ScopeCounty, city, special-district and court instruments of the Denver metropolitan area from March 12, 2020 through September 30, 2021: Denver Department of Public Health and Environment (DDPHE) public health orders under D.R.M.C. 24-16 and the Mayor's local disaster emergency; Tri-County Health Department (TCHD) orders for Adams, Arapahoe and Douglas Counties under C.R.S. 25-1-506, -508, -509 and -516; Jefferson County Public Health (JCPH) orders; Boulder County Public Health (BCPH) orders and the City of Boulder's emergency orders as recited; Regional Transportation District (RTD) Board actions and rider rules; administrative orders of the Second Judicial District (Denver District, Probate and Juvenile Courts), Denver County Court, First Judicial District (Jefferson and Gilpin), Seventeenth Judicial District (Adams and Broomfield) and Twentieth Judicial District (Boulder). Colorado's metro counties ran a three-layer regime and the local layer moved first, went further and lasted longer than the State's. 2020 Q2 (with the March 13-31 run-up). Denver's Mayor declared a local disaster emergency on March 12, 2020 (C.R.S. 24-33.5-701), extended by the City Council on March 16 through May 11, 2020 and never lifted in the period (recited as continuing 'more than fifteen months later' in the Sept. 3, 2021 order, Ex. MET-DEN-026). DDPHE closed Red Rocks, the Coliseum, the Performing Arts Complex, the Colorado Convention Center and McNichols to the public and cancelled every permitted outdoor gathering of 250 or more on March 13 (Ex. 001); closed on-premises dining and drinking and banned gatherings of 50 or more on March 16 (Ex. 002); and on March 23 ordered all individuals in Denver to stay at their residences, all non-essential businesses to cease all activities at their Denver facilities except Minimum Basic Operations, all gatherings outside a household prohibited and all non-essential travel including on public transit prohibited, effective 5:00 p.m. March 24 (Ex. 005), adopted the State's PHO 20-24 through April 30 (Ex. 006) and extended it through May 8, 2020 (Ex. 007). TCHD closed dine-in service in Adams, Arapahoe and Douglas from 8:00 a.m. March 17 through April 30 (Ex. 083); JCPH closed bars, restaurants, theaters, casinos and public buildings March 18 (Ex. 084) and ordered Jefferson County residents to stay home March 25 (Ex. 085), yielding to the State's order the next day; the City of Boulder ordered residents to stay home by amended Emergency Order 2020-6 on March 23 (recited in Ex. 067). When the State's stay-home order expired April 26, Boulder County (Ex. 097), Denver (Ex. 007), Jefferson County (recited in Ex. 087) and TCHD (Ex. 073) each extended it locally through May 8, 2020. Safer at Home reached the metro May 9 (Exs. 008, 087); Jefferson County kept its buildings closed to the public through May 31 and limited P-12 school access and sports (Exs. 087, 086). Local mask orders began May 5-9, 2020 (Denver, recited in Ex. 060; Boulder County PHO 2020-02, Ex. 098). The Denver County and District Courts closed to the public from March 16 and cancelled jury calls through May 15 and jurors through July 6, 2020 (Exs. 050, 101, 053). RTD's Board cut service 40 percent from April 19, 2020, moved to rear-door boarding, suspended fares to July 1, capped riders at about 15 per bus and 30 per rail car and required operators to mask from April 24 (Exs. 043-045). 2020 Q3. TCHD's Board ordered face coverings for everyone outside the residence where six feet could not be kept on July 10 (Ex. 074; Douglas County opted out); JCPH ordered masks July 14, rescinded that order July 16 when EO D 2020 138 took effect, and ordered masks outdoors where distancing failed from July 25 (Exs. 088, 089, 091); Boulder County aligned its order with the State's July 24 (Ex. 108); RTD required riders to mask (Ex. 046); JCPH required pre-approval of events above 25 indoors or 75 outdoors under Level 3 (Ex. 090); Boulder County prohibited all gatherings involving 18-to-22-year-olds in the City of Boulder and confined 36 properties from September 24 (Ex. 100); the Second Judicial District required masks in every court facility (Ex. 060). 2020 Q4. Denver cut gatherings to 5 on October 16, made its face covering order independent of the State's (Ex. 036), ordered institutes of higher education to enforce limits and suspend team sports on any case (Ex. 037), confined residents from 10:00 p.m. to 5:00 a.m. and closed in-person dining at 10:00 p.m. from November 8 (Ex. 028) and adopted Level Red from 5:00 p.m. November 20 (Exs. 039, 027, 042: no personal gatherings, indoor dining prohibited, offices 10 percent, retail 50 percent, indoor events prohibited). TCHD limited indoor personal gatherings to 5 and cut alcohol sales at 10:00 p.m. in Adams and Arapahoe from October 16 (Exs. 075, 076) and imposed a 10:00 p.m.-5:00 a.m. curfew in Adams County, closing non-critical businesses during it, from November 7 to December 7 (Ex. 077). JCPH limited gatherings and alcohol sales from October 29 (Ex. 092); Boulder County capped indoor events at 25 and indoor dining at 25 percent from November 14 (Ex. 107). Every metro court suspended jury trials again (Exs. 055, 065, 068). 2021 Q1. Level Red ended January 4; Denver kept spectators out of non-professional sports and its own alcohol cut-off through March 10 (Exs. 009, 011, 012); JCPH's gathering limits ran through February 28 (Exs. 093, 094); Denver's January 20 face covering order reached everyone three and older (Ex. 010); no Denver juror was summoned before April 5, 2021 (Ex. 056). 2021 Q2. When the State dial expired April 16, Denver (Ex. 014), TCHD (Ex. 079), JCPH (Exs. 096, 106) and Boulder County (Ex. 030) issued their own dial orders keeping capacity restrictions to May 15-16 and an observation period with automatic re-imposition to August 15-16, 2021; the general indoor mask mandates ended May 15-16 (TCHD Ex. 080; JCPH Ex. 105; Denver Ex. 018, with EO D 2021 103 settings to June 1) and Boulder County's on June 10 (Ex. 031); Denver's June 1 orders kept prior approval for indoor events over 2,000 and masks where PHO 20-38 required them (Exs. 019, 020); RTD lifted its capacity caps June 13 and kept masks under the federal mandate (Ex. 047). 2021 Q3. Denver adopted the Fourth, Fifth and Sixth Amended PHO 20-38 by orders of July 1, August 2 and September 3 (Exs. 021, 022, 026); on August 2 it ordered the personnel of the City, care facilities, hospitals, clinical and limited health care settings, shelters, correctional facilities, schools including post-secondary, child care, home care and first responder entities to be fully vaccinated by September 30, 2021 (Ex. 023; amended Sept. 1, Ex. 025); on August 17 it required masks of everyone two and older in every school and child care facility (Ex. 024). TCHD's dial order ran to August 15 and its school mask orders took effect August 23 and, universally and without opt-out, September 1 through December 31, 2021 (Exs. 079, 081, 082). JCPH extended its dial order's observation period to September 15 and required masks of everyone three and older plus regular testing of unvaccinated staff in every pre-K-12 and child care setting from August 17 (Exs. 103, 102). Boulder County required masks in schools from August 10 and in all indoor public spaces for everyone two and older from 5:00 p.m. September 3, 2021 (Exs. 032, 033). The First and Seventeenth Judicial Districts re-imposed courthouse masking from August 2, 2021 (Exs. 058, 066), the Twentieth's civil jury trials resumed only from July 19, 2021 (Ex. 068), and RTD's rider mask mandate ran through September 13 and then January 18, 2022 (Exs. 034, 047). Colorado never preempted its local health agencies; every instrument here carried force of law under C.R.S. 25-1-506 to -516 or D.R.M.C. 24-16 and 24-24.

The State and the local orders

None. Colorado's county and district public health agencies act under C.R.S. 25-1-506 (powers and duties of county and district public health agencies), 25-1-508 (public health directors) and 25-1-509 (emergency orders), and enforce under C.R.S. 25-1-114 and 25-1-516 (misdemeanor; injunctive relief; reimbursement of expenses); Denver acts under section 24-16 of the Denver Revised Municipal Code and enforces under section 24-24 (recited in every DDPHE order: 'it is unlawful for any person to fail to comply with this Order. Any person who fails to comply with this Order may also be subject to a civil penalty of up to nine hundred ninety-nine dollars ($999.00) per violation'). The State's orders set floors; the Governor's stay-home order let counties be stricter, the Safer at Home framework operated through county variances, and the State's April 16, 2021 transition returned the dial to local control (recited in Exs. 079, 096, 030: 'On April 16, 2021, PHO 20-36 expired and the COVID-19 Dial became non-mandatory guidance at the State level'). The only in-period friction was internal to TCHD: its Board's policy of November 6, 2020 (recited in Ex. 081) allowed a member county to opt out of a TCHD order by written resolution of its governing body; Douglas County exercised that opt-out against the July 10, 2020 face covering order (TCHD's own site: 'counties that opted out of the TCHD mask order remain under the state order') and against the August 18, 2021 school mask order (opt-out deadline Sept. 1, 2021, Ex. 081); the September 1, 2021 universal school order carried no opt-out (Ex. 082); Douglas County's withdrawal from TCHD and the federal litigation over its own Board of Health's October 8, 2021 opt-out order fall after September 30, 2021 and are not relied on.
