Operative words

A person who knowingly, intentionally, or recklessly violates this chapter commits a Class B misdemeanor.

Penalty

Class B misdemeanor: up to 180 days and a fine of up to $1,000 (Ind. Code 35-50-3-3, as recited in the orders)

What it required

Every person obey the Governor's disaster-emergency orders and the chapter; the Governor's orders recited this section in terms: 'Penalty: A knowing violation of an Executive Order issued pursuant to Indiana's Emergency Disaster Law is a class B misdemeanor, punishable up to 180 days incarceration and a fine of up to $1,000' (Ex. IN-016 para. 20(c)(i); Ex. IN-024 para. 34; Exs. IN-026, IN-030).

Retrieval note

Saved so that the misdemeanor text in force during 2020 Q2 through 2021 Q1 and the first half of 2021 Q2 can be cited from the statute itself rather than from the orders' recitals alone. Section 12(d)(7) ('Control ingress to and egress from a disaster area, the movement of persons within the area, and the occupancy of premises in the area') is at the same place in the 2020 edition.
