Operative words

The county health officer shall place any restrictions upon ingress and egress at this location as in his judgment or in the judgment of the state health officer are necessary to prevent the spread of the disease from the infected locality.... If necessary for the protection of the public health... the state health officer shall establish and maintain a state quarantine

Penalty

35-4-101: misdemeanor, fine of not more than $100 or imprisonment not exceeding 30 days, or both, or such penalty as provided by law; 35-4-105: fine of not more than $500 or imprisonment of not more than one year; general penalty of 35-1-106 for disobeying a health officer's order

What it required

The Department 'shall have the power to prescribe rules and regulations for the management and control of communicable diseases' and 'Any persons violating or refusing to obey such rules and regulations or resisting or interfering with any officer or agent of the state department of health... shall be deemed guilty of a misdemeanor' (35-4-101); on report of an infectious or contagious disease that 'is a menace to the public health' the health officers shall investigate, may declare a place in quarantine with restrictions on ingress and egress, shall 'control the population' of the quarantined place, shall maintain a State quarantine and 'enforce practical regulations regarding railroads or other lines of travel into and out of the state', and may employ police officers 'to enforce and carry out any quarantine regulations' (35-4-103); escape from quarantine is a crime (35-4-105).

Retrieval note

35-4-103 is the second authority recited in every statewide order (State records: 'W.S. 35-1-240(a)(i), (ii), (iv) and 35-4-103'). 35-4-112 (right of appeal of quarantine) qualifies the quarantine power. 35-4-115(a)(ii)(B) defines 'Quarantine' to include 'The isolation of a geographic area' (DUT-WY-006).
