The record in brief

Connecticut governed the six claimable quarters through one continuous chain of emergency authority and a numbered series of executive orders that reached every function of every employer in the State. Governor Ned Lamont declared public health and civil preparedness emergencies on March 10, 2020 under Conn. Gen. Stat. sections 19a-131a and 28-9 (Ex. CT-001), renewed and re-declared them on September 1, 2020 (to February 9, 2021), January 26, 2021 (to April 20, 2021), April 19, 2021 (to May 20, 2021, under Special Act 21-2), May 18, 2021 (to July 20, 2021, under Special Act 21-4), July 13, 2021 (to September 30, 2021, under Special Act 21-5, approved by the General Assembly on July 14, 2021) and September 27, 2021 (to February 15, 2022, approved by resolution on September 28, 2021, as EO 14A recites). The General Assembly ratified every declaration by Special Act 21-2 (March 31, 2021) and set the renewal procedure by Special Acts 21-4 and 21-5 (May 2021). The emergency and its orders therefore had force of law on every day from March 10, 2020 through September 30, 2021 and beyond. 2020 Q2 (with the March 13-31 run-up): EO 7 (March 12) banned gatherings of 250; EO 7D (March 16, 8 p.m.) cut gatherings to 50, closed restaurants and bars to all but takeout, and closed gyms, fitness centers, movie theaters and off-track betting; EO 7F (March 19, 8 p.m.) closed the indoor common areas of the ten large malls and every place of public amusement; EO 7G (March 19) suspended non-critical court operations, venue and time requirements statewide and closed barbershops, salons, nail salons, spas and tattoo parlors from March 20 at 8 p.m.; EO 7H (March 20), the 'Stay Safe, Stay Home' order, required every business and nonprofit to employ telecommuting to the maximum extent possible and required non-essential businesses to reduce their in-person workforces by 100 percent by March 23 at 8 p.m., with a binding DECD essential-business list, and barred municipal orders that conflicted with State orders; EO 7N (March 26) cut social and recreational gatherings to five; EO 7Q (March 30) capped child-care groups at ten; EO 7S (April 1) and EO 7V (April 7) imposed mandatory statewide Safe Stores and Safe Workplace rules on every retailer and every workplace; EO 7T (April 2) prohibited all non-essential lodging, including Airbnb and VRBO rentals; EO 7X (April 10) imposed the eviction moratorium; EO 7BB (April 20, 8 p.m.) required masks in public wherever six feet could not be kept; EO 7C, 7L, 7X and 7II closed public school classes from March 17 through the end of the 2019-20 year. Reopening came in phases under DECD Sector Rules that EO 7PP made 'legally binding guidance': Phase 1 on May 20, 2020 (outdoor dining at 50 percent with no bar areas, offices at 50 percent with employees to 'continue to work from home where possible', retail and malls at 50 percent, museums and zoos), hair salons and barbershops at 50 percent on June 1 (EO 7TT), and Phase 2 on June 17 (EO 7ZZ: indoor dining at 50 percent, personal services, gyms at 50 percent, indoor recreation at 50 percent, amusements, hotels), with the five-person gathering cap replaced on June 1 by ten indoors and 25 outdoors and worship capped at 25 percent or 100 indoors. Alcohol could be served only with food, a rule kept in force by EO 7D as amended, EO 9 section 2, EO 9K section 7, EO 10A and EO 11B section 4 until May 20, 2021. The essential-business and telework rules of EO 7H section 1 were extended for the duration of the emergency by EO 7ZZ section 10. 2020 Q3: the tri-State travel advisory of June 25 (EO 7BBB) became a mandatory 14-day quarantine on July 24 (EO 7III, civil penalty up to 1,000 dollars, Travel Health Form), amended September 18 (EO 9B, 500 dollars per violation, Affected Countries added); EO 7NNN (August 14) tightened the mask order; EO 9 (September 4) made the State Department of Education's reopening plan and OEC child-care rules binding, including school masking; EO 9A (September 8) reissued every order to November 9; EO 9B (September 15) created 100-dollar mask fines (the business liable for its employees) and 500- and 250-dollar gathering fines; the nursing-home visitor ban of March 13 (Ex. CT-059) was rescinded September 25 only after the CMS memorandum; Phase 2 capacities (indoor dining 50 percent, indoor events 25 persons, gyms 50 percent) governed the whole quarter. 2020 Q4: Phase 3 on October 8 (restaurants and personal services to 75 percent, worship to 50 percent or 200 under EO 9F), a municipal option to revert (EO 9G, October 15), then the statewide rollback to Phase 2.1 on November 6 (EO 9K: restaurants 50 percent, parties of eight, mandatory closing times, worship 50 percent or 100, indoor events 25), EO 9L extending everything to February 9, 2021, EO 9N imposing a 10,000-dollar civil penalty per capacity violation from November 26, a road-race ban from November 23, and EO 9S (December 19) extending the ten-day quarantine to travelers from every State except New York, New Jersey and Rhode Island. 2021 Q1: the January 26 renewal, EO 10A (February 8) extending every order to April 19 and the eviction moratorium for the duration, worship at 50 percent (EO 10 section 7), indoor performing arts at 50 percent from February 17, and the March 19 step announced March 4 and executed by DECD rules and EO 10D: percentage capacity limits removed for most sectors subject to six-foot distancing, parties of eight and closing times, indoor events to 50 percent up to 100, outdoor private events to 200, worship caps lifted, the travel quarantine repealed; bars without food stayed closed and the sector rules stayed binding. 2021 Q2: the April 19 renewal, EO 11 and 11A re-enacting the sector rules and every enforcement tool through May 20, EO 11B keeping alcohol tied to food, EO 11F allowing outdoor alcohol without food from May 1, Special Acts 21-4 and 21-5, the May 18 renewal to July 20, and the end of general business restrictions at 11:59 p.m. on May 20, 2021 by EO 12B (repealing EO 11A sections 1 and 2, EO 11B sections 3 to 5 and EO 7TT section 2), with EO 12A (May 20) keeping masks for the unvaccinated indoors and universal masking in the DPH-listed settings (schools, child care, all health-care settings including dental offices, shelters, corrections, transit) enforceable by 100-dollar fines charged to the employer. 2021 Q3: the July 13 renewal to September 30 and EO 13 (July 19) carried EO 12A, EO 9 section 1, EO 12D and other orders through September 30; EO 13A (August 5) re-issued the mask order, authorized municipal universal indoor mask orders, and made the nursing-home staff testing statute effective immediately; DPH's August 7 order imposed universal masking in every PreK-12 school, child-care facility, health-care setting and transit hub; EO 13B (August 6) and 13F (September 3) required vaccination of every long-term-care worker by September 27 under a 20,000-dollar-per-day penalty; DPH's August 11 order required weekly testing of unvaccinated nursing-home staff; EO 13D (August 19) and 13G (September 10) required State employees, State hospital employees and every worker in a public or non-public school or child-care facility to be vaccinated or tested weekly from September 27, with exclusion from the premises for non-compliance; EO 12D governed every residential notice to quit; and on September 27-30 the Governor and the General Assembly renewed the emergency to February 15, 2022 and EO 14A carried EO 13A, 13C, 13E, 13F, 13G, 12D and 9 section 1 forward. Preemption of local orders

Connecticut has no county governments; municipalities act under Conn. Gen. Stat. section 28-8a. EO 7H section 2 (March 20, 2020) provided that 'no municipal chief executive officer or designee may enact or enforce any order that conflicts with any provision of any of my Executive Orders or an order issued by an executive agency pursuant to the existing public health and civil preparedness emergency, or issue any shelter-in-place order or order prohibiting travel, unless they first seek and receive written permission from the Department of Emergency Services and Public Protection' (Ex. CT-007). EO 7S section 1 (Safe Stores rules), EO 7T section 1 (lodging), EO 7V section 1 (Safe Workplace rules), EO 7BB section 1 and EO 7NNN section 1(c) (masks), EO 12/12A subsection (d) and EO 13A section 1(d) each provided that the order 'shall supersede and preempt any current or future municipal order' whenever the municipal order conflicts. EO 9G (October 13, 2020, effective October 15) and EO 9J (October 29, 2020) gave municipalities with a Municipal Case Average of 15 or more new daily cases per 100,000 the election to revert to the pre-October 8 (Phase 2) rules; EO 9K section 1 (November 5, 2020) repealed that authority and returned the State to uniform statewide Phase 2.1 measures. EO 13A section 1(d) (August 5, 2021) carved out one class of local order: 'a municipal order issued pursuant to Section 28-8a of the Connecticut General Statutes requiring masks or face coverings in indoor settings regardless of vaccination status shall not be deemed to conflict with this order', while 'additional restrictions on social, recreational, or business activity that are not related to masks or face coverings... shall be deemed to be in conflict with this order' (Ex. CT-050). Local health directors and municipal designees were the enforcement arm of the State's Sector Rules (EO 7PP section 2; EO 7ZZ section 3; EO 9N; EO 11A section 2), with power to close a business until it abated the nuisance and to impose the 10,000-dollar civil penalty.

Standing duties

The statutes, codes and penalty provisions of Connecticut that stood before March 2020 and ran through every claimable quarter. They are the reason nothing an employer did under the orders was voluntary. Read the Connecticut duties →

Connecticut placed every employer under three standing duties before any COVID-19 order issued, and every COVID-19 order was written on top of them. First, the communicable-disease statutes: chapter 368a authorizes the Governor to declare a public health emergency (§ 19a-131a) and the Commissioner of Public Health to quarantine or isolate 'any individual, group of individuals or individuals present within a geographic area' by confinement 'to private homes or other private or public premises' (§ 19a-131b), and § 19a-131a(d) makes any individual who 'violates the provisions of any order issued pursuant to sections 19a-131 to 19a-131i' liable to a fine of $1,000 or a year's imprisonment for each offense; chapter 368e binds every owner or occupant of property to the Public Health Code (§ 19a-206(a) deems a violation 'a nuisance or source of filth injurious to the public health'), arms local directors of health with abatement orders, injunctions, closure and a $250-per-day civil penalty (§ 19a-206(b)), requires local directors to 'comply with and carry out' the Commissioner's emergency orders (§ 19a-221(a)), and makes violation of 'any legal order of a director of health' a class C misdemeanor (§ 19a-230); violation of any provision of the Public Health Code is itself a class C misdemeanor (§ 19a-36(a)(4)). Second, the emergency statute: § 28-9(b)(1) provides that the Governor's order 'shall have the full force and effect of law upon the filing of the full text of such order in the office of the Secretary of the State,' § 28-9(b)(7) authorizes 'such other steps as are reasonably necessary... to protect the health, safety and welfare of the people of the state,' and § 28-22 makes a person 'who violates any provision of this chapter' guilty of a class D felony. The Connecticut Supreme Court held in Casey v. Lamont, 338 Conn. 479 (2021), that § 28-9 authorized the COVID-19 orders limiting bars and restaurants and that the statute is constitutional; the District of Connecticut held in Amato v. Elicker (May 19, 2020) that Executive Order 7N 'is within the state's power to protect public health during an epidemic.' Third, the workplace duties: § 31-49 makes it 'the duty of the master to exercise reasonable care to provide for his servant a reasonably safe place in which to work'; § 31-40v requires every employer of twenty-five or more to 'administer a safety and health committee'; the State's OSHA plan (chapter 571, § 31-370(a)) states the general duty for public employers, and private employers are bound by the identical federal duty in 29 U.S.C. § 654(a)(1) because CONN-OSHA administers a 'Public Employer Only State Plan.' On those duties the Governor built the operating conditions: EO 7H § 1 (telework 'to the maximum extent possible' and a 100 percent in-person reduction for non-essential workforces), EO 7V § 1 ('Every workplace in the State of Connecticut shall take additional protective measures' under rules that 'shall be mandatory throughout the state'), EO 7PP and EO 11A (Sector Rules that 'shall constitute legally binding guidance,' a violation of which was written into the Public Health Code's definition of public nuisance and punished by closure and, from November 24, 2020, a $10,000 civil penalty per violation), the DECD self-certification requirement ('All businesses subject to the following rules are required to self-certify prior to opening'), and the mask orders that made the employer, 'rather than the employee,' liable for the fine. Connecticut enacted no general business liability shield: HB 5125 (2021), which would have immunized businesses that 'acted in substantial compliance with public health guidelines,' was never enacted, so the ordinary standard of care applied in full, and the only immunity conferred (EO 7U § 1, superseded by EO 7V § 6) ran to health care professionals and facilities for acts 'undertaken in good faith' and expired for facilities on March 1, 2021 (EO 10A § 4). Nothing an employer did to comply with these instruments was voluntary.

The question these duties answer

Whether the measures employers took 'beyond' the orders were voluntary. Connecticut answer: the measures were the performance of duties imposed by statute (Conn. Gen. Stat. §§ 19a-131a(d), 19a-206, 19a-221, 19a-230, 19a-36(a)(4), 28-9(b)(1), 28-22, 31-49, 31-40v; 29 U.S.C. § 654(a)(1)), by the Public Health Code (Regs. Conn. State Agencies §§ 19-13-B1, 19-13-B2), and by orders that carried 'the full force and effect of law' (§ 28-9(b)(1)) and made continued operation conditional on compliance with 'legally binding' Sector Rules enforced by closure and civil penalty.
