Operative words

A person subject to isolation or quarantine shall obey the public safety authority's rules and orders, shall not go beyond the isolation or quarantine premises, and shall not put oneself in contact with any person not subject to isolation or quarantine

What it required

During a public health emergency the public safety authority may establish places of isolation and quarantine and 'require isolation or quarantine of any person by the least restrictive means necessary to protect the public health'; a person under isolation or quarantine 'shall obey' the authority's rules and orders; no unauthorized person 'shall enter' the premises; and the public health authority and public safety authority 'shall have the power to enforce the provisions of this subchapter through the imposition of fines and penalties, the issuance of orders, and such other remedies as are provided by law' (§ 3143).

§ 3132(11): 'Public health authority' means the Secretary of Health and Social Services or such person as the Secretary may designate with the Governor's consent. § 3144(b): 'During a state of emergency, any private person, firm or corporation or employee or agent of such person, firm or corporation who renders assistance or advice at the request of the State or its political subdivisions under the provisions of this subchapter shall be considered a public employee under §§ 4001-4002 of Title 10'; § 3144(c) withholds that immunity from any person 'whose act or omission caused, in whole or in part, the emergency.' The Omnibus Modification § A.4 reserves DEMA's power to issue isolation and quarantine orders 'pursuant to 20 Del. C. § 3136' and DPH's power 'pursuant to 16 Del. C. § 505' (Ex. DE-031).
