Operative words
if the governor issues an executive order declaring a state of emergency, the governor may:... (b) employ measures and give direction to state and local officers and agencies that are reasonable and necessary for the purpose of securing compliance with the provisions of this part and with orders, rules, and regulations made pursuant to this part
Penalty
Compliance secured through State and local officers and agencies under subsection (1)(b); the Health Code penalties attach to the Department of Health's concurrent orders (Ex. DUT-UT-003)
What it required
During a declared state of emergency the Governor could direct State and local officers and agencies to secure compliance with the Act and with orders under it, and could 'control ingress and egress to and from a disaster area, the movement of persons within the area, and recommend the occupancy or evacuation of premises in a disaster area' (subsection (1)(f)); Exs. UT-012, UT-015, UT-021, UT-029 recite subsections (1)(a) and (1)(b) as their authority. Character as recorded: statutory_authority (enabling power; binds through the orders issued under it).
