Operative words

(a) The operator of a food establishment shall take all reasonable precautions to ensure that each employee with an infected wound or a disease communicable by food is not working in a food establishment in any capacity that might contaminate food or a food-contact surface. (b) The operator... shall ensure that... each employee reports each of the following conditions to the operator

What it required

A standing operator's duty to keep employees with communicable disease or the listed symptoms (vomiting, diarrhea, jaundice, sore throat with fever, infected lesions) out of food handling, to require employee reporting of those conditions, to exclude or restrict under Table E, and to notify the department within 24 hours of listed diagnoses; with 18 AAC 31.320 (the person in charge 'shall' identify hazards, develop and implement policies 'to prevent foodborne illness' and train employees), it is the sanitary-code footing of the symptom-screening and exclusion protocols of Mandate 016 Attachment F (Ex. AK-042) and of DEC's COVID-19 guidance (DUT-AK-013).
