Operative words

The organization shall have full power and jurisdiction over and supervision of every place of employment subject to this title. Whenever necessary to enforce and administer this title, the organization may issue and enforce all rules and safety regulations. The organization may designate an individual to make inspections and determine if safety regulations are being followed.

Places every North Dakota place of employment under the standing supervisory and rulemaking jurisdiction of Workforce Safety and Insurance for safety, with inspection to 'determine if safety regulations are being followed' (65-03-01), and charges WSI to 'create and operate work safety and loss prevention programs to protect the health of covered employees' (65-03-04);

Retrieval note

North Dakota has no OSHA-approved State plan; the general workplace duty is federal (Ex. DUT-ND-008). Chapter 65-03 is the State's own supplement. Executive Orders 2020-12 and 2020-12.1 (Ex. ND-029) adjusted WSI coverage for COVID-19 exposure; the workers' compensation orders were terminated by EO 2021-05 (Ex. ND-076).
