Operative words

Whoever intentionally fails to comply with an order issued by an agent of the state or of a local unit of government who is engaged in emergency management activities under this chapter, including training exercises, is subject to a forfeiture of not more than $200.

Penalty

Forfeiture not more than $200 per violation (recited in Emergency Order #1 (Face Coverings) § 7, Ex. WI-009: 'This order is enforceable by civil forfeiture of not more than $200. Wis. Stat. § 323.28.').

What it required

Every person was bound, under a civil forfeiture, to obey the Governor's emergency orders under § 323.12(4)(b) and the emergency orders of local units of government under ch. 323; the statewide face-covering orders recited this section as their enforcement provision.

Retrieval note

Local emergency powers under §§ 323.11 and 323.14 (noted in OAG-03-20 n.1) carry the same penalty.
