Operative words

While the Wyoming Department of Health and Governor's Office did not prohibit elective procedures through statewide orders, hospitals and providers were encouraged to follow guidance from CMS and CDC that recommended suspending these procedures in order to preserve PPE and protect Wyoming's hospital capacity during the outbreak.... 3. Hospitals and providers should work with their County Health Officer and the State Health Officer in determining if the 'gating criteria' outlined in the CMS recommendations have been met in the region, before resuming non-emergent and elective procedures.... 8. PPE provided by the State of Wyoming shall not be used for non-emergent care or elective procedures.

Wyoming's own statement that its elective-procedure suspension in March-April 2020 operated through federal CMS/CDC recommendations rather than a State order; the memoranda plead the federal instruments (CMS March 18, 2020 recommendations; FED files) and this State guidance as the facts and circumstances of the resumption.
