The record in brief

Colorado's regime was State-driven from March 10, 2020 through April 16, 2021, and it never went dark before September 30, 2021. Governor Polis verbally declared a disaster emergency on March 10, 2020 and issued Executive Order D 2020 003 on March 11, 2020 (Ex. CO-001); the declaration was extended monthly by twenty-six orders through D 2021 121 (June 30, 2021) and was then rescinded and replaced, not ended, by the Colorado COVID-19 Disaster Recovery Order, D 2021 122 (July 8, 2021, Ex. CO-043), which was itself extended on July 30, August 6 and September 4, 2021 (Exs. CO-044 to CO-046) and continuously thereafter. The closure layer began March 12, 2020 with PHO 20-20 (visitor restrictions at every skilled nursing facility, assisted living residence and intermediate care facility, Ex. CO-002), March 14 with D 2020 004 (all downhill ski areas closed, extended to May 23, 2020, Exs. CO-003, CO-082), March 16-17 with PHO 20-22 (restaurants, bars, gymnasiums, theaters and casinos 'closed to ingress, egress, use, and occupancy by members of the public'; hair and nail salons, spas, tattoo and massage parlors added March 19; Ex. CO-004), March 18-19 with PHO 20-23 (gatherings of more than ten prohibited, Ex. CO-005) and D 2020 007 (all P-12 in-person instruction suspended, later through the end of the school year, Exs. CO-006, CO-018), March 19 with D 2020 009 (all elective medical, dental and veterinary procedures suspended to April 26, Ex. CO-007), March 22 with D 2020 013 and PHO 20-24 (every employer ordered to cut in-person work by at least fifty percent and 'to implement tele-work or other work from home capabilities to the greatest extent possible', Exs. CO-010, CO-011), and March 25 with D 2020 017 Stay at Home (effective 6:00 a.m. March 26 through April 26, 2020, Exs. CO-012, CO-013, CO-015, CO-016, CO-047). Second quarter 2020 reopening was staged by D 2020 044 Safer at Home and PHO 20-28 (April 27: retail curbside; May 1: in-store retail and personal services at 50 percent or ten people; May 4: non-critical offices at 50 percent in-office occupancy; May 27: restaurants at 50 percent indoors; June 4: gyms at 25 percent; June 18: bars at 25 percent or 50 patrons, indoor events to 100 and outdoor to 175; Exs. CO-019 to CO-025, CO-028, CO-064), under a ten-person gathering cap that lasted into the fall. Third quarter 2020 added the statewide face-covering order D 2020 138 (July 16, 2020: every person over ten in every Public Indoor Space, with owners forbidden to serve the unmasked, Ex. CO-031), the 10:00 p.m. alcohol last call (D 2020 142, July 21, Ex. CO-032), the Protect Our Neighbors certification framework (Exs. CO-030, CO-050) and, on September 15, 2020, the Safer at Home Dial, PHO 20-35 (Ex. CO-033). Fourth quarter 2020 was the re-tightening: D 2020 235 (October 30) created the COVID-19 Dial and ordered residents of Level Red counties to stay at home (Ex. CO-035); PHO 20-36 (November 2, Ex. CO-036) and its First Amended version (November 17, effective November 20, Ex. CO-081) added Level Red (Severe Risk: personal gatherings prohibited, offices at 10 percent with remote work 'to the greatest extent possible', indoor dining closed, last call 8:00 p.m., indoor events closed, gyms at 10 percent, casinos closed) and Level Purple (Extreme Risk: stay at home; offices, retail, personal services, restaurants and events closed), and the Denver metro and most Front Range counties were placed in Level Red from 5:00 p.m. November 20, 2020 through January 4, 2021 (Exs. CO-037, CO-038). First quarter 2021 ran on the Dial (Dial 2.0, February 6, Ex. CO-039; Dial 3.0, March 24, Ex. CO-057) with capacity caps on every sector, the mask order (Exs. CO-067 chain), the elective-procedure order PHO 20-29 to April 16 (Exs. CO-022, CO-094) and tenant protections (Exs. CO-071, CO-070). General business restrictions ended when PHO 20-38 Limited COVID-19 Restrictions took effect at 12:01 a.m. April 16, 2021 (Ex. CO-051), but the mask order continued to June 1, 2021 (D 2021 079, 095, 103, Exs. CO-067, CO-068, CO-040), the 500-person indoor gathering cap to June 1, 2021 (Exs. CO-060, CO-061), and PHO 20-38 itself was amended seven times through September 30, 2021 (Exs. CO-052, CO-041, CO-053, CO-091, CO-054). Third quarter 2021 in Colorado therefore had in force: the Recovery Order chain; the Fourth, Fifth and Sixth Amended PHO 20-38 (masks and medical-grade masks for unvaccinated persons in health care settings, prisons, jails and homeless shelters, an obligation on 'all employers' to implement them, an 85-percent hospital-capacity trigger for renewed county restrictions, hospital reporting, and from September 1 school case reporting); the Seventh and Eighth Amended PHO 20-20 (weekly PCR testing and visitation rules in every residential care facility, Exs. CO-042, CO-092); PHO 21-01 (Ex. CO-093); the Board of Health emergency rule of August 30, 2021 requiring every employee, contractor and support-staff member of every licensed health care facility to receive a first dose by September 30 and be fully vaccinated by October 31, 2021 (Ex. CO-055); the State's vaccination-or-testing requirement for its own workforce (testing and indoor masking from September 20, 2021; first doses by September 30 in the Departments of Corrections, Human Services and Public Health); and local orders such as San Miguel County's universal indoor mask order of September 1, 2021 (Ex. CO-076). Colorado never preempted local orders: every stay-home, Safer at Home and Dial instrument stated that a county or municipality may adopt more protective standards, and less protective local measures required CDPHE approval.

What remained in force

Preemption of local orders

None. Colorado set a statewide floor and expressly preserved stricter local orders throughout. D 2020 017 (Mar. 25, 2020) § II.D.1.e: 'Nothing in this Executive Order prevents a local public health authority from issuing an order more protective of public than this Executive Order. For clarity, any stay at home or similar order issued by a local jurisdiction remains in full force and effect' (Ex. CO-012); D 2020 235 (Oct. 30, 2020) § M: 'Nothing in this Executive Order prevents a county or municipality from adopting more protective standards than those contained in this Executive Order as necessary' (Ex. CO-035). Local public health directors act under C.R.S. §§ 25-1-506 and 25-1-508 (recited in the Pitkin County order, Ex. CO-090, and the San Miguel County order, Ex. CO-076). Less protective local measures required State approval: PHO 20-24 § IV allowed local agencies to apply to CDPHE for relief (Ex. CO-016); the Protect Our Neighbors and Dial variance processes ran through CDPHE certification (Exs. CO-030, CO-050, CO-036); D 2020 235 § K authorized CDPHE to 'restrict funding to any county that implements measures that are less restrictive than the standards approved by CDPHE for each level if the county did not first obtain approval from CDPHE' (Ex. CO-035). Counties in Level Red in November 2020 (Weld County among them) that announced non-enforcement did not thereby remove the State order's force. From April 16, 2021 (PHO 20-38) counties assumed local control and several reimposed mask orders in Q3 2021.

Child care

Face coverings

Vaccination mandates

State Board of Health emergency rule 6 CCR 1011-1, ch. 2, Part 12 (adopted and effective Aug. 30, 2021): every employee, direct contractor and support-staff member of every licensed health care facility first dose by Sept. 30, 2021, fully vaccinated by Oct. 31, 2021, new hires fully vaccinated after Oct. 31, medical and religious exemptions per facility policy, vaccination-rate reporting from Oct. 1, 2021; State of Colorado as employer: unvaccinated State employees to test twice weekly and mask indoors from Sept. 20, 2021, and Corrections, Human Services and Public Health staff serving vulnerable populations first dose by Sept. 30, 2021 (Governor's releases Aug. 17-18, 2021); federal EO 14042/14043 and the CMS and OSHA rules of Nov. 2021 stated in the Federal files.

Standing duties

The statutes, codes and penalty provisions of Colorado that stood before March 2020 and ran through every claimable quarter. They are the reason nothing an employer did under the orders was voluntary. Read the Colorado duties →

Colorado's pandemic measures rested on standing law that no single order created. C.R.S. 25-1.5-101(1)(a) and 25-1.5-102(1)(a)(I), (c) and (d) empower CDPHE to close public places, forbid gatherings, investigate and control communicable disease, and establish and enforce isolation and quarantine with physical control over property and persons; 25-1-506(3)(b) gives county and district public health agencies the same powers locally. C.R.S. 25-1-114(1)(a) makes it unlawful for any person, association or corporation, and the officers thereof, to willfully violate, disobey or disregard any lawful public-health order, punishable during the period by a fine up to $1,000 and county jail up to one year (25-1-114(4), 2018 text), and expressly preserves civil actions in damages for violations of the public health laws; 25-1-516 is the local analogue (class 1 misdemeanor in the 2018 text). Every CDPHE order in the library recites 25-1.5-101 and 25-1.5-102 as authority and 25-1-114 as the penalty. C.R.S. 24-33.5-704(2) gives the Governor's executive orders the force and effect of law and (7)(g) the power to control the occupancy of premises; violations of executive orders were enforced through the implementing PHOs, license suspension (D 2020 138 sec. K) and trespass (D 2020 138 sec. H). Colorado is a federal-OSHA State without a State general-duty statute (the former 8-1-109 is repealed; HB 26-1054 to enact one was lost May 13, 2026), so 29 U.S.C. 654(a)(1) bound every private employer; the General Assembly added the Public Health Emergency Whistleblower Act (HB 20-1415, eff. July 11, 2020) and the Healthy Families and Workplaces Act (SB 20-205, eff. July 14, 2020). Colorado enacted no COVID-19 liability shield: SB 20B-011, HB 21-1074 and SB 21-080 were each postponed indefinitely, and each would have protected only an entity that attempted in good faith to comply with applicable public health guidelines, instructions, orders and mandates; the Premises Liability Act's duty of reasonable care to invitees (13-21-115) and the ordinary negligence standard therefore governed. The retail food statute (25-4-1609, 25-4-1611) allowed closure for an imminent health hazard and license suspension, the route CDPHE used against a Castle Rock restaurant in May 2020, and the Board of Health's rules (6 CCR 1009-1) impose reporting, investigation and food-worker exclusion duties. The orders themselves wrote the protocols into operating conditions with mandatory verbs (must comply, shall take, must implement) and incorporated CDPHE guidance by reference, while marking recommendations as such (encouraged, should, strongly encouraged); PHO 20-38's employer implementation duty ran through September 30, 2021. The Attorney General stated in March 2020 that residents and businesses are required to follow the orders on pain of criminal penalty and license revocation, and the District of Colorado held on April 19, 2020 that the Stay at Home orders represented the reasonable judgment of the Governor and the public health departments under broad emergency powers.
