Operative words
(1) Each employer: (a) Shall furnish to each of his employees employment and a place of employment which are free from recognized hazards that are causing or are likely to cause death or serious physical harm to his employees; (b) Shall comply with occupational safety and health standards promulgated under this chapter.
Penalty
KRS 338.991: civil penalties up to $7,000 per serious violation, $70,000 per willful or repeated violation, $7,000 per day for failure to abate
What it required
Bound every Kentucky employer, throughout the six quarters, to a place of employment free from recognized hazards likely to cause death or serious physical harm and to compliance with the Kentucky OSH standards (803 KAR ch. 2), the standing vessel that the CDC, DPH and Healthy at Work protocols filled with content.
Retrieval noteKentucky's counterpart to 29 U.S.C. 654(a)(1)-(2); the Kentucky OSH Program (Labor Cabinet, Department of Workplace Standards) enforces it in place of federal OSHA for private employers. 2021 SB 5 sec. 1(4)(d) preserves 'the applicability of KRS Chapter 338' (Ex. DUT-KY-014).
