Operative words
433.441(3) During a declared public health emergency, the Governor may: (a) Close, order the evacuation of or order the decontamination of any facility... (d) Control or limit entry into, exit from, movement within and the occupancy of premises in any public area... 433.010(1) No person shall willfully cause the spread of any communicable disease within this state.
Penalty
Violation of ORS 433.010 is a Class C felony (433.990(2)); violation of 433.004 or 433.008 is a Class A misdemeanor (433.990(1)); knowing failure to comply with requirements imposed by the Public Health Director under 433.443(2) carries civil penalties of up to $500 per day of violation (433.443(2)(a)(F), (3)); State and local law enforcement 'must assist' in enforcing isolation, quarantine and property-isolation orders (433.138) and 'shall cooperate' in enforcing isolation or quarantine (433.156).

Bound every person in Oregon not to cause the spread of a communicable disease, subjected every facility and every premises open to the public to closure, decontamination and control of entry, movement and occupancy at the Governor's order (433.441(3), made available in any ORS 401.165 emergency by 433.441(4), and recited as the source of EO 20-12, EO 20-25 para. 6 and every successor order), authorized the Public Health Director to 'Order, or authorize local public health administrators to order, public health measures appropriate to the public health threat presented' (433.443(2)(a)(C)), required 'any public or private entity' to permit inspection and release of information in an outbreak investigation (433.004(3)(b)), and placed persons and premises under isolation and quarantine orders enforced by State and local law enforcement (433.121, 433.138, 433.156). ORS 433.441(4): 'If a state of emergency is declared as authorized under ORS 401.165, the Governor may implement any action authorized by ORS 433.441 to 433.452'; EO 20-25 para. 6 recites 'Pursuant to ORS 433.441(3)(a), (b), (d), and (f), ORS 401.168(1), and ORS 401.188(1) to (3)' (Ex. OR-017), and the Court of Appeals confirmed the pathway in JGB Enterprises, 325 Or App at 328-29 (DUT-OR-017) and Along Came Trudy, 330 Or App at 299-300 (DUT-OR-016). ORS 433.443(2)(a)(F): 'Take any enforcement action authorized by ORS 431A.010, including the imposition of civil penalties of up to $500 per day against individuals, institutions or facilities that knowingly fail to comply with requirements resulting from actions taken' under the section.
