Weddings, events and production services under the orders

In plain terms: if you plan weddings or corporate events, run a banquet hall or venue, arrange flowers, photograph or film events, play or book the music, build stages and lighting, rent tents and tables, or produce film, television and commercials, your business operated under governmental orders in every quarter from April 2020 through September 2021. In March 2020 every State prohibited or capped the gatherings you sell, forty-seven closed banquet halls, concert halls and theaters by name, and the largest production counties closed filming. The rooms reopened in the summer of 2020 at ten to fifty guests or a quarter of their capacity; the winter of 2020-21 prohibited receptions and catered events by name in the largest markets; the spring of 2021 permitted 100 to 150 guests with testing, notice and sign-in; and the caps ended State by State between April and June 2021 (Hawaii's in December). What did not end: the federal conveyance, entry and border orders; Los Angeles County's production protocol; and, from July 17, 2021, the face-covering, proof-of-vaccination, gathering-cap and large-event orders of New York City, San Francisco, New Orleans, Honolulu, Hawaii, Nevada, Los Angeles County, Washington, seven States and the District.

The orders reached twelve functions of a business like yours: planning, venues, florists, photography, entertainers, staging and rental, production, marketing and shows, hiring and permits, offices, the workforce and the customer base. This page sets out those orders by layer and by quarter, with dates, instrument numbers and exhibit links, and answers each of the fourteen sentences the letters of the Internal Revenue Service (the "Service") use. The quarter those letters most often dispute is the third quarter of 2021, and the record answers it: the instruments in force on July 1 and September 30, 2021 are listed below by name and date.

Partial suspension, element by element

Every analysis on this site asks the same five questions in the same order. Here they are asked of Weddings, Events and Production Services, from the industry's own record.

  3. The change it compelled: the operative words.The operative words of FilmLA release, 'COVID-19 Shutdown Sends Production Levels Lower' (Apr. 23, 2020) (Ex. SEC-25-005): “The 1,091 local productions filming in February 2020 dwindled to 644 projects in March before filming ended completely on March 20. On that date, the County of Los Angeles Department of Public Health and other state and local authorities issued complementary 'Safer at Home' Orders, which closed the…” Each record page quotes the operative words in full, with the enforcement provision beside them.
  4. The quarter: in force on which days.Every instrument carries the quarters it was in force.   5. The statute's answer.A partial suspension is a temporary delay, interruption or termination of a portion of the business's operations; the order need only be the but-for cause of it; and nothing in the Suspension Clause asks whether the business was essential, stayed open, could telework or served customers who were themselves under orders (Tri-State Memorial Hospital v. The analysis describes the business as twelve functions, each with a two-letter code that every page of this set uses without variation. An order “reached” a function when its operative words told the business what that part of it could do, when, where, for how many and on what conditions.
