency Temporary Standard for Alaska health-care employers (Program Directive 21-05). Third, on April 30, 2021 the Legislature conditioned every business's immunity from customer-exposure suits on having operated 'in substantial compliance with the applicable federal, state, and municipal laws and health mandates in effect at the time of the customer's exposure' (HB 76, ch. 2 SLA 2021, secs. 14-15), which made compliance with the health protocols the legal standard of care for the second and third quarters of 2021. The Alaska Food Code independently required food-establishment operators to exclude employees with communicable disease (18 AAC 31.300) and exposed them to immediate closure for an 'imminent health hazard' (18 AAC 31.905(a)(1)); DEC's COVID-19 food-establishment guidance and Mandate 016 Attachment F carried those standing rules into the pandemic protocols. The reopening attachments made continued operation conditional ('can resume operations if they meet all of the following requirements'), used 'must' for screening, sanitation, training and the CDC-guided illness plan, 'should' for six-foot spacing and 'strongly encouraged' for cloth face coverings, and from May 22, 2020 became 'Advisory Document[s]' that still said 'must' for the CDC-guided illness plan and post-positive disinfection; the Outbreak Health Orders of November 16, 2020 carried 'the power of law'. The Superior Court enforced Anchorage EO-15 against a diner by injunction on August 7, 2020 ('A property interest cannot outweigh a person's interest in life'). Each of these instruments is a governmental command or a governmental condition, not an election by the employer.

Whether the additional measures employers took beyond the four corners of the emergency orders were voluntary within Notice 2021-20 Q&A-14, or were the discharge of standing duties imposed by Alaska law.
