Operative words

The commission may assess civil penalties against any employer who has received a citation under Section 34A-6-302 as follows: (a)... up to $7,000 for each cited violation. (b) The commission may not assess less than $250 nor more than $7,000 for each cited serious violation... (c) The commission may not assess less than $5,000 nor more than $70,000 for each cited willful violation.

What it required

Gave the employer's general duty and standards compliance under section 34A-6-201 their sanction: civil penalties per violation, per serious violation ('a substantial possibility that the condition, practice, method, operation, or process could result in death or serious physical harm'), per willful violation and per day of uncorrected violation.
