Operative words

Any employer or owner who violates or fails or refuses to comply with any provision of this subchapter, any lawful order of the Director of the Division of Labor, or any judgment or decree made by any court in connection with the provisions of this subchapter for which no penalty has been otherwise provided shall be guilty of a misdemeanor.

Penalty

Misdemeanor: $10-$100 fine or imprisonment up to six months, or both; each day a separate offense

Enforces the 11-2-117 safe-workplace duty by misdemeanor: fine of $10 to $100 or imprisonment up to six months, or both, for each offense, with each day the violation continues a separate offense (subsecs. (b)-(c)); 11-2-105 allows the penalty to be recovered in a civil action.
