Operative words

Restaurants may resume table service dining if they meet all of the following requirements:... i. Social distancing protocol is maintained. ii. Continue to follow all regulatory and legal standards required to operate a food services business in Alaska. iii. All buffets and salad bars are closed to self-service.... Cleaning and disinfecting must be conducted in compliance with CDC protocols

Penalty

As recited in Mandate 016: order to cease operations and/or civil fine of up to $1,000 per violation; AS 11.41.250 with AS 12.55.035 and 12.55.135 (Ex. AK-085); Food Code enforcement under 18 AAC 31.905 (DUT-AK-012)

What it required

Table service was conditional on distancing ('No more than 20 tables. Tables must be 10 feet apart' in the Phase II text), on continuing to follow the Food Code and every other legal standard of a food-service business, on closing self-service, on a visitor log, on entryway signage that symptomatic customers 'must not enter', on a written COVID-19 Mitigation Plan, on 'Employer must provide hand washing capability or sanitizer', on pre-shift screening, exclusion of symptomatic employees and a 72-hour post-fever exclusion, on an illness and return-to-work plan 'following CDC guidance', and on weekly CDC-protocol cleaning or a 72-hour shutdown, with CDC cleaning 'as soon after the confirmation of a positive test as practical'. Recorded exactly: cloth face coverings for employees interacting with the public 'strongly encouraged'; disposableware 'should be used, when available'; sec. III lists further practices restaurants 'are encouraged to follow'.

Retrieval note

Clause II.a.ii incorporates the standing sanitary code (18 AAC 31; DUT-AK-011, DUT-AK-012) as a condition of reopening. The Anchorage orders of Aug. 3-30 and Dec. 1, 2020 to Jan. 1, 2021 closed indoor dining again within the Municipality (Ex. AK-073, AK-074); the Kriner's Diner injunction enforced the first (DUT-AK-009).
