Mining, oil and gas, and energy services under the orders

In plain terms: if you run an operator, a drilling or well-services company, a mine or quarry, or a pipeline or utility contractor, your business operated under governmental orders in every quarter from April 2020 through September 2021. In March 2020 forty-two States confined the public and closed non-essential businesses; every one of them named oil and gas and energy essential and attached conditions to the designation, and Pennsylvania closed its coal, metal and nonmetal mines and its mining contractors by name. Twenty States quarantined arriving crews. New Mexico capped the hotels and RV parks your crews sleep in for fifteen months. Your own regulators acted: the Railroad Commission of Texas rolled every deadline, North Dakota revived its well waivers, New Mexico's State Land Office wrote a shut-in rule, and FERC opened a waiver regime that was still being extended in September 2021. From February 1, 2021 every crew flight and airport ran under a federal mask order. What did not expire on June 30, 2021: that federal order, the land-border limits, the workplace-safety rules of four States, New Mexico's COVID-Safe Practices mandate, and the indoor face-covering orders Louisiana, New Mexico, Nevada, Oregon, Illinois, Washington and the District re-imposed that summer.

The orders reached eleven functions of a business like yours: the extraction site, the service job, the rig crew, the pipeline spread, crew lodging and travel, permits and regulators, equipment and supply, hiring and credentials, the office, the workforce and the customer base. The quarter those letters most often dispute is the third quarter of 2021, and the record answers it: the instruments in force on July 1 and September 30, 2021 are listed below by name and date.

Partial suspension, element by element

Every analysis on this site asks the same five questions in the same order. Here they are asked of Mining, Oil and Gas, and Energy Services, from the industry's own record.

  4. The quarter: in force on which days.Every instrument carries the quarters it was in force.   5. The statute's answer.A partial suspension is a temporary delay, interruption or termination of a portion of the business's operations; the order need only be the but-for cause of it; and nothing in the Suspension Clause asks whether the business was essential, stayed open, could telework or served customers who were themselves under orders (Tri-State Memorial Hospital v. Function codes

The analysis describes the business as eleven functions, each with a two-letter code that every page of this set uses without variation. An order “reached” a function when its operative words told the business what that part of it could do, when, where, for how many and on what conditions.
