Operative words

any health care professional or health care facility shall be immune from suit for civil liability... because of the individual's or health care facility's acts or omissions undertaken in good faith while providing health care services in support of the State's COVID-19 response... Such immunity shall not extend to... gross negligence, willful misconduct

Penalty

none (an immunity, conditioned on good faith; withdrawn from facilities effective March 1, 2021)

What it required

Conferred immunity only on health care professionals and health care facilities, only for acts or omissions 'undertaken in good faith while providing health care services in support of the State's COVID-19 response,' and never for gross negligence or willful misconduct; no other business received any immunity from Connecticut, so every other employer answered to the ordinary standard of care, and the health care sector's own shield was conditioned on good-faith performance of the State's response.

Retrieval note

EO 7V § 6 (Ex. CT-014, read): 'Section 1 of my prior Executive Order No. 7U concerning protection from civil liability... is hereby superseded and replaced in its entirety by the following: Notwithstanding any provision of the Connecticut General Statutes or any other state law, including the common law,... any health care professional or health care facility shall be immune from suit...' EO 10A § 4 (Ex. CT-036, read): 'the provisions of Executive Order No. 7V, Section 6 applicable to a healthcare facility, as defined therein, shall expire on March 1, 2021. All other provisions of that Executive Order are extended... for the duration of the current public health and civil preparedness emergencies.' Connecticut enacted no statutory shield for businesses (Ex. DUT-CT-008).
