Operative words

(7) The director, under rules adopted by the board of health and welfare, shall have the power to impose and enforce orders of isolation and quarantine to protect the public from the spread of infectious or communicable diseases or from contamination from chemical or biological agents... (c) Any person who violates an order of isolation or quarantine shall be guilty of a misdemeanor.

What it required

Every person in Idaho to obey an order of isolation or quarantine imposed by the Director of Health and Welfare, on pain of a misdemeanor; the statutory basis recited in the statewide Order to Self-Isolate (Ex. ID-003 sec. 9 and penalty clause), the Stay Healthy Orders (Exs. ID-004 to ID-007, ID-009 to ID-011) and the Central District Health orders (Exs. ID-022 to ID-025). Retrieval note

Subsection (7)(a) (2020 text) provided that on judicial review the court 'shall affirm the order if it appears by a preponderance of the evidence that the order is reasonably necessary to protect the public from a substantial and immediate danger of the spread of an infectious or communicable disease'. The Order to Self-Isolate, the Stay Healthy Orders and the district orders all recited this subsection as their authority and its subsection (c) as their penalty.
