Professional and Information Services

The professional, technical and information services industry is the office economy: about 10.8 million employees in NAICS 54 and roughly 3 million in NAICS 51 (BLS, Industries at a Glance, read Sept. 26, 2026; Ex. SEC-12-069), organized in law firms…

In plain terms: if you run a law firm, an accounting practice, an engineering or architecture firm, a consultancy, a software or IT services company, an agency, a publisher or a studio, your business operated under governmental orders in every quarter from April 2020 through September 2021. The States closed your office or ordered it to telework; the courts suspended trials; the bar, CPA and engineering examinations were cancelled; the consulates stopped issuing visas; and the federal agencies that buy your services went to maximum telework. When the office caps expired in 2021, the federal workplace and contractor orders, the State workplace standards, the court orders and, from July 17, 2021, the indoor face-covering orders of the largest States and metros did not. This page lists those orders by layer and by quarter, with dates, instrument numbers and exhibit links, and answers each of the fourteen sentences the letters of the Internal Revenue Service (the "Service") use.

Professional and information services under the orders

Employers in professional, technical and information services operated under orders from appropriate governmental authorities limiting commerce, travel and group meetings in every quarter from the second quarter of 2020 through the third quarter of 2021. In March 2020 the States closed offices or ordered them to telework; the courts suspended trials; the bar, CPA and engineering examinations were cancelled; the consulates stopped issuing visas; and the federal agencies that buy the industry's services went to maximum telework. Offices reopened in the summer of 2020 at a fraction of their occupancy, and in the winter of 2020-21 seventeen jurisdictions cut them back again. The caps and telework mandates expired in steps between April 4 and June 30, 2021. The federal workplace and contractor orders, the workplace-safety standards of California, Virginia, Oregon and Washington, New York's exposure-prevention plans, the court orders of the United States and of at least twenty-nine States and the entry proclamations remained in force, and from July 17, 2021 the indoor face-covering orders of the largest States and metros were added to them. The orders reached ten functions of an employer in this industry: the office, customer meetings and site visits, the courts and recorders, conferences, customer-dependent projects, data centers and field work, business development and federal contracting, hiring and licensing, the workforce and the customer base. The quarter those letters most often dispute is the third quarter of 2021, and the record answers it: the instruments in force on July 1 and September 30, 2021 are listed below by name and date.

Partial suspension, element by element

Every analysis on this site asks the same five questions in the same order. Here they are asked of Professional and Information Services, from the industry's own record.

  3. The change it compelled: the operative words.The operative words of In re Tolling of Time Requirements Imposed by Rules Promulgated by the Supreme Court and Use of Technology, 2020-Ohio-1166 (Ex. SEC-12-039): “(A) This order shall apply retroactively to the date of the emergency declared by Executive Order 2020-01D and shall expire on the date the period of emergency ends or July 30, 2020, whichever is sooner.... (C) Any requirement in a rule of the Court that a party appear in person or requiring…” Each record page quotes the operative words in full, with the enforcement provision beside them.
  4. The quarter: in force on which days.Every instrument carries the quarters it was in force.   5. The statute's answer.A partial suspension is a temporary delay, interruption or termination of a portion of the business's operations; the order need only be the but-for cause of it; and nothing in the Suspension Clause asks whether the business was essential, stayed open, could telework or served customers who were themselves under orders (Tri-State Memorial Hospital v.
