Operative words

In addition to following all directives of the Governor as outlined in proclamations, entities considering reopening must adhere to the following public health guidance: 1. Follow CDC guidance... 6. Members of the public and employees should consider the use of cloth face coverings (when practical) if staying at least 6 feet away from others is not possible.

Penalty

none in the document; the incorporating proclamation was enforceable by peace officers (§§ 29C.18, 135.35) and by license sanction (§ 123.39; DIA food licensing), and knowing violation of the Department-conjoined order was a simple misdemeanor (§ 135.38).

What it required

The IDPH guidance that the proclamations incorporated by the words 'consistent with guidance issued by the Iowa Department of Public Health': its own preface uses 'must adhere'; its nine items use the imperative for cleaning per CDC guidance, six-foot reminders and floor markings, door signage excluding symptomatic and exposed persons, and removal of persons who become ill, and 'should consider' for cloth face coverings and 'should' for outbreak reporting and employee messaging. Its legal effect on a reopened establishment came from the proclamation's 'shall also implement reasonable measures... consistent with guidance issued by' IDPH (IA-012, IA-018) and, from July 1, 2020, from § 686D.5's safe harbor, which turns on consistency with 'public health guidance' (DUT-IA-007).

The saved copy is the IDPH document as posted by O'Brien County, Iowa (county government mirror); The Attorney General's FAQ (DUT-IA-009 § 1.3) refers to this document by title as the Department's 'general reopening guidance.' Its 'Other Resources' list the federal OSHA Guidance on Preparing Workplaces for COVID-19 (OSHA 3990; AGY-FED-LABOR-IMMIGRATION-029).
