The record in brief

Indiana governed the six claimable quarters through one continuous public health disaster emergency (Executive Order 20-02, March 6, 2020, renewed every thirty days without interruption through Executive Order 22-01 and rescinded by Executive Order 22-09 at 7:00 p.m. The run-up to the second quarter of 2020 was the March 16 closure of restaurants, bars and nightclubs to in-person patrons and the immediate cancellation of elective surgeries (EO 20-04), the March 19 closure of every K-12 school and the utility-disconnection and eviction moratoria (EO 20-05, 20-06), the March 23 stay-at-home directive under which all individuals were ordered to stay home, all non-essential businesses were required to cease all activities except Minimum Basic Operations, gatherings of more than ten were prohibited, all places of public amusement were closed and every business was ordered to allow as many employees as possible to work from home (EO 20-08, effective 11:59 p.m. March 24), the same-day closure of State buildings to the public with a telework mandate for State personnel (EO 20-09), and the March 30 order cancelling elective and non-urgent procedures for all providers whether medical, dental or other from April 1 (EO 20-13). 2020 Q2 opened under all of those instruments. EO 20-18 (April 6) replaced and tightened the stay-at-home order (non-necessity retail limited to curbside or delivery from 11:59 p.m. April 7; campgrounds closed; an Enforcement Response Team led by the Chairman of the Alcohol and Tobacco Commission; the Class B misdemeanor penalty recited), and EO 20-22 extended it to 11:59 p.m. May 1. Reopening came in numbered stages with capacity steps fixed in the orders: Stage 2 (EO 20-26; May 4, with Lake and Marion Counties from May 11 and Cass County from May 18): retail 50 percent, malls 25 percent, restaurants 50 percent of seating one week after entry with bar areas closed and bars and taverns closed, personal services by appointment only, gatherings of 25 or fewer, gyms and all places of public amusement closed, every employer required to adopt and post a written safeguards plan by May 11; Stage 3 (EO 20-28; May 22, Cass, Lake and Marion from June 1): retail 75 percent, malls 50 percent, gyms 50 percent, gatherings of 100 or fewer, cinemas, theaters, bowling alleys and bars still closed; Stage 4 (EO 20-32; June 12): retail 100 percent, dining 75 percent, bar seating and bars 50 percent, entertainment venues 50 percent, gatherings of 250 or fewer, casinos from June 15 under Gaming Commission approval, fairs, festivals and parades still prohibited, State buildings by appointment only. 2020 Q3 ran under Stage 4.5 (EO 20-35, July 4, extended by EO 20-36, 20-39 and 20-42 through September 25; events over 250 required a local-health-department-approved plan from July 23; Elkhart County held in Stage 4 through July 31), the statewide face-covering mandate (EO 20-37, effective 12:01 a.m. July 27, 2020, for persons eight and older in indoor public places, outdoors where six feet could not be kept and on public transportation, with a grades 3-12 school mandate), and, from September 26, Stage 5 (EO 20-43), which lifted percentage caps but kept the mask mandate, required every patron of a restaurant or bar to remain seated with parties six feet apart, required a plan filed fourteen days ahead for any event over 500, and required every business to maintain a written COVID response plan. 2020 Q4 opened in Stage 5 (extended by EO 20-46 to November 14) and closed under the winter re-tightening: EO 20-48 (effective November 15) rescinded Stage 5 and imposed county color-coded caps on social gatherings and events (Blue 250, Yellow 100, Orange 50, Red 25, with local-health-department safety-plan approval required above the cap from November 22), business signage and employee mask duties, 25 percent attendance caps on winter school events in Orange counties and participants-and-family-only in Red counties, and EO 20-50 (effective December 13) added a directive that licensed hospitals postpone non-emergent inpatient procedures from December 16, 2020 through January 3, 2021; the Indiana Supreme Court suspended all in-person jury trials from December 14, 2020 to March 1, 2021. 2021 Q1 ran entirely under the county-based regime (EO 20-53, 21-01, 21-02, 21-06), with the mask mandate, the seated-service rule and the K-12 mask and quarantine rules in force on every day of the quarter; EO 21-02 (February 1) converted the numerical caps to strong recommendations paired with percentage-of-capacity limits (25 percent in Red and Orange counties, 50 percent in Yellow) and safety-plan approval above them. 2021 Q2 opened under EO 21-06 as extended by EO 21-09 through April 5; on April 6, 2021, EO 21-09 ended the public face-covering mandate (retained for State buildings, testing and vaccination sites and K-12 schools), the statewide gathering caps (local health departments expressly authorized to impose their own) and the seated-service rule, while keeping the business COVID-response-plan and IOSHA directives through May 31 (EO 21-12) and the K-12 mask mandate and quarantine rules through June 30 (EO 21-15). 2021 Q3 opened with EO 21-16 (sixteenth renewal) and EO 21-17 (June 30, 2021), which rescinded every prior directive as of 11:59 p.m. June 30 and carried forward the health-care licensing, PREP Act vaccinator, Medicaid, unemployment and local-authority provisions; EO 21-19 (August 1) incorporated the Indiana Department of Health's COVID-19 Control Measures under 410 IAC 1 (isolation of positives, quarantine of unvaccinated close contacts with exclusion from employment and public places, mandatory case reporting by schools, child care, long-term care and other congregate settings under Commissioner Order CO 21-01); EO 21-24 (effective September 2) directed hospitals to reprioritize or postpone non-emergent surgeries where necessary, imposed daily capacity reporting, required K-12 schools and child-care facilities to contact-trace and report, and required fully vaccinated close contacts to mask in public pending a negative test; Monroe County reinstated an indoor mask regulation for August 5 through September 30, 2021 under the legislative-approval structure of Senate Enrolled Act 5 (Ind. Code § 16-20-1-21.5), and Indiana University conditioned fall-2021 attendance on vaccination with masking and twice-weekly testing for the exempt (Klaassen v. Trustees of Indiana University, 7th Cir. Aug. 2, 2021). The emergency itself, the health-care directives and the control measures remained in force on September 30, 2021 and were renewed that day (EO 21-26, 21-27).

Instrument Executive Order 21-09 (Mar. 31, 2021; effective 12:01 a.m. Apr. 6, 2021) ended the public face-covering mandate, the statewide gathering and event caps and the seated-service rule for restaurants and bars; Executive Order 21-15 (May 28, 2021) rescinded EO 21-12 and with it the business COVID-response-plan and IOSHA directives as of 11:59 p.m. May 31, 2021; Executive Order 21-17 (June 30, 2021) rescinded all directives in EOs 20-03 through 20-53 and 21-01 through 21-15 as of 11:59 p.m. June 30, 2021 (Ex. What remained in force

The public health disaster emergency (renewed monthly by EO 21-16, 21-18, 21-22, 21-26 and successors to Mar. 3, 2022); the EO 21-17 series (temporary health-care licensing through Sept. 30 then Dec. 31, 2021; PREP Act vaccinator authorizations; FSSA Medicaid, HIP, CHIP and TANF waivers; DWD provisions; the reservation of State and local authority to order quarantine, isolation or closure of a specific location; the rule that local orders may be more restrictive if they comply with Ind. Preemption of local orders

Indiana did not preempt local COVID-19 orders during 2020 and expressly authorized stricter local rules. Every stay-at-home and reopening order from EO 20-18 forward carried the same clause: "Pursuant to the Emergency Disaster Law, no local ordinance, directive, or order of any county, political subdivision, or other local government entity pertaining to this public health emergency, may contradict or impose less restrictive requirements than those set forth in this Executive Order, or else that ordinance, directive, or order will be void and of no force or effect. However, unless prohibited by an Executive Order, local ordinances, directives, and orders may be more restrictive" (EO 20-18 ¶ 22(a); EO 20-26 ¶ 36(a); EO 20-28 ¶ 23(a); EO 20-32 ¶ 24; EO 20-43 ¶ 10; EO 20-48 ¶ 12; EO 21-09 ¶ 12). The one restriction on local power, "No local unit of government and/or political subdivision may restrict travel within their jurisdiction above a Travel Watch status" (EO 20-18 ¶ 22(b); EO 20-26 ¶ 36(b); EO 20-28 ¶ 23(b)), was terminated by EO 20-29 effective 11:00 a.m. May 31, 2020. Marion County (Indianapolis), Monroe County, Elkhart, Lake, Cass and other counties imposed stricter or later-lifted rules under that authority (Marion County instruments are in the MET-IND file). From May 10, 2021, Senate Enrolled Act 5 (2021), enacted over the Governor's veto (Senate 36-10, House 59-30) and codified at Ind. Code § 16-20-1-21.5 (local health departments) and § 16-22-8-31.3 (the Marion County Health and Hospital Corporation), conditioned any local health order more stringent than, or not addressed by, the Governor's executive order on approval by the county legislative body or, for a city health department, by ordinance approved by the mayor, and created an appeal to the local legislative body from local enforcement actions. EO 21-15, 21-17, 21-19, 21-23, 21-24 and 21-27 incorporate that condition verbatim: local orders "may be more restrictive provided there is compliance with Ind. Code § 16-20-1-21.5 and § 16-22-8-31.3." The Monroe County regulation of Aug. 4, 2021 recites approval by the Board of Commissioners under that regime. No Indiana instrument barred local mask or capacity orders outright at any time through Sept. 30, 2021.

Restaurants and bars

EO 20-08 ¶ 9 (Mar. 24, 2020): "Fitness and exercise gyms, spas, salons, barber shops, tattoo parlors, and similar facilities are not included in Healthcare and Public Health Operations" (closed as non-essential); EO 20-18 ¶ 9: the same facilities "shall close"; Stage 2 (EO 20-26 ¶ 13): closed in Stage 1, reopened one week after Stage 2 entry (May 11; May 18; May 23) with services "by appointment only," workstations spaced and cleaned after each client, employees and customers masked; Stage 3 and 4: appointment preferred, employee masks mandatory; statewide mask mandate through Apr. 5, 2021; no personal-care directive from Apr. 6, 2021.

Fitness and entertainment

EO 20-08 ¶ 5 (Mar. 24, 2020): "All places of public amusement, whether indoors or outdoors... bowling alleys, movie and other theaters, concert and music halls, and country clubs or social clubs, shall be closed"; gyms closed (¶ 9); Stage 2: closed; Stage 3 (May 22): gyms 50 percent with no contact workouts, cinemas, theaters, bowling alleys, skating rinks closed, mini-golf open; Stage 4 (June 12): cinemas, theaters, nightclubs and concert stages 50 percent, amusement parks, zoos, museums, arcades 50 percent, bowling and skating 50 percent, gyms 50 percent with contact permitted, contact sports from June 19, casinos from June 15 under IGC approval, fairs, festivals, parades and carnivals not permitted; Stage 4.5 (July 4): fairs and festivals 50 percent indoors, racino spectators 50 percent, events over 250 require a local-health-department-approved plan from July 23; Stage 5 (Sept. 26): events over 500 require a plan filed fourteen days ahead; EO 20-48 (Nov. 15): events capped 250/100/50/25 by county color with approved plans above, collegiate and professional spectators 25 percent with local approval, community leagues participants and family only in Orange and Red; Apr. 6, 2021: local health departments may cap; IGC casino closure Mar. 16-June 15, 2020 with reopening conditions (Ex. Hotels and short-term rentals

EO 20-08 ¶ 14.w (Mar. 24, 2020): hotels and motels essential only "to the extent they are used for lodging and delivery or carryout food services"; campgrounds closed 11:59 p.m. Apr. 7 (EO 20-18 ¶ 5) through Stage 2, reopened Stage 3 with gathering limits; State park inns closed in Stages 1-2; conventions capped at 250 in Stage 4.5 (EO 20-35 ¶ 4), plan required over 500 in Stage 5, county caps 250/100/50/25 Nov. 15, 2020-Apr. 5, 2021; no traveler quarantine order.

Offices and telework

EO 20-09 (Mar. 23, 2020): the head of each State agency "shall require all personnel, unless the employee's physical presence is required to perform an essential function, to work remotely via telework"; EO 20-08 ¶ 4 (Mar. 24): non-essential businesses cease except Minimum Basic Operations, which include "the minimum necessary activities to facilitate employees of the business being able to continue to work remotely from their residences," and ¶ 20: "All businesses and employers, whether or not they are deemed to be essential under this Executive Order, are hereby ordered to... Allow as many employees as possible to work from home by implementing policies in areas such as teleworking and video conferencing"; EO 20-18 ¶ 14.t (Apr. 6): professional services "should be conducted virtually or by telephone whenever reasonably possible and any professional services requiring face-to-face encounters should be postponed unless the failure to meet in-person will have a significant adverse impact on the client's financial or legal position"; EO 20-26 ¶ 11 (May 4): office-based businesses "should return staff in phases" under a posted safeguards plan; EO 20-28, 20-32, 20-43, 20-48 (May 22, 2020-Apr. 5, 2021): telework "encouraged"; mask mandate exempted private offices where six feet was kept (July 27, 2020-Apr. 5, 2021); State offices closed to the public Mar. 23-May 1, 2020 and appointment-only in Stages 4 and 4.5.

EO 20-04 (Mar. 16, 2020): CDC guidance of no in-person events over 50; EO 20-08 (Mar. 24): all gatherings outside a household prohibited and "Any gathering of more than ten (10) people is hereby prohibited" (religious facilities essential "provided they adhere to the CDC's guidance on social gatherings"); EO 20-18 (Apr. 6): "All public and private gatherings, whether governmental, social, philanthropic, religious, spiritual or otherwise... are prohibited unless such gathering is of ten (10) or less people"; EO 20-26: religious services exempt from gathering limits from May 8, 2020 (receptions and visitations remained subject); Stage 2 cap 25; Stage 3 cap 100; Stage 4 and 4.5 cap 250 (events over 250 approved plan from July 23); Stage 5: plan for events over 500; EO 20-48 to 21-01 (Nov. 15, 2020-Jan. 31, 2021): 250/100/50/25 by county color with approval above; EO 21-02 and 21-06 (Feb. 1-Apr. 5, 2021): caps "strongly recommended" with 25 percent (Red, Orange), 50 percent (Yellow) or 100 percent (Blue) of capacity and safety plans; Apr. 6, 2021: local authority.

Courts and public offices

Ind. Sup. Ct. Mar. 16, 2020: all trial courts ordered to implement continuity-of-operations plans and petition for AR 17 relief (tolling; jury-trial continuances); Mar. 23: appellate deadlines tolled to Apr. 6, in-person filing suspended; Apr. 3: all AR 17 relief extended through May 4 or the end of the emergency, jury pools not to be recalled before May 4, no new writs of attachment or body attachments; May 13: relief through May 30 and transition plans required; May 29: tolling through Aug. 14, 2020, no interest during the tolled period, remote-proceedings orders to Jan. 1, 2021; Nov. 10: masks required for all participants in in-person proceedings, remote authority to July 1, 2021; Dec. 14: "No in-person jury trials may be held until March 1, 2021"; May 7, 2021: remote-hearings authority until further order. Travel and quarantine

EO 20-08 ¶ 6 (Mar. 24, 2020): "Only Essential Travel and Essential Activities... are permitted"; travel into or out of Indiana allowed to maintain Essential Businesses and Minimum Basic Operations; Stage 2 (May 4): travel permitted; no statewide traveler quarantine at any time; EO 20-03 (Mar. 13-Apr. 5, 2020): hours-of-service waiver for carriers delivering to Indiana businesses; EO 20-48 to 21-15: persons testing positive "shall self-quarantine"; IDOH control measures (July 19, 2021): positives isolate at least ten days with exclusion from employment and public places, unvaccinated close contacts quarantine fourteen days (ten with precautions; seven with a negative day-5 PCR) with exclusion from employment; EO 21-24 (Sept. 2, 2021): vaccinated close contacts must mask in public until a negative test.

Face coverings

EO 20-37 (July 24, 2020; eff. 12:01 a.m. July 27): "every individual within the State of Indiana shall wear a face covering over the nose and mouth when: a. inside a business, public building, or other indoor place open to the public... b. in an outdoor public space wherever it is not feasible to maintain six feet of social distancing... c. using public transportation or while in a taxi, private car service, or ride-sharing vehicle" (age 8 and older; exemptions listed; enforcement by health departments "through education"); grades 3-12 school mandate; extended by EO 20-42 (to Sept. 25), continued in EO 20-43 and 20-46 (Stage 5), EO 20-48, 20-50, 20-53, 21-01, 21-02, 21-06 (with business signage and employee mask duties) and EO 21-09 through 11:59 p.m. Apr. 5, 2021; Apr. 6-May 31, 2021: State buildings, testing and vaccination sites, K-12; June 1-30: State congregate facilities, testing and vaccination sites, K-12; July 1, 2021: none statewide; Monroe County Aug. 5-Sept. 30, 2021 (Ex. IN-093); Indianapolis and Marion County: MET-IND.

Vaccination mandates

No statewide vaccination mandate for health-care workers, State employees or the public through Sept. 30, 2021; EO 21-15, 21-17, 21-19, 21-24 and 21-27 "strongly encouraged" vaccination and authorized PREP Act vaccinators; the IDOH control measures conditioned exemption from quarantine and from workplace exclusion on full vaccination (July 19, 2021); Indiana University (a State institution) required all students to be vaccinated for the fall 2021 semester, with masks and twice-weekly testing for the religiously or medically exempt, a condition the Seventh Circuit left in force on Aug. 2, 2021 (Klaassen; Ex. IN-094).

Standing duties

The statutes, codes and penalty provisions of Indiana that stood before March 2020 and ran through every claimable quarter. They are the reason nothing an employer did under the orders was voluntary. Read the Indiana duties →

Indiana law imposed, throughout the six quarters, four standing duties that made the pandemic protocols compulsory for every employer and every operator of premises open to the public. First, the communicable-disease title of the Indiana Code (Title 16, Article 41) empowered the State Department of Health and every local health officer to impose isolation and quarantine, by court order or, in exigent circumstances, by immediate order posted on the premises, and made violation of a condition of isolation or quarantine a Class A misdemeanor (Ind. Code 16-41-9-1.5(k), (t)); the Department's communicable-disease rule, 410 IAC 1-2.5, directed health officers to place 'such restrictions upon the movements of cases or carriers and their contacts as may be reasonably necessary to prevent the spread of disease' and to require cases to cease 'conduct that constitutes a health threat to others' (410 IAC 1-2.5-79(2), (8)(E)); the Department's COVID-19 Control Measures issued under that rule required every positive case to isolate and every unvaccinated close contact to quarantine 'including exclusion from... employment' (Ex. IN-092; Ex. DUT-IN-018). Second, the local-health-department article forbade every person to 'institute, permit, or maintain any conditions that may transmit, generate, or promote disease,' required health officers to order abatement, and authorized enforcement by injunction, license suspension, vacation of property and civil penalty (Ind. Code 16-20-1-25, 16-20-1-26); the State Department held the parallel powers to 'establish quarantine,' 'forbid public gatherings' and 'issue an order condemning or abating conditions causative of disease' (Ind. Code 16-19-3-9 to -12). Third, the Emergency Management and Disaster Law gave the Governor's orders 'the full force and effect of law' (Ind. Code 10-14-3-22(b)), authorized him to 'control ingress to and egress from a disaster area, the movement of persons within the area, and the occupancy of premises in the area' (Ind. Code 10-14-3-12(d)(7)), and made a knowing, intentional or reckless violation a Class B misdemeanor through April 14, 2021 (Ind. Code 10-14-3-34 (2020 ed.)) and a Class B infraction carrying a judgment of up to $1,000 thereafter (Ind. Code 10-14-3-34 (2021 ed.), as amended by P.L.64-2021; Ind. Code 34-28-5-4(b)). Every stay-at-home and reopening order recited the misdemeanor (Exs. IN-016, IN-024, IN-026, IN-030). Fourth, the Indiana Occupational Safety and Health Act bound every employer to 'establish and maintain conditions of work which are reasonably safe and healthful for employees, and free from recognized hazards that are causing or are likely to cause death or serious physical harm' (Ind. Code 22-8-1.1-2) and to comply with the adopted standards (Ind. Code 22-8-1.1-3.1; 620 IAC 1-1-1 adopting 29 C.F.R. Part 1910), on pain of civil penalties of up to $7,000 per violation and $70,000 for repeated or knowing violations (Ind. Code 22-8-1.1-27.1). The Governor's orders wrote this duty into the pandemic regime in terms: 'All employers, whether manufacturers, distributors, professional offices, retailers or others, must comply with safety and health standards established and enforced by IOSHA. Employers are subject to specific standards to prevent the exposure or spread of a disease. Additionally, the General Duty Clause requires employers to provide their employees with a workplace free from recognized hazards likely to cause death or serious physical harm' (Ex. IN-024 para. 4(b); Ex. IN-016; Ex. IN-061). The Indiana Department of Labor administered that duty against the CDC's business guidance: IOSHA 'required employers to demonstrate they were following both Centers for Disease Control business COVID guidelines as part of general duty and any guidance federal OSHA recommended,' collected 'thousands of documents that employers were required to submit in response to complaints,' received more than 6,700 valid complaints in 2020 and 2021 against a pre-pandemic average of about 1,200 a year, conducted more than 120 inspections and issued citations (Ex. DUT-IN-020; federal OSHA's FAME reports record 6,200 complaints in FY 2020 and 3,157 complaint investigations in FY 2021, Exs. DUT-IN-011, DUT-IN-010). The COVID-19 civil-immunity statute (Ind. Code 34-30-32, P.L.1-2021, signed Feb. 18, 2021, retroactive to causes accruing on or after Mar. 1, 2020) contains no compliance-with-guidance condition in terms; it withholds immunity from 'gross negligence or willful or wanton misconduct' proven by clear and convincing evidence (Ind. Code 34-30-32-7), so the governmental protocols remained the measure of the conduct a business had to meet. A federal court applying Indiana law held in December 2020 that the Epidemic Statute (Ind. Code 16-20-1-24) authorized the Marion County health officer to close and restrict bars, nightclubs and restaurants and that the health department 'acted within the authority granted to them' (Ex. DUT-IN-009).

The question these duties answer

Whether the measures employers took beyond the four corners of the emergency orders were 'voluntary' within Notice 2021-20 Q&A-14, or were compelled by standing legal duties.
