Operative words
This guidance applies to all business and places of public accommodation... from Friday, May 28, 2021 through the earlier of June 30, 2021 or until 70% of Minnesotans aged 16+ receive at least one dose of a COVID-19 vaccine. The EO requires all businesses to have and implement a written COVID-19 Preparedness Plan that addresses EO requirements and applicable Stay Safe Industry Guidance.
Penalty
Through EO 21-11 ¶ 13 (Ex. MN-038) to June 30, 2021: § 12.45; AG § 8.31 relief; DLI citations and closure orders (EO 21-11 ¶ 7.b, Ex. MN-037). None after July 1, 2021.
What it required
From May 28 through June 30, 2021 every business still had to have, sign, post, distribute and train on a written Plan ('The representative responsible for implementing the Plan must sign and certify the Plan'; 'Each business must provide its Plan, in writing, to all workers'; 'operators must evaluate the operational capacity of ventilation systems'), while the document labelled its distancing, masking, testing and vaccination content 'Recommendations' and stated that 'There is no longer a statewide requirement to wear face coverings in most settings'.
Retrieval noteRecorded exactly: the Plan itself remained mandatory ('The EO requires'; 'must sign'; 'must provide'; 'must ensure that training is provided'; 'must evaluate... ventilation'); the content headed 'Recommendations to prevent the spread of COVID-19' and 'MDH strongly recommends' is recommendation. 'Employers must provide reasonable accommodations as required under existing federal and [state] law' restates standing law. After 11:59 p.m. June 30, 2021 the document continued as recommendation only; the standing duties of ch. 182 and §§ 144.419-144.4196 continued as law.
