Operative words
Any person processing, distributing, storing or preparing any food for sale shall obtain a license from the department of agriculture or a local health department.... No food establishment shall serve, hold for sale or sell food to the public without a valid license.
Penalty
35-7-113(a): misdemeanor, imprisonment of not more than six months, fine of not more than $750, or both; on a subsequent conviction one year and $1,500; embargo of adulterated articles (35-7-114); license suspension or revocation (35-7-124(b))
What it required
Every food establishment must hold and display an annual license (35-7-124(a)); 'No person shall: (i) Violate this act or any rules promulgated under it' or 'Refuse to permit entry, inspection or access to records' (35-7-111(a)(i), (v)); a knowing and intentional violation is a misdemeanor (35-7-113(a)).
