Notes

Subsec. (b): a State may assume responsibility for development and enforcement of standards by submitting a State plan; subsec. (c)(2): the plan's standards must be 'at least as effective in providing safe and healthful employment and places of employment as the standards promulgated under section 655'. The legal basis of the State-plan COVID-19 rules (Virginia, Michigan, California, Oregon, Washington, Kentucky, Utah, Maryland, Hawaii, Iowa, Alaska, Vermont, North Carolina) pleaded in the analysis.
