The record in brief
Minnesota ran a single continuous statewide regime from March 13, 2020 to July 1, 2021 under the Governor's peacetime emergency (Emergency Executive Order 20-01, Minn. Stat. ch. 12), extended every thirty days by fifteen further orders (EO 20-35 through EO 21-24) and terminated by the Legislature at 11:59 p.m. on July 1, 2021 (Laws 2021, 1st Spec. Sess., ch. 12, art. 2, sec. 23). Every emergency order recites Minn. Stat. sec. 12.32 (orders approved by the Executive Council and filed with the Secretary of State 'have the force and effect of law during the peacetime emergency' and suspend inconsistent local rules) and sec. 12.45 (willful violation is a misdemeanor, fine to $1,000 or 90 days). 2020 Q2 (the March 13-31 run-up included): EO 20-04 (Mar. 16) closed restaurants, bars, theaters, gyms, amusement venues and country clubs 'to ingress, egress, use, and occupancy by members of the public' from 5:00 p.m. March 17; EO 20-08 (Mar. 18) added every salon, barbershop, spa and tattoo establishment; EO 20-09 (Mar. 19) postponed 'indefinitely' all elective surgeries and procedures 'including non-emergent or elective dental care' from March 23; EO 20-02 (Mar. 15) closed schools March 18-27 and EO 20-19 (Mar. 25) imposed distance learning from March 30, extended to the end of the school year by EO 20-41; EO 20-14 (Mar. 23) suspended evictions; EO 20-16 (Mar. 23) ordered every business holding PPE to inventory it and refrain from using it. EO 20-20 (Mar. 25) ordered 'all persons currently living within the State of Minnesota... to stay at home' from 11:59 p.m. March 27 and directed that 'All workers who can work from home must do so'; EO 20-33 (Apr. 8) and EO 20-48 (Apr. 30) carried the stay-home order to 11:59 p.m. May 17, 2020, with the outdoor-recreation carve-out of EO 20-38 (Apr. 18) and the manufacturing and office return of EO 20-40 (Apr. 27, with a mandatory written COVID-19 Preparedness Plan). EO 20-51 (eff. May 11) let procedures resume only under a written prioritization and PPE plan enforceable by MDH and the licensing boards. EO 20-56 (eff. May 18, 'Stay Safe MN') prohibited all gatherings of more than 10 (naming conventions, fairs, fundraisers, festivals and faith-based events), capped retail and malls at 50 percent, required a certified Preparedness Plan for every non-critical business, kept the telework mandate ('Any worker who can work from home must do so') and extended the public-accommodation closures to May 31. EO 20-62 (May 26) opened worship at 25 percent, 250 maximum; EO 20-63 (eff. June 1) opened outdoor dining (50 patrons) and salons at 25 percent while indoor dining stayed closed; EO 20-74 (eff. June 10) opened indoor dining, salons and worship at 50 percent with a 250-person ceiling, capped social gatherings at 10 indoors and 25 outdoors, and sent gyms, pools, theaters and venues to capacity limits set by incorporated Stay Safe MN guidance. 2020 Q3: EO 20-74 governed the whole quarter; EO 20-81 (eff. July 25) mandated face coverings in every indoor business and public indoor space and on transit, with a $1,000 misdemeanor and $25,000 civil penalty against businesses; EO 20-82 (July 30) fixed the 2020-21 school year under the Safe Learning Plan (in-person, hybrid or distance by county case rates); EO 20-85 (Aug. 26) required higher-education plans; EO 20-79 (eff. Aug. 4) restated the eviction suspension; the Supreme Court's July 7 order required face coverings in every court facility from July 13. 2020 Q4: EO 20-96 (eff. Nov. 13) imposed a 10:00 p.m. closing on bars and restaurants, cut their indoor ceiling to 150, capped receptions at 50 then 25, and limited social gatherings to 10 people from 3 households; EO 20-99 (eff. Nov. 20, 11:59 p.m.) closed bars and restaurants to all on-premises service, closed gyms, pools, theaters, event venues and fairs, prohibited every social gathering and every reception, and kept 'Any worker who can work from home must do so'; EO 20-103 (eff. Dec. 18) allowed only outdoor dining (50 percent, 100 maximum, 4 per table, closed 10 p.m.) and gatherings of 2 households/10 indoors; EO 20-104 reopened gyms at 25 percent, 100 maximum, from January 3; the Supreme Court's November 20 order stopped new jury trials from November 30, 2020. 2021 Q1: EO 21-01 (eff. Jan. 10, 11:59 p.m.) reopened indoor dining at 50 percent, 150 maximum, closing at 10 p.m., gyms and indoor venues at 25 percent, 150 maximum; EO 21-07 (eff. Feb. 13) raised ceilings to 250 and closing to 11 p.m.; EO 21-11 (eff. Mar. 15) set restaurants at 75 percent, gyms and venues at 50 percent, gatherings at 15 indoors and 50 outdoors, and ordered 'Until April 14, 2021 at 11:59 pm, employees who can work from home, must work from home'; jury trials stayed paused to March 15. 2021 Q2: EO 21-11 governed to May 27; EO 21-21 (May 6) lifted the outdoor caps May 7, rescinded every capacity and gathering limit at 11:59 p.m. May 27 while requiring every Minnesota business to keep a certified Preparedness Plan, and rescinded the face-covering order and the remaining operating orders at 11:59 p.m. June 30; EO 21-23 (May 14) lifted the general mask mandate immediately but kept school and child-care masking through the school year; the eviction executive orders were voided by statute effective June 30. 2021 Q3: the peacetime emergency terminated at 11:59 p.m. July 1, 2021 by legislative act; what remained in force by force of law were the eviction-moratorium phaseout statute (Laws 2021, 1st Spec. Sess., ch. 8, art. 5, in effect to October 12, 2021, with the pending-rental-assistance bar to June 1, 2022), the Supreme Court's June 28 and July 30, 2021 operations orders (remote-default proceedings, court face coverings at the chief judges' direction, extended indefinitely), MMB HR/LR Policy 1446 (issued Aug. 11, effective Sept. 8, 2021: proof of vaccination or weekly testing for all executive-branch and Minnesota State workers reporting to a workplace), the human-services waiver extensions of Laws 2021, 1st Spec. Sess., ch. 7, and the federal layer. Minnesota never preempted local orders; EO 20-81 para. 18 and EO 21-23 para. 9 expressly preserved local power to impose stricter rules and barred localities from relaxing State rules. Through June 30, 2021: the mandatory certified COVID-19 Preparedness Plan for 'All businesses in Minnesota' (EO 21-11 para. 13 as added by EO 21-21), school and child-care face coverings through the 2020-21 school year (EO 21-23 para. 4), EO 20-54 worker protections, EO 20-55 at-risk provisions, the EO 20-51 facility plan requirement (to May 27). From July 1, 2021: Laws 2021, 1st Spec. Preemption of local orders
None. Minnesota preserved local authority throughout. EO 20-38 para. 5 and every successor recreation paragraph: 'Nothing in this paragraph should be construed to abrogate existing local authority to limit or restrict activities or close facilities.' EO 20-81 para. 18 ('Enhanced local measures permitted'): 'Nothing in this Executive Order or previous Executive Orders should be construed to prohibit or prevent political subdivisions from implementing, within their jurisdictions and pursuant to applicable law and authority, requirements beyond those contained in this Executive Order... Pursuant to Minnesota Statutes 2019, section 12.32, political subdivisions may not relax or reduce this Executive Order's requirements.' EO 21-23 para. 9 repeated the rule on May 14, 2021 ('cities and other political subdivisions may take actions that are more protective of the public health but may not take actions that are less protective'). After the emergency ended July 1, 2021, cities and counties acted under their own ordinance and emergency powers. The Supreme Court's July 30, 2021 order directed district courts to follow county face-covering mandates in county-owned courthouses.

MMB HR/LR Policy 1446, issued Aug. 11, 2021, effective Sept. 8, 2021: executive-branch employees, contractors, vendors, volunteers and interns, and Minnesota State Colleges and Universities staff, who work at a workplace 'must provide proof of their COVID-19 vaccination status' and if not fully vaccinated 'must undergo mandatory COVID-19 testing at least weekly' (MN-044, MN-045); no State health-care-worker or private-employer mandate in period.
Standing duties
The statutes, codes and penalty provisions of Minnesota that stood before March 2020 and ran through every claimable quarter. They are the reason nothing an employer did under the orders was voluntary. Read the Minnesota duties →
Minnesota's compulsion ran on four tracks, three of them standing law that predates COVID-19 and outlasted every emergency executive order. First, the Emergency Management Act, Minn. Stat. ch. 12, gives every gubernatorial emergency order, once approved by the Executive Council and filed with the Secretary of State, 'the full force and effect of law' (§ 12.32) and makes willful violation a misdemeanor punishable by a fine of up to $1,000 or ninety days (§ 12.45) (DUT-MN-006); the Supreme Court of Minnesota held on May 10, 2024 that the Act 'authorizes the declaration of a peacetime emergency in response to a pandemic' and that the Governor needed no evidentiary showing before declaring one for COVID-19 (Snell v. Walz, No. A21-0626, DUT-MN-018). The orders carried their own penalties on their face: § 12.45 in EO 20-20 ¶ 9 (Ex. MN-010); a gross misdemeanor ($3,000, one year) for any business owner, manager or supervisor who requires or encourages a worker to violate the order, plus civil penalties of up to $25,000 per occurrence under § 8.31, in EO 20-99 (Ex. MN-032); and the Attorney General enforced them by temporary restraining orders and injunctions, obtaining a Dakota County temporary injunction on December 31, 2020 that found a restaurant's defiance 'both against the law and harmful' (State v. Alibi Drinkery, DUT-MN-017), while the Department of Health used cease-and-desist orders, administrative penalties of up to $10,000 and license suspension and the Department of Public Safety used misdemeanor citations and sixty-day liquor-license suspensions (DUT-MN-016). Second, the communicable-disease statutes: the Commissioner of Health may control by rule 'the disinfection and quarantine of persons and places' (§ 144.12 subd. 1(7), DUT-MN-001); isolation and quarantine of infected and exposed persons 'may include... confinement to private homes or other private or public premises' (§ 144.419 subd. 2(b), DUT-MN-002), enforceable by any peace officer (§ 144.4195 subd. 1(d), read); every employer 'shall not discharge, discipline, threaten, or penalize' an employee who complied with isolation or quarantine, including on a mere 'written recommendation of the commissioner' (§ 144.4196, DUT-MN-003); community health boards must 'obey instructions on the control of communicable diseases as the commissioner may direct' and 'shall order the owner or occupant of the property to remove or abate' any 'cause of sickness' found on any property (§ 145A.04 subds. 6 and 8, DUT-MN-005); and the Health Enforcement Consolidation Act supplies correction orders, administrative penalty orders of up to $10,000, injunctions, 72-hour cease-and-desist orders and license denial (§ 144.99, DUT-MN-004). Third, the workplace-safety duty: the Minnesota Occupational Safety and Health Act commands that 'Each employer shall furnish to each of its employees conditions of employment and a place of employment free from recognized hazards that are causing or are likely to cause death or serious injury or harm to its employees' and 'shall comply with occupational safety and health standards' (§ 182.653 subds. 2-3), requires a written hazard-control program (AWAIR, subd. 8), protects the employee who refuses imminently dangerous work (§ 182.654 subd. 11) and fines willful violations up to $70,000 (§ 182.666) (DUT-MN-007); Minnesota adopts the federal standards by reference (Minn. R. 5205.0010, DUT-MN-009), and the current text of that rule adopts 86 Fed. Reg. 32376 (June 21, 2021), 'Occupational Exposure to COVID-19; Emergency Temporary Standard,' so the OSHA Healthcare ETS was Minnesota law by incorporation; the Employee Right-to-Know standard requires employers to 'exercise reasonable diligence in evaluating their workplace for the presence of other recognized infectious agents' and to train exposed employees (Minn. R. 5206.0600, DUT-MN-010). MNOSHA told essential employers in April 2020 that they 'have a fundamental obligation to protect their employees from known hazards' and 'must follow requirements set forth under the Occupational Safety and Health Act,' 'must ensure they are assessing the potential exposures,' 'must perform an assessment' for PPE and 'must train their employees about the health hazards relative to COVID-19 exposure' (DUT-MN-014). Fourth, the orders made the right to operate conditional on a written COVID-19 Preparedness Plan implementing 'Minnesota OSHA Standards and MDH and CDC Guidelines' (EO 20-40 ¶ 6, Ex. MN-015; EO 20-56 ¶ 7.e, Ex. MN-022; EO 20-74 ¶¶ 7.c.i, 7.d.i, 7.e, Ex. MN-025, extending the requirement to every Critical Business from June 29, 2020; EO 20-99 ¶ 7.d, Ex. MN-032; EO 21-11 ¶¶ 7.b-c, Ex. MN-037; EO 21-21 ¶ 13, Ex. MN-038, in force to 11:59 p.m. June 30, 2021), on face coverings that 'Businesses must require' (EO 20-81 ¶ 15.a, Ex. MN-027) and on the Industry Guidance the orders incorporated by reference; the State's own Plan guidance instructed that 'Unless clearly indicated that an action included in the guidance is recommended, businesses should understand that the action is required' (DUT-MN-013), and the universal guidance of May 28, 2021 confirmed that 'The EO requires all businesses to have and implement a written COVID-19 Preparedness Plan' through June 30, 2021 while marking its own post-mandate content as 'Recommendations' (DUT-MN-015). Minnesota enacted no COVID-19 liability shield in 2020 or 2021 (DUT-MN-021, from the Legislative Reference Library's catalogue of the COVID-19 session laws), so no business ever received immunity for compliance; instead the Legislature made COVID-19 a presumptively compensable occupational disease for front-line workers (Laws 2020, ch. 72, Ex. AGY-ST-UTILITIES-HOUSING-AG-067), and the ordinary rule that a business answers in tort for the injury its unlawful operation causes remained the standard of care. The Food Code independently required the person in charge to exclude ill food employees (Minn. R. 4626.0045, DUT-MN-011) and every licensee to 'immediately discontinue operations' on an imminent health hazard including any 'other circumstance that may endanger public health' (Minn. R. 4626.1795, DUT-MN-012), under a licensing statute whose inspection orders 'Each person shall comply with' (§ 157.20 subd. 3, DUT-MN-008). Every one of these instruments is a governmental command or a governmental condition on operating; none is an election by the employer.
