The record in brief

Arkansas never issued a stay-at-home order; it limited commerce, travel and group meetings through the Governor's executive orders under the Emergency Services Act (Ark. Code Ann. 12-75-101 et seq.) and the Secretary of Health's directives under Ark. Code Ann. 20-7-109 to -110, each carrying criminal sanction. Every order from EO 20-10 forward recites that the Governor's orders 'have the force and effect of law' and that violation of a directive of the Secretary of Health 'is a misdemeanor offense... punishable by a fine of not less than one hundred dollars ($100) nor more than five hundred dollars ($500) or by imprisonment not exceeding one (1) month, or both,' and commands that 'all law enforcement officers within this state shall enforce the directives of this order and those of the Secretary of Health.' Run-up (March 11-31, 2020): EO 20-03 (March 11) declared the emergency and barred any local 'quarantine regulations of commerce or travel' except by authority of the Secretary of Health; the Secretary's March 19 directive closed dine-in service, gyms and indoor entertainment venues from March 20, closed schools to April 17 and moved State employees to remote work; the casino directive (March 16-17) closed casinos, extended March 30 to April 30; the March 13 long-term-care directive barred visitation; the barber, cosmetology, body-art, massage and medical-spa directive closed those establishments; dentistry was limited to emergencies; on March 26 the gatherings directive and EO 20-10 prohibited 'gatherings of more than ten (10) people in any confined indoor or outdoor space' from 12:01 a.m. March 27 and declared the whole State a disaster area under 12-75-114(e)(7); the Supreme Court suspended in-person proceedings from March 18 and closed the Justice Building from March 19; Little Rock imposed a curfew (midnight to 5 a.m. from March 17; 9 p.m. to 5 a.m. from March 26). 2020 Q2: EO 20-13 (April 4, effective April 6) consolidated the closures (dine-in, gyms and indoor entertainment, casinos, personal care), the ten-person cap, mandatory distancing protocols on 'all businesses, manufacturers, construction companies, and places of worship,' the limitation of hotels, motels and short-term rentals to thirteen categories of 'authorized guests,' school closure and State-employee telework; the April 3 directive ordered postponable procedures, tests and office visits rescheduled and routine dental and eye care postponed; the April 17 directive cancelled summer camps; EO 20-25 (May 5) extended the emergency to June 19, made the fourteen-day quarantine of travelers from New York, New Jersey, Connecticut, New Orleans and abroad mandatory, and set the reopening calendar (gyms May 4; salons May 6; restaurants May 11 at one-third seating; venues from May 4/18; casinos May 18 at 33 percent; bars May 26; elective procedures April 27 with testing; dentistry May 18); Phase 2 (June 15) raised every sector to 66 percent and lifted the lodging and travel limits; EO 20-33 (June 15) conditioned business immunity on compliance with directives; EO 20-37 (June 18) declared the emergency anew, ordered every business, manufacturer, construction company, long-term-care facility, medical and dental provider, team-sports program and place of worship to 'adhere to applicable directives or guidelines issued by the Secretary of Health' and barred cities and counties from any more restrictive measure; the courts resumed hearings May 18 and jury trials only from July 1. 2020 Q3: EO 20-41 (July 3) authorized city mask ordinances (Fayetteville June 16 and Little Rock June 26 had preceded it); EO 20-43 (July 16) and the Face Coverings Directive (effective July 20) required 'every person in Arkansas' to wear a face covering indoors and outdoors where six feet could not be assured, enforced by misdemeanor; the 66 percent directives, the music and team-sports directives, the Phase IV elective-procedure conditions and the long-term-care directive continued; schools reopened on site August 24 under Ready for Learning; EO 20-45 (August 14) renewed the emergency. 2020 Q4: EO 20-48 (October 13), EO 20-51 (December 11) and EO 20-53 (December 29) renewed the emergency and re-incorporated the mask order; the winter re-tightening consisted of the November 19 directive closing on-premises alcohol sales at 11:00 p.m. from November 20 to January 3, the October 6 and December 23 long-term-care visitation directives and the Supreme Court's suspension of jury trials from November 20, 2020 (extended to January 15, February 28 and April 30, 2021). 2021 Q1: the 11:00 p.m. closing was re-issued January 5; indoor venues over ten attendees required an approved plan from January 5; EO 21-03 (February 26) renewed the emergency to March 31 and converted the business, capacity and gathering directives to guidance while keeping the mask mandate to March 31; Act 403 (March 19) subjected renewals and directives to Legislative Council review; the mask directive was 'Converted to Guidance Effective April 1, 2021'; EO 21-07 (March 31) renewed the emergency to 11:59 p.m. May 30, 2021 without the mask order. 2021 Q2: jury trials resumed May 1 with courts ordered to follow Department mask and distancing guidelines; Act 1002 (April 28) ended all public mask mandates; Act 977 (April 28) barred State and local vaccination mandates; Act 1030 (April 29) barred vaccine passports; the emergency expired May 30; the Justice Building reopened June 1. 2021 Q3: EO 21-14 (July 29) declared a statewide public-health emergency for the 'catastrophic statewide impact of the Delta Variant... on the healthcare system,' which ran to September 27, 2021; the Pulaski County Circuit Court enjoined Act 1002 on August 6 and the Supreme Court refused a stay on September 30 (Hickey v. McClane, CV-21-421), so school districts' mask rules and the DESE-ADH 2021-2022 school guidance (quarantine of unvaccinated, unmasked close contacts) governed the school year; the Department's quarantine requirement on close contacts and Acts 977 and 1030 remained; no capacity, gathering or general mask directive was in force after February 26 and March 31, 2021 respectively.

Instrument EO 21-03 (Feb. 26, 2021) converted the Department of Health's business, capacity, venue and gathering directives to guidance and kept only the face-covering mandate to March 31, 2021; the Face Coverings Directive was 'Converted to Guidance Effective April 1, 2021' (Ex. AR-070); EO 21-07 (Mar. 31, 2021) renewed the emergency without EO 20-43 and fixed its expiry at 11:59 p.m. May 30, 2021 (Ex. AR-015).

What remained in force

After Feb. 26, 2021: the statewide face-covering directive to Mar. 31; the emergency and its incorporated orders (telehealth EO 20-05; notarization EO 20-14; health-care resources EO 20-18 and 20-52; business immunity EO 20-33 conditioned on compliance with directives or guidelines); the Secretary of Health's isolation and quarantine authority and the 14-day quarantine requirement on close contacts (Ex. AR-073); the long-term-care visitation directive (Ex. AR-068); the Supreme Court's jury-trial suspension to Apr. 30, 2021 and the Justice Building closure to June 1, 2021 (Ex. AR-026, AR-028, AR-029); Act 403 (Ex. AR-032). After Apr. 28-29, 2021: Acts 1002, 977 and 1030 (Ex. AR-031, AR-033, AR-034). After May 30, 2021: no State emergency until EO 21-14 (July 29-Sept. 27, 2021; Ex. AR-017); the Act 1002 injunction of Aug. 6, 2021 and school-district mask rules (Ex. AR-081); the DESE-ADH 2021-22 school guidance (Ex. AR-080); the federal layer (CDC conveyance mask order; TSA directives; OSHA Healthcare ETS from June 21, 2021; CMS long-term-care rules).

Preemption of local orders

State-driven and centralized: Arkansas has no county health departments. EO 20-03 par. 2 (Mar. 11, 2020): 'No quarantine regulations of commerce or travel shall be instituted or operated by any place, city, town or county against another place, city, town, or county in this or in any other state except by authority of the Secretary of Health.' EO 20-13 par. 12 and EO 20-25 par. 14 permitted 'reasonable' city and county curfews and closures of city or county parks and facilities. EO 20-37 par. 5 (June 18, 2020), repeated in EO 20-45, 20-48, 20-51 and 20-53: 'Cities and counties shall not impose any restriction of commerce or travel that is more restrictive than a directive or guideline issued by the Secretary of Health, in consultation with the Governor.' EO 20-41 (July 3, 2020) authorized cities to adopt a model face-covering ordinance after Fayetteville (June 16) and Little Rock (June 26) had acted; EO 20-43 par. 4-6 (July 16, 2020) permitted local ordinances 'consistent with this order,' provided that 'Cities shall not impose any measure that is in conflict with a directive or guideline issued by the Secretary of Health,' and superseded EO 20-41 while preserving the ordinances adopted under it. Act 1002 (Apr. 28, 2021) barred every State agency, political subdivision and State or local official from mandating face coverings; the Pulaski County Circuit Court preliminarily enjoined it Aug. 6, 2021 (Nos. 60CV-21-4692 and 60CV-21-4763), the Supreme Court denied a stay Sept. 30, 2021 (Ex. AR-081), and the circuit court held the Act unconstitutional Dec. 29, 2021. Acts 977 and 1030 (Apr. 28-29, 2021) barred State and local vaccination mandates and vaccine passports. Act 403 (Mar. 19, 2021) subjected the Governor's renewals and the Department's directives to Legislative Council review.

Code Ann. 20-7-101 et seq.: the State Board of Health has direction and control of all sanitary and quarantine measures (20-7-110), rulemaking power over quarantine, isolation and sanitary conditions (20-7-109), and every violation of its orders or rules is a misdemeanor, each day a separate offense, with a civil penalty of up to $1,000 per violation for rule and permit violations (20-7-101); the Board's Rules Pertaining to Reportable Diseases (eff. Jan. 1, 2019) direct the Director to impose quarantine restrictions upon commerce, travel and all individuals and forbid any person to interfere with a health authority; 20-7-113 makes violation of a gubernatorial nuisance-abatement order a misdemeanor. Every executive order from EO 20-13 forward recited 20-7-101 and ordered all law enforcement officers to enforce the Secretary of Health's directives; Act 401 of 2021 confirms by its own findings that businesses were penalized under this scheme and carves out only patron behavior. (2) The Emergency Services Act, 12-75-114: executive orders have the force and effect of law; the Governor may control the occupancy of premises (e)(7) and suspend regulatory statutes (e)(1); the Act has no general offense section, so the criminal route ran through 20-7-101. (3) The labor statute of 1937, 11-2-117: every employer shall furnish safe employment and do every other thing reasonably necessary to protect employees' life, health, safety and welfare; 'safe' includes conditions and methods of sanitation and hygiene for the protection of employees or the public (11-2-102); misdemeanor for each day of violation (11-2-104); Arkansas is a federal-OSHA State, so 29 U.S.C. 654(a)(1) binds every private employer. The liability shields (EO 20-33, June 15, 2020; Act 559 of 2021, Apr. 5, 2021) presume the absence of willful misconduct only for a business substantially complying with the directives or guidelines of the Governor, the Secretary of Health, the CDC and CMS. The Retail Food Establishment rules (eff. Sept. 7, 2019) make compliance with the regulatory authority's directives 'in response to community emergencies' a condition of retaining the permit, and the Department closed a Little Rock bar on July 4, 2020 under them. EO 20-35 (June 15, 2020) made COVID-19 a compensable occupational disease. The orders in the library used 'shall' and 'must' for the protocols that conditioned continued operation (EO 20-13 par. 3; the Business Limitations Directives; EO 20-37 par. 3 'shall adhere to applicable directives or guidelines'; the Face Coverings Directive) and 'should' or 'encouraged' for the items left to judgment; EO 21-03 converted the directives to guidelines on Feb. 26, 2021 with 'are encouraged to adhere', and the Supreme Court ordered all State courts to 'continue to follow' the ADH guidelines on Apr. 8, 2021.
