Operative words
Every person who maintains or commits any public nuisance, the punishment for which is not otherwise prescribed, or who wilfully omits to perform any legal duty relating to the removal of a public nuisance, is guilty of a misdemeanor.
Penalty
Misdemeanor; Idaho Code § 18-113
What it required
Made it a misdemeanor to maintain a public nuisance or to omit willfully 'any legal duty relating to the removal of a public nuisance'; the statute's own words recognize a 'legal duty' on the person in control of a condition injurious to health.
