Operative words

(1) The State Board of Health shall adopt rules and regulations (a) defining and classifying communicable diseases and other diseases that are a danger to health based upon the characteristics of the disease; and (b) establishing reporting, monitoring and preventive procedures for those diseases.

What it required

The Board must adopt communicable-disease rules with 'preventive procedures'; the Rules Governing Reportable Diseases and Conditions (Ex. DUT-MS-004) and the classification that names COVID-19 outbreaks a Class 1A condition are those rules; subsection (2) imposes reporting duties on attending physicians, persons in charge of hospitals and medical examiners.
