Operative words

1. Effective immediately each nursing home licensed by ODH or certified by the U.S. Department of Health and Human Services Centers for Medicare and Medicaid Services (CMS) or by the Ohio Department of Medicaid, shall perform COVID-19 testing for residents and staff.... a. Fully vaccinated staff do not have to be routinely tested.... b. All unvaccinated staff shall be tested at least twice per week.... c. Regardless of vaccination status, staff and residents with symptoms or signs of COVID-19 shall be tested. d. Regardless of vaccination status, all staff and residents shall be tested upon identification of a single new case of COVID-19 infection in any staff or resident... Exposed residents and staff should be retested every 3 days to 7 days until testing identifies no new cases of COVID-19 for a period of 14 days.... Accordingly, this Order shall replace all prior Orders regarding testing at Ohio's Nursing Homes. This Order shall be effective immediately and remain in full force and effect until the Director of the Ohio Department of Health rescinds or modifies this Order...

Notes

The principal State instrument in force throughout 2021 Q3; the July 1, 2022 rescission (Ex. OH-073) dates the nursing-home testing orders 'May 21, 2020, and March 23, 2021' and omits May 4, 2021, a discrepancy in ODH's own recital; the May 4, 2021 order states that it 'shall replace all prior Orders regarding testing at Ohio's Nursing Homes.'
