Operative words
(1) To promote health and safety in places of employment in this state: (a) each public or private employer shall establish and administer a safety program in accordance with rules adopted by the department pursuant to 39-71-1505;... (3) The department may issue a safety recommendation to an employer who fails to comply with the requirements of this section
Penalty
Department 'safety recommendation' for noncompliance ((3)); 39-71-1502 (read; not saved) states the Act's purpose as reducing 'occupational injury and illness' and that 'The creation of a safety culture requires employers to provide training and education'
What it required
Every public or private employer 'shall establish and administer a safety program' under the Department of Labor and Industry's rules, including temporary workers ((2)); the written COVID-19 exposure-control and screening policies the Directives told employers to 'develop and implement' (Ex. MT-013, MT-014, MT-020, MT-021) were the content of a program Montana law already required every employer to maintain.
