Operative words
(1) Food establishments shall comply with the sanitation standards and processes contained in the Department of Health and Senior Services Missouri Food Code manual. The manual is incorporated by reference in this rule as published June 3, 2013, by the Department of Health and Senior Services
Penalty
Permit and license sanctions and closure under the Food Code and local ordinances; RSMo 192.320 (class A misdemeanor) for violation of chapter 192 provisions and the rules made under § 192.020
What it required
Every Missouri food establishment must comply with the Missouri Food Code (the Department's adoption of the FDA Food Code), which governs employee health, exclusion and restriction of ill food employees, handwashing, sanitation and the duties of the person in charge; the local public health agencies that enforce the Food Code under RSMo 192.300 and city ordinances were the same agencies the COVID-19 orders directed to enforce their protocols against restaurants and food retailers.
