Operative words

Throughout all phases of the reopening, DECD has required businesses to self-certify they are following specified safety guidelines before reopening. DECD provides an up-to-date searchable list of self-certified businesses. Businesses are only required to self-certify once

Penalty

The certification was the condition of lawful opening; operating in violation of the Sector Rules was a public nuisance enforceable by closure (EO 7PP § 2, Ex. CT-018) and, from Nov. 24, 2020, a $10,000 civil penalty per violation (EO 9N, Ex. CT-033; EO 11A, Ex. CT-041)

What it required

Records, as the General Assembly's own research office found, that every business reopening under the Sector Rules was required to certify to the State that it was following the specified safety rules before it opened, and that 19,566 businesses had done so by June 26, 2020 and more than 22,000 by December 11, 2020, restaurants (23.7 percent), offices (21.9 percent), retail and malls (17.2 percent) and hair salons and barbershops (14 percent) leading.
