Operative words

(1) An employer who is the owner or lessee of any real property in this state shall not construct or cause to be constructed or maintained any place of employment that is unsafe. (2) Every employer who is the owner of a place of employment or lessee thereof shall repair and maintain the same as to render it safe.

Penalty

As DUT-MT-010: no penalty in part 2; public sector enforcement under 50-71-116 to -120; federal OSHA for private employers

What it required

The employer that owns or leases its premises 'shall not... maintain any place of employment that is unsafe' and 'shall repair and maintain the same as to render it safe'; the physical modifications of 2020-2021 (barriers, spacing, ventilation, closed common areas, occupancy limits) are the maintenance this section commands.
